According to Article 51 of the Law of People's Republic of China (PRC) on Tax Collection and Management, if the tax authorities find that the tax paid by taxpayers exceeds the tax payable, they shall return it immediately. If a taxpayer finds out within three years from the date of final settlement of the tax, he may request the tax authorities to refund the overpaid tax plus the interest on the bank deposits in the same period, and the tax authorities shall immediately refund it after timely verification. Those involved in withdrawing the treasury shall be returned in accordance with the provisions of laws and administrative regulations on treasury management. If the tax refund period exceeds three years, it shall not apply for refund of the overpaid tax in accordance with the regulations. Contact the tax department immediately and provide proof that can reflect cross-taxation.
