Thoughts on further improving the reform of township institutions and personnel diversion
My opinion on immigration work
200 1 since the reform of township institutions, with the joint efforts of party committees, governments and relevant departments at all levels, the work of personnel diversion and resettlement has achieved initial results, but due to some factors, some personnel diverted from the reform of township institutions have not yet been put in place. In order to effectively solve the problem of resettlement of triage personnel and consolidate the achievements of township institutional reform, we hereby put forward the following opinions.
First, the main ways of personnel diversion and resettlement
200 1 in the reform of township institutions, the relocated personnel in government agencies and institutions (excluding primary and secondary schools and health centers) who rely on financial, various fees and administrative fees will be resettled in the following ways.
(1) Break the zoning restrictions, excavate vacant posts and arrange personnel diversion. Counties (cities, districts) should, in accordance with the principle of giving full play to their talents, focus on vacant posts and other new posts in township organs, directly affiliated institutions and schools, uniformly organize triage personnel to compete for posts again, and arrange triage personnel (who need to obtain teacher qualifications when assigned to schools). Former civil servants and government functionaries participate in the post competition of civil servants (including civil servant management); If the staff of the original institution or civil servants or government workers meet the requirements of the post, they will participate in the post competition of the institution. We should take various measures to provide reemployment opportunities for the diverted personnel to the maximum extent. Contact to find the receiving unit, in line with the relevant provisions, the relevant departments and the original unit should actively assist in handling the relevant procedures.
(2) dismissing the workers under the labor contract system. The labor contract workers who fail to take up their posts through competition among the triage personnel shall terminate their labor relations in accordance with the relevant provisions of the Labor Law of People's Republic of China (PRC) and notify them in writing according to the relevant provisions.
(3) Appropriate relaxation of conditions for early retirement. I am willing to retire early if I have worked for 30 years or 55 years for men, 50 years for women, and 20 years for women before the end of 2007 (except for workers with labor contracts).
(4) Self-employment. Encourage the staff of government agencies and institutions (except workers with labor contracts) to resign and start businesses.
(5) Resign. Staff members of government agencies and institutions who meet the conditions for resignation stipulated by the state (except workers under labor contract system) may resign after approval.
(six) dismissal of the diversion personnel who do not obey the arrangement. Those who refuse to arrange the triage personnel shall be dismissed according to the relevant provisions of the Interim Provisions of the Ministry of Personnel on Resignation and Dismissal of State Civil Servants (UNCED [1995] No.77) and the Interim Provisions on Dismissal of Professional and Technical Personnel and Management Personnel in Institutions Owned by the Whole People (UNCED [1992]18).
Second, relevant policies.
(a) For re-employed personnel, the three-year off-duty period is regarded as continuous service; No violation of law and discipline, as the annual assessment.
(2) Pay a one-time economic compensation in accordance with the regulations when dissolving the labor relationship of the employees under the labor contract; Those who have participated in unemployment insurance and meet the relevant regulations can enjoy the relevant benefits of unemployment insurance. In line with the relevant provisions of the Notice of the Party Committee and the People's Government of the Autonomous Region on Further Improving the Work of Employment and Re-employment (GYF [2003] No.7), a "Re-employment Concession Card" will be issued, and the certificate will enjoy the re-employment support policy.
Calculation and payment method of economic compensation: According to the relevant provisions of the Measures for Economic Compensation for Violating and Dissolving Labor Contracts issued by the Ministry of Labor (No.48 1994 issued by the Ministry of Labor), workers under labor contract system will be paid economic compensation equivalent to one month's salary every year for their working years in this unit, and those who work less than one year will be paid economic compensation according to the standard of one year.
(three) the resignation of individual workers in government agencies and institutions (except for workers with labor contract system) shall be paid by the finance at the same level in a lump sum equivalent to three years' basic salary.
(four) the basic old-age insurance measures for the diversion of personnel. National civil servants who are diverted to enterprises and self-employed after the diversion, unit staff who refer to and refer to the management of civil servants, employees owned by the whole people and labor contract workers shall participate in the basic old-age insurance for employees of urban enterprises in accordance with regulations and pay the basic old-age insurance premium in full and on time. When retirement reaches the prescribed payment period, the basic old-age insurance premium for urban enterprise employees will be calculated and paid according to the regulations.
