The measures referred to in administrative law enforcement personnel, refers to the administrative law enforcement organs (including organizations authorized by laws and regulations to perform administrative law enforcement duties, the same below), organizations entrusted to perform administrative law enforcement duties (hereinafter referred to as entrusted law enforcement organizations) to obtain administrative law enforcement qualifications, perform administrative licensing, administrative punishment, administrative enforcement, administrative collection, administrative fees, administrative inspection, administrative confirmation and other administrative law enforcement duties of on-the-job staff.
The term "administrative law enforcement auxiliary personnel" as mentioned in these Measures refers to the auxiliary administrative law enforcement organs and their administrative law enforcement personnel employed by administrative law enforcement organs to perform administrative law enforcement duties. Article 3 The management of administrative law enforcement personnel and administrative law enforcement assistants shall adhere to the principle of combining unified management with the responsibility of different departments at different levels. Article 4 The people's governments at or above the county level shall uniformly lead the management of administrative law enforcement activities of administrative law enforcement personnel and administrative law enforcement assistants within their respective administrative areas. The specific work is the responsibility of the legal institution of the government.
Institutions, human resources and social security, finance and other departments and supervisory organs are responsible for the relevant management of administrative law enforcement personnel and administrative law enforcement assistants according to their respective responsibilities.
Administrative law enforcement organs and organizations entrusted with law enforcement are responsible for the daily management of their subordinate administrative law enforcement personnel and administrative law enforcement assistants. Chapter II Administrative Law Enforcement Personnel Article 5 The qualification management system for administrative law enforcement personnel shall be implemented. Persons who intend to engage in administrative law enforcement in administrative law enforcement organs and entrusted law enforcement organizations shall take the administrative law enforcement qualification examination, and after passing the examination, apply for the Hunan Provincial Administrative Law Enforcement Certificate according to procedures. "Hunan Province Administrative Law Enforcement Certificate" is renewed every five years.
If the relevant departments of the State Council uniformly issue administrative law enforcement certificates in accordance with the provisions of relevant laws and administrative regulations, they shall not apply for the Hunan Provincial Administrative Law Enforcement Certificate in accordance with these measures, but the relevant departments of the province shall report the basis for issuing certificates, the number of holders and the certificate style to the legal institution of the provincial people's government for the record, and make an announcement to the public. Sixth legal institutions of the provincial people's government unified organization of the province's administrative law enforcement personnel general legal knowledge training and examination; The relevant departments of the provincial people's government shall organize the specialized legal knowledge training and examination of administrative law enforcement personnel in this system.
Before the examination, the training and examination of general legal knowledge and specialized legal knowledge shall be conducted in the form of network, and no fees shall be charged. Seventh "Hunan province administrative law enforcement certificate" is the certificate of administrative law enforcement personnel in this province to obtain the qualification of administrative law enforcement. Personnel engaged in administrative law enforcement within the administrative region of this province shall apply for the Hunan Provincial Administrative Law Enforcement Certificate. There is no charge for applying for administrative law enforcement certificates.
Personnel who have not obtained the Hunan Provincial Administrative Law Enforcement Certificate or the Administrative Law Enforcement Certificate issued by the relevant departments of the State Council in accordance with the provisions of the second paragraph of Article 5 of these Measures shall not engage in administrative law enforcement work such as administrative licensing, administrative punishment, administrative coercion, administrative collection, administrative fees, administrative inspection and administrative confirmation.
Administrative law enforcement personnel engaged in investigation, administrative inspection, execution of administrative law enforcement decisions and other law enforcement activities directly facing citizens, legal persons and other organizations, should take the initiative to produce administrative law enforcement certificates. Citizens, legal persons or other organizations have the right to refuse if they do not produce it. Eighth administrative law enforcement personnel who have passed the administrative law enforcement qualification examination shall meet the following conditions when applying for the "Hunan Provincial Administrative Law Enforcement Certificate":
(a) the person who intends to engage in administrative law enforcement work in this position;
(2) Having good political quality;
(three) law-abiding, honest and diligent.
The staff of the administrative law enforcement organ shall not apply for the "Hunan Provincial Administrative Law Enforcement Certificate" in any of the following circumstances:
(a) the administrative law enforcement qualification examination is unqualified;
(2) Not working in the post of administrative law enforcement;
(three) off-the-job contract workers, temporary workers and other auxiliary administrative law enforcement personnel;
(four) the political quality is unqualified;
(five) due to violation of law and discipline is verified by administrative punishment or criminal punishment;
(six) the previous annual assessment is incompetent. Ninth intends to engage in administrative law enforcement personnel to apply for the "Hunan Province Administrative Law Enforcement Certificate", by the administrative law enforcement organs and entrusted law enforcement organizations to the people's government at the same level unified application. The specific audit and release work is the responsibility of the government legal institutions.
"Hunan Province administrative law enforcement certificate" shall be stamped with the special seal of the administrative law enforcement certificate of the people's government at the corresponding level. Article 10 Where an administrative law enforcement officer is damaged due to the adjustment of law enforcement posts or the certificate of administrative law enforcement, the administrative law enforcement organ or the entrusted law enforcement organization shall apply to the legal institution of the people's government at the corresponding level for renewal of the certificate of administrative law enforcement and return the restored certificate of administrative law enforcement.
If the administrative law enforcement certificate is lost, the administrative law enforcement organ and the entrusted law enforcement organization shall explain the situation in writing to the legal institution of the people's government at the corresponding level, and the legal institution of the people's government at the corresponding level shall re-apply after announcing the invalidation through newspapers or government websites.
Administrative law enforcement personnel are no longer engaged in administrative law enforcement, the administrative law enforcement certificate shall be cancelled by the legal institution of the people's government at the corresponding level, and published through the legal network of the provincial people's government.
