Chapter I General Provisions Article 1 These Measures are formulated in accordance with the People's Republic of China (PRC) Water Law, the People's Republic of China (PRC) Flood Control Law, the People's Republic of China (PRC) Mineral Resources Management Law, the People's Republic of China (PRC) River Management Regulations and other laws and regulations, and in combination with the actual situation of this Municipality, in order to standardize the sand excavation in rivers in our city, rationally develop, utilize and protect sand resources, and protect and improve the ecological environment. Article 2 The sand and gravel mentioned in these Measures refers to river sand and non-river sand.

River sand refers to sand and gravel resources within the management scope of rivers (including rivers, lakes, reservoirs, artificial waterways, flood discharge areas, flood storage and detention areas, etc.). ).

Non-river sand and gravel refers to the surface and underground sand and gravel resources beyond the management and protection scope of waters, sandbanks, beaches, flood discharge areas, dikes and berms on both sides of rivers, reservoirs, artificial waterways and flood storage and detention areas. Third units and individuals engaged in the exploitation, processing, utilization and operation of sand and gravel resources within the administrative area of this Municipality shall abide by these measures. Article 4 Sand and gravel resources belong to the state and will not be changed due to the different ownership or use right of the land to which they are attached. No unit or individual may illegally exploit, occupy, trade, lease or destroy sand and gravel resources in any way. Article 5 The municipal water administrative department is the supervision and management department of sand and gravel resources within the river course and river course management scope, responsible for the unified management, supervision and inspection of river sand mining in this Municipality, and supervising and guiding the river sand mining management of the county (district) water administrative department.

The water administrative department of the county (district) is specifically responsible for the management, supervision and inspection of river sand mining within its administrative area, and is responsible for the safety of river sand mining within its administrative area.

The municipal administrative department of land and resources is the supervision and management department of non-river sand and gravel resources in this Municipality. Responsible for the supervision and management of the exploitation of sand and gravel resources outside the river in this Municipality. Supervise and guide the management of sand and gravel resources by the administrative departments of land and resources of counties (districts).

County (District) administrative departments of land and resources shall be responsible for the supervision and management of sand and gravel resources exploitation within their respective administrative areas. Management matters such as the establishment, extension, change of registration, certification and cancellation of registration, annual inspection, reserves review and filing, development and utilization plan review and filing of mining rights shall be reported to the municipal government for approval by the administrative department of land and resources of the county (district). Article 6 The relevant departments of the people's governments at or above the county level, such as public security, environmental protection, development and reform, finance, transportation, housing and urban and rural construction, industry and commerce, taxation, safety supervision, forestry and greening, agriculture and animal husbandry, shall, according to their respective functions and duties, assist in the related work of river sand mining. Chapter II Planning of River Sand Excavation Article 7 The planning of river sand excavation shall fully consider the requirements of flood safety, river regime stability and ecological environment, and conform to the professional planning of comprehensive river basin planning, flood control and river regulation. Article 8 The water administrative department of a county (district) shall be responsible for compiling the river sand mining planning within its administrative area, and the planning shall solicit the opinions of other relevant departments at the same level, and after being approved by the municipal water administrative department, it shall be reported to the people's government at the same level for approval and implementation.

City directly under the management of water conservancy projects and the Lhasa River sand mining planning, by the municipal water administrative department or its authorized relevant units to organize the preparation, solicit the opinions of other relevant departments at the same level, submitted to the Municipal People's government for approval and implementation.

Sand mining planning involving cities and counties (districts) boundary rivers and other boundary rivers shall be formulated by both parties through consultation and submitted for approval according to their authority. Article 9 The administrative departments of land and resources of counties (districts) shall, according to the needs of economic construction and social development, jointly with the relevant functional departments, and in accordance with the principle of sustainable development, make a unified plan for the sand and gravel resources of counties (districts), and announce the organization and implementation after reporting to the higher authorities for approval.

River sand mining planning should follow the principle of giving priority to river dredging, supplemented by river sand mining, unified planning and step-by-step implementation. Areas that do not have the conditions for sand mining planning can also be planned by stages and stages.

Once the sand mining plan is approved, it shall be strictly implemented. If it is really necessary to modify it, the preparation unit shall submit it for approval in accordance with the original planning procedures. Tenth sand mining planning shall include the following contents:

(a) the forbidden mining area and quasi mining area, there are water conservancy projects within the planning scope, to delimit a reasonable control zone outside the scope of protection stipulated in its specifications;

(2) mining period and mining period;

(three) the annual total sand mining, mining depth, length and width, mining control elevation;

(four) mining methods and the number of sand mining machinery;

(5) Waste disposal methods and site cleaning requirements;

(6) Analysis of sand mining impact. Eleventh the following areas should be listed as prohibited mining areas:

(a) the scope of safety protection of river flood control projects, river regulation projects, reservoirs, hydrological observation facilities, culverts, water intake, drainage, hydropower stations and other projects;

(2) Dangerous works, dangerous sections, berms and planned reserved areas of the river;

(3) Rivers, important landscape belts and river landscape corridors within the urban planning area;

(four) the safety protection scope of roads, railways, bridges, communication cables, river-crossing pipelines, tunnels and other engineering facilities;

(five) drinking water source protection areas, nature reserves, wildlife habitats under special protection by the state and autonomous regions, and areas directly affecting water ecological protection;

(six) waters with unclear boundaries or major ownership disputes;

(seven) other areas where sand mining should be prohibited according to law.
