Article 1 In order to conscientiously implement the Party's ethnic policies, respect the customs and habits of Hui and other ethnic minorities, strengthen the management of halal food, standardize and prosper the halal food market, these measures are formulated in accordance with the relevant provisions of the Food Sanitation Law of People's Republic of China (PRC) and the Regulations on Urban Ethnic Work of Yunnan Province, and combined with the actual situation of this Municipality. Article 2 The Hui and other ethnic minorities mentioned in these Measures refer to ten ethnic minorities with muslim food customs, such as Hui, Uygur, Kazak, Kirgiz, Uzbek, tatar people, Tajik, Dongxiang, Baoan and Salar (the same below).

The term "Muslim food" as mentioned in these Measures refers to meat and poultry, catering, candy, cakes and other foods slaughtered, purchased, produced, sold, stored and transported in accordance with the traditional living habits of Hui and other ethnic minorities (the same below). Article 3 All units and individuals that produce and operate halal food within the administrative area of this Municipality shall abide by these Measures. Article 4 The ethnic affairs departments of the municipal, county (city) and district people's governments are the supervision and management departments of halal food in this Municipality.

The administrative departments of industry and commerce, taxation, public security, health, price, urban construction, environmental protection, agriculture and animal husbandry at all levels shall, according to their respective functions and duties, cooperate with the ethnic affairs departments to do a good job in the supervision and management of halal food. Article 5 Units and individuals engaged in the production and operation of halal food shall meet the following conditions:

(a) among the leading members of the unit, there should be Hui and other minority citizens;

(two) the owners of individual and private enterprises must be Hui and other minority citizens;

(three) key positions such as buyer, keeper and chef are held by Hui and other ethnic minorities;

(4) Hui and other ethnic minority workers in production units shall not be less than 20% of the total number of employees in this unit; Hui and other ethnic minority employees in institutions shall not be less than 25% of the total number of employees in the unit; Employees of Hui and other ethnic minorities in catering units shall not be less than 30% of the total number of employees in this unit;

Employees who have no customs and habits in muslim food must be trained before they can take up their posts.

(five) the production and operation of halal food must meet the requirements of food hygiene. Article 6 Production and operation of Muslim food such as cattle, sheep, chickens and ducks. Must be slaughtered according to halal customs; If you go out for shopping, you should go to a place with a halal sign. Seventh halal food producers and operators shall not produce and operate meat and its finished products and mixed products that are taboo for Hui and other ethnic minorities. Eighth employees and customers are not allowed to bring food and other items taboo by Hui and other ethnic minorities into the halal food production and business premises. Ninth non-professional halal food shopping malls and shops set up halal food counters, Hui and other ethnic minorities should participate in the management, and their operators shall not be mixed with non-halal food operators.

Muslim food and non-Muslim food should be stored in different cabinets and sold separately. Article 10 The competent department of bazaars shall rationally arrange the stalls in muslim food that enter the bazaars, and keep a proper distance from the non-muslim food stalls. Eleventh halal food packaging, there shall be no taboo words and patterns of Hui and other ethnic minorities, halal food packaging shall not be sold or transferred to non-halal food producers and operators. Article 12 Anyone who produces and markets halal food shall hold a hygiene license issued by the health department at or above the county level, a business license issued by the industrial and commercial department and a halal sign under the unified supervision of the Kunming Ethnic Affairs Commission before engaging in production and marketing activities. Thirteenth units and individuals that have not obtained the halal logo shall not publish advertisements for halal food without the halal logo, and shall not produce and operate halal food; Signs with the words "halal", "Hui" and "Muslim" shall not be used, posted or hung on production and business premises and product packaging. Fourteenth any unit or individual shall not forge, transfer or resell halal signs, and shall not use expired and halal signs outside the city. Fifteenth halal food producers and operators to apply for signs, can only apply within their respective administrative areas; Need to go to other counties (cities) in this city to produce and operate halal food, it should go to the local ethnic affairs department to re-apply for halal signs. Sixteenth halal food management to implement the principle of combining professional supervision and mass supervision:

(a) the ethnic affairs department of the people's government of the city, county (city) District shall, in conjunction with the relevant departments of industry and commerce, health and other departments, regularly or irregularly supervise and inspect the halal food industry within its jurisdiction.

(two) the city, county (city), district ethnic affairs departments should hire Hui and other ethnic minorities as halal food duty supervisors to carry out regular supervision activities.

When conducting supervision activities, the halal food supervisor shall produce the "halal food supervision certificate" uniformly produced by the municipal ethnic affairs department. Seventeenth halal sign management personnel should be verified once a year, and the halal sign that has not been verified due will automatically become invalid. Certification bodies are responsible for certification. Eighteenth ethnic affairs departments to deal with the owners and supervisors of halal food production and operation enterprises to carry out ethnic policy, halal food management regulations training. Nineteenth halal food producers and operators who abide by and implement these measures shall be commended by the ethnic affairs departments of the people's governments at all levels. Twentieth in violation of the provisions of any of the following circumstances, the city and county (city), the district government departments of ethnic affairs shall be punished:

(a) halal food production operators do not hang halal license plate, do not have the conditions for halal food production and operation, shall be ordered to make corrections within a time limit, overdue correction, the operators shall be fined 200 to 500 yuan.

(two) in violation of the provisions of article sixth, article seventh, article eighth and article ninth of these measures, it shall be ordered to make corrections within a time limit. If no correction is made within the time limit, the unit shall be fined above 500 yuan 1000 yuan, and the individual shall be fined above 200 yuan 1000 yuan.

(III) Whoever, in violation of the provisions of Article 11 of these measures, pretends to be halal meat with meat taboo by Hui and other ethnic minorities, or labels other non-halal foods as halal food for sale, shall be fined from 500 yuan to 800 yuan and corrected within a time limit.