1. After the diversion, if the civil servants and the staff of the units managed by the civil servants participate in the basic old-age insurance for employees of urban enterprises and pay the old-age insurance premiums in full and on time, their original working hours in government agencies and institutions can be calculated as continuous working years according to national policies and regulations, and they will be regarded as payment years. The above two types of personnel assigned to enterprises, in accordance with the provisions to participate in the basic old-age insurance for employees of urban enterprises, according to their working experience in the organs (or units) to give a one-time subsidy, by the original unit through the local social insurance agencies transferred to the basic old-age insurance personal account, the required funds by the financial arrangements at the same level. The subsidy standard is: the average monthly basic salary of the previous year when I left the institution (or unit) × the working years in the institution (unit) × 0.3% ×120 months.
2. If employees owned by the whole people participate in the basic old-age insurance for employees of urban enterprises according to regulations,1991kloc-0/0 must pay the basic old-age insurance premium according to regulations until the month of resettlement. Part of the unit payment is paid by the original unit; If the original unit is merged, it shall be repaid by the functional merged unit; If the original unit is revoked, it shall be paid by the finance at the same level; I am responsible for paying individual contributions; 199 1 year1October 3 1 days ago, the continuous length of service calculated according to the regulations shall be regarded as the payment period.
3 after the diversion of the labor contract workers, did not participate in the basic old-age insurance for employees of urban enterprises before the diversion, must pay the basic old-age insurance premiums from the month when the original labor contract was signed with the government agencies and institutions. Insured but unpaid basic old-age insurance premiums, according to the provisions of the payment. Part of the unit payment is paid by the original unit; If the original unit is merged, it shall be repaid by the functional merged unit; If the original unit is revoked, it shall be paid by the finance at the same level; I am responsible for paying personal contributions. For those who have already participated in the basic old-age insurance for employees of urban enterprises and paid in full, they will do a good job in renewal according to the regulations and no longer pay the basic old-age insurance premium.
4. For those who have participated in the old-age insurance of government agencies and institutions and participated in the basic old-age insurance for employees of urban enterprises after diversion, the procedures for the transfer of the old-age insurance relationship and the old-age insurance fund should be handled in time according to the existing relevant regulations, and the payment amount should be calculated according to the payment standard of the basic old-age insurance for employees of urban enterprises. The difference must be paid back, and the basic old-age insurance shall be paid according to the enterprise's method when the specified payment period is reached at retirement.
5. After the triage personnel participate in the basic old-age insurance for employees of urban enterprises, if they need to pay the basic old-age insurance premium, they can be subsidized by the finance at the same level.
(five) for early retirement after appropriate relaxation of conditions, the formalities must be completed within one month from the date of approval, and the wages and benefits will be paid to normal retirees. We will no longer give preferential policies to early retirees in the last round of institutional reform, that is, we will not be able to enjoy the Notice of the General Office of the Party Committee of the Autonomous Region and the General Office of the People's Government of the Autonomous Region on Printing and Distributing Measures for Personnel Diversion in City (prefecture), County and Township Institutions.
(6) The monthly retirement living expenses for those who implement the rank wage system are: the original basic salary and seniority salary are paid in full. The original post salary and grade salary are calculated and paid according to the working years as of the date of resignation, specifically: if the working years are over 20 years but less than 30 years, the sum of post salary and grade salary is calculated and paid according to 70%; If the working experience is over/kloc-0 and less than 20 years, the sum of post salary and grade salary shall be calculated as 60%; If the working experience is less than 10 year, it will be paid according to 40% of the sum of post salary and grade salary.
After the staff of public institutions and government agencies resign, their monthly retirement living expenses are: as of the date of resignation, if they have worked for more than 20 years but less than 30 years, they will be paid 75% of the post salary and allowance; If the working experience is over/kloc-0 and less than 20 years, the post salary and allowance will be paid at 65%; If the working experience is less than 10 years, the post salary and allowance will be paid at 50%.
Retirees must go through the formalities within one month from the date of approval, and after retirement, they will be insured and renewed according to the local medical insurance policy and enjoy the corresponding medical insurance benefits; If the staff of government agencies and institutions increase their capital, it shall be handled in accordance with the relevant provisions of retirees; If you find a job in an organ, institution or state-owned enterprise again, you will stop paying severance pay.
(7) Dismissal of civil servants and staff of state organs shall be paid in a lump sum according to the Interim Measures for Dismissal and Resignation of National Civil Servants in Guangxi Zhuang Autonomous Region (No.38 [1996] issued by Zheng Gui). Dismissal of public institution personnel shall be accompanied by a certificate of dismissal, and a one-time economic compensation shall be issued according to the Notice of the Ministry of Personnel on Printing and Distributing the Interim Provisions on Dismissal of Professional and Technical Personnel and Management Personnel in Institutions Owned by the Whole People (No.1992+08). The files of the dismissed personnel shall be handed over to the local talent exchange service center for management.
