Measures for the Administration of Technical Qualification of Drilling Industry in Inner Mongolia Autonomous Region

Chapter I General Principles

Article 1 In order to strengthen the technical qualification management of drilling industry, standardize the construction market, ensure the quality of engineering construction, and make rational use of groundwater resources, according to the Measures for the Implementation of People's Republic of China (PRC) Water Law in Inner Mongolia Autonomous Region and the Technical Qualification Grade Standard of Drilling Enterprises in Inner Mongolia Autonomous Region (DB15/T1KLOC-0/6-96).

Article 2 These Measures shall apply to the application for technical qualification certification of drilling industry and the management of drilling technical qualification in the autonomous region.

The term "drilling industry" as mentioned in these Measures refers to enterprises and individuals engaged in the foundation engineering of water supply wells, drainage wells and cast-in-place piles for drilling groundwater resources.

Article 3 A drilling construction enterprise shall apply for technical qualification certification according to its registered capital, net assets, professional and technical personnel, mechanical equipment, performance and other qualifications. Only after passing the examination can they engage in drilling activities within the scope permitted by their qualification level.

Article 4 According to the Grade Standard of Technical Qualification of Drilling Enterprises (Enterprises) in Inner Mongolia Autonomous Region (DB15/T116-93) issued by the Technical Supervision Bureau of the autonomous region, the construction qualification of drilling industry in the autonomous region is divided into three grades (Grade I, Grade II and Grade III).

Article 5 The Water Resources Department of the autonomous region shall be responsible for the management of technical qualification of the drilling industry in the whole region.

Chapter II Technical Qualification Certification

Article 6 The technical qualification is divided into three levels, and the scope of contracted projects according to the Qualification Level Standard for Drilling Enterprises (Enterprises) in Inner Mongolia Autonomous Region (DB15/T116-93) shall be implemented.

Article 7 A newly established drilling construction enterprise shall go through the registration formalities in the administrative department for industry and commerce and obtain the Business License of Enterprise as a Legal Person, and then go to the water administrative department of the local Union City to collect and fill in the Application Form for Technical Qualification Certification of Drilling Industry in Inner Mongolia Autonomous Region, which is uniformly printed by the water administrative department of the local Union City. Only after the preliminary examination and approval of the water administrative department of the local Union City, can it apply for qualification.

To declare the technical qualification certification of drilling industry, the following materials shall be provided to the qualification management department:

(1) An application form for technical qualification certification of drilling industry;

(2) Business license of enterprise as a legal person;

(3) Articles of association of the enterprise;

(four) the title certificate and identity card of the legal representative of the enterprise and the person in charge of technology, finance and operation of the enterprise;

(five) the professional title certificate of the professional and technical personnel of the enterprise;

(six) the enterprise capital verification certificate;

(seven) other relevant documents and materials that need to be recorded.

Eighth drilling industry technical qualification certification and annual inspection take the form of industry self-discipline, supervised by the water administrative department of the autonomous region, and audited by the water conservancy engineering association of the autonomous region.

Article 9 When applying for qualification upgrading, a drilling construction enterprise shall provide the following information in addition to the information listed in Article 7 of these Measures to the qualification management department:

(a) the original enterprise qualification certificate;

(2) Annual financial statements of the enterprise;

(three) the representative project contract and quality acceptance data completed by the enterprise;

Tenth drilling industry technical qualification certificate is divided into original and duplicate, uniformly printed by the water administrative department of the autonomous region, valid for 5 years.

Article 11 An enterprise changes its name, address, legal representative, technical director, etc. , should be within one month after the change to the qualification management department for change procedures.

Chapter III Supervision and Administration

Twelfth water administrative departments at all levels should strengthen the supervision and management of the technical qualifications of the drilling industry.

Thirteenth enterprises that have obtained the technical qualifications of drilling industry must engage in production and business activities within the scope of the obtained grades. Drilling units that have not obtained the technical qualification grade shall not carry out drilling construction.

Fourteenth drilling industry technical qualifications to implement the annual inspection system, by the autonomous region water conservancy engineering association for the specific annual inspection of qualifications, the autonomous region water administrative department to implement supervision.

Article 15 The annual inspection of technical qualification of drilling industry shall be conducted according to the following procedures:

(1) An enterprise that has obtained the drilling technical qualification shall submit the annual inspection form, the drilling technical qualification certificate and other relevant materials to the qualification management institution within the specified time every year, and submit the business license of the enterprise as a legal person.

(2) The competent annual inspection department shall make an annual inspection conclusion on the technical qualification of drilling industry within 15 days after receiving the annual inspection data, and record it in the annual inspection record column of the copy of Technical Qualification Certificate of Drilling Industry.

Article 16 The content of the annual inspection of technical qualification of drilling industry is to check whether the qualification conditions of enterprises meet the qualification grade standards and whether there are violations of laws and regulations in terms of quality, safety and market behavior.

The annual inspection conclusion of technical qualification of drilling industry can be divided into three types: qualified, basically qualified and unqualified.

(1) If the qualification conditions of the enterprise fully meet the prescribed qualification grade standards, and no major quality accidents and illegal acts have occurred in the past year, the annual inspection conclusion is qualified.

(2) The qualification conditions of the enterprise have basically reached the prescribed qualification grade standard, (one index has reached more than 80%, and others have reached the standard requirements) and there have been no major quality accidents and illegal acts in the past year, and the annual inspection conclusion is basically qualified.

