Conditions and procedures for deferred payment of taxes
Conditions for extension of filing: Taxpayers and withholding agents need to extend the time limit for filing tax returns or submitting tax withholding and collecting reports. Natural persons and legal persons who are obligated to pay taxes and pay taxes directly to the government according to the tax law. Natural persons refer to domestic citizens and foreign citizens who live or engage in economic activities in their own countries; Legal person refers to enterprises and mass organizations established according to law, enjoying civil rights and being able to bear civil liabilities independently.

The conditions for deferred tax payment are as follows:

1. The taxpayer suffers heavy losses due to force majeure, and the normal production and business activities are greatly affected;

2. The current monetary funds are not enough to pay taxes after deducting the wages and social insurance premiums payable to employees.

The procedures for deferred payment of taxes are as follows:

1. The application should be made before the tax payment period expires;

2. Submit relevant materials;

3, the tax authorities shall make a decision of approval or disapproval within 20 days from the date of receiving the application for deferred payment of taxes;

4. If it is not approved, a late payment fee of 0.5‰ will be added from the date when the tax payment period expires.

The detailed rules for the implementation of the Tax Administration Law explain the "special difficulties" and the examination and approval authority of the Tax Administration Law as follows:

1. The taxpayer suffers heavy losses due to force majeure, and the normal production and business activities are greatly affected;

The State Taxation Bureau and the Local Taxation Bureau of cities under separate state planning have the right to examine and approve taxpayers' deferred tax payment.

Article 31

Taxpayers and withholding agents shall pay or remit taxes in accordance with the provisions of laws and administrative regulations or the time limit determined by tax authorities in accordance with laws and administrative regulations.

Taxpayers who are unable to pay taxes on time due to special difficulties may, with the approval of the State Taxation Bureau and the Local Taxation Bureau of provinces, autonomous regions and municipalities directly under the Central Government, postpone paying taxes for a maximum of three months.