(three) in any of the following circumstances, the annual qualification inspection conclusion is unqualified:

1, any one of the net assets, personnel and business scale in the qualification conditions fails to reach 80% of the qualification grade standard, or any other one fails to reach the qualification grade standard;

2. Construction without obtaining a construction permit;

3. Subcontracting the contracted project or subcontracting it illegally;

4, in violation of the national mandatory standards for engineering construction;

5. Cut corners during construction, resulting in quality accidents;

6. Operators of technical jobs who need certificates according to regulations have not obtained certificates without training and examination, and the circumstances are serious.

Article 17 If the technical qualification of the drilling industry fails to pass the annual inspection, the water administrative department of the autonomous region shall re-verify its technical qualification grade. The re-approved qualification grade should be lower than the original qualification grade, and if it fails to meet the minimum qualification grade standard, its technical qualification shall be cancelled.

Eighteenth drilling industry technical qualifications for three consecutive years after passing the annual inspection, can apply for promotion to a higher level of qualification.

Nineteenth drilling units shall apply for upgrading the technical qualification of drilling industry within two months after the annual qualification inspection, and handle it in batches. Other changes in the technical qualification of the drilling industry shall be handled at any time.

Article 20 A degraded drilling unit that has been rectified for more than one year and verified by the qualification management institution of the autonomous region to meet the prescribed qualification standards, and during this period, no acts listed in Item (3) of Article 16 of these Measures have occurred, may re-apply for the original qualification grade in accordance with these Measures.

Article 21 The qualification certificate of a drilling enterprise that fails to participate in the annual inspection of technical qualification within the specified time shall automatically become invalid, and it shall not re-apply for technical qualification within one year.

Article 22 A drilling enterprise that holds the technical qualification certificate of drilling industry issued by the water administrative department of the autonomous region and needs to go out across provinces and regions to undertake production tasks shall abide by the relevant laws and regulations of the state, earnestly perform the contract, manage the engineering construction technology, and bear the economic and technical responsibilities in production and business activities.

Twenty-third drilling enterprises at all levels must randomly carry a copy of the technical qualification certificate of the drilling industry and accept the supervision and inspection of the staff of the water administrative departments at all levels.

Article 24 Units and individuals from other provinces, cities and districts who enter our region for drilling construction must register with the water administrative department at or above the county level where the construction is located with a copy of the technical qualification certificate of the drilling industry issued by the local provincial level, go through the certification procedures, and abide by the relevant provisions on the management of the drilling market in our region.

Chapter IV Supplementary Provisions

Twenty-fifth approach by the Inner Mongolia Autonomous Region Water Resources Department is responsible for the interpretation of.

Article 26 These Measures shall be implemented as of the date of promulgation.

In order to standardize and manage the drilling market in the autonomous region, strengthen the industry management of drilling units in the whole region, improve the quality of employees, and provide basic conditions for enterprises and individuals engaged in drilling water supply wells, taking groundwater resources, drainage wells and grouting pile foundation projects in the whole region to enter the drilling market in an equal and orderly manner.

The Measures clearly require drilling construction enterprises to apply for technical qualification certification according to their registered capital, net assets, professional and technical personnel, machinery and equipment, completed performance and other qualifications. Only after passing the examination can they engage in drilling activities within the scope permitted by their qualification grade.

Newly established drilling construction enterprises shall go through the registration formalities in the administrative department for industry and commerce, and after receiving the Business License of Enterprise as a Legal Person, they shall go to the water administrative department of the local Union City to receive and fill in the Application Form for Technical Qualification Certification of Drilling Industry in Inner Mongolia Autonomous Region, which is uniformly printed by the water administrative department of the local Union City, and apply to the water administrative department of the local Union City for qualification after being approved by the water administrative department for preliminary examination. Drilling units that have not obtained the technical qualification grade shall not undertake drilling construction. At the same time, it is also required to implement new technical qualification certification for all kinds of drilling units in the whole region from the date of document issuance.

In order to carry out this work in a healthy and orderly manner, according to the specific reality of economic development and drilling market development in recent years in the autonomous region, and in the spirit of facilitating enterprises and reducing examination and approval links, the Water Resources Department of the autonomous region revised the original Measures for the Administration of Technical Qualification of Drilling Enterprises (Enterprises) in Inner Mongolia Autonomous Region, and issued a new Measures for the Administration of Qualification of Drilling Construction Technical Schools in Inner Mongolia Autonomous Region. The units applying for the qualification grade certification of drilling technology shall be assessed with technical qualification grade. According to Article 28 of Chapter III of the Administrative Licensing Law of People's Republic of China (PRC), the construction technical qualification certification of drilling industry in the whole region shall be implemented by specific technical institutions of the industry. Entrust the Water Conservancy Engineering Association of the Autonomous Region to evaluate the technical qualification of the units applying for the certification of drilling technical qualification according to the local standard of Inner Mongolia Autonomous Region, Technical Grade Standard for Drilling Enterprises and Institutions DB15/T16-93, and specifically assist the local water conservancy department to do a good job in the daily management of drilling team qualification and the technical training of drilling technical workers. The evaluation results of drilling technology qualification are certified by the water administrative department of the autonomous region, and the qualification grade certificate is issued.