(eight) actively do a good job in the basic medical insurance or the basic medical insurance relationship.
1. If re-employed after the diversion, the employing unit shall go through the formalities of participating in the basic medical insurance or changing or renewing the insurance according to the basic medical insurance policy of the overall planning area, pay the basic medical insurance premium and enjoy the corresponding basic medical insurance benefits.
2. Those who have participated in the medical insurance for urban workers before the institutional reform and engaged in self-employment after the diversion should go through the renewal procedures of basic medical insurance according to the basic medical insurance policies and regulations in the overall planning area, pay the basic medical insurance premium and enjoy the corresponding basic medical insurance benefits; Those who have not participated in the basic medical insurance shall participate in the basic medical insurance in accordance with the basic medical insurance policy of the overall planning area, pay the basic medical insurance premium and enjoy the corresponding basic medical insurance benefits.
(nine) triage personnel can also enjoy the following preferential policies:
1. If the diverted personnel meet the requirements stipulated in the Regulations on Minimum Living Security for Urban Residents, they will be included in the minimum living security for urban residents.
2. Diverted personnel who are engaged in self-employment (except industries restricted by the state) and meet the preferential policies of the state and the autonomous region for the reemployment of laid-off workers shall be exempted from business tax, urban maintenance and construction tax, education surcharge and personal income tax within three years from the date of receiving the tax registration certificate. In accordance with the relevant provisions of the Notice of the Department of Finance and the Price Bureau of the Autonomous Region on Implementing Preferential Charges Policies for Laid-off and Unemployed Persons Engaged in Self-employed Business (Gui Cai Zong [2002] No.59), all administrative fees related to management, registration and license are exempted.
3. Newly established productive enterprises engaged in local resource development, agriculture and animal husbandry, forest product processing and energy development. Those who divert personnel to poor areas shall be exempted from enterprise income tax for the first three years from the date of production and operation; Engaged in community service industry, to simplify the industrial and commercial registration procedures, three years can be exempted from business tax, personal income tax and administrative fees.
4. For the newly-established independent accounting and self-financing enterprises for the resettlement of triage personnel, the enterprise income tax shall be exempted for the first three years, and the enterprise income tax shall be halved for the next two years.
5. Enterprises registered in the administrative department for industry and commerce according to law (except for industries restricted by the state), which have settled a certain proportion of their employees and signed labor contracts with them for more than three years, will be exempted from enterprise income tax according to a certain proportion of the annual income tax payable by the number of employees: if the settled employees account for more than 60% (including 60%) of the total number of employees, they will be exempted from enterprise income tax for the first three years; Accounting for more than 30% (including 30%), less than 60%, the enterprise income tax can be halved in the first three years; If it accounts for more than 10% (including 10%) and less than 30%, the enterprise income tax can be halved in the first year.
6. Enterprises that provide technical services for agriculture set up by diverted personnel enjoy the treatment of supporting scientific and technological enterprises by the state and the autonomous region; Established high-tech enterprises can enjoy the policy treatment given to scientific research institutions in the Notice on Implementing the Registration System of Self-operated Import and Export Rights for State-owned and Collective Scientific Research Institutes and High-tech Enterprises (Foreign Trade and Economic Cooperation [1999] No.595).
Third, organize the implementation.
(1) Strengthen leadership and clarify responsibilities. The resettlement of triage personnel has strong policy, involving a wide range and heavy tasks. Party committees and governments at all levels should earnestly strengthen leadership, seriously organize implementation, and ensure that the resettlement work is carried out in an orderly manner. City, county (city, district) should set up a leading group for personnel placement, with the leaders in charge as the team leader and the relevant departments of organization, staffing, finance, personnel, labor and social security as the member units. The office of the leading group is located in the personnel department and is responsible for the daily work of personnel placement. Party committees and governments of counties (cities, districts) should take overall responsibility for the resettlement of triage personnel and must complete the resettlement task of triage personnel within half a year. After the resettlement work is basically completed, the leading group and its office will be cancelled and the follow-up work will be handed over to the personnel department. Township Party committees and governments should conscientiously and responsibly do a good job in the resettlement of diverted personnel. If the personnel are overstaffed, it is necessary to implement the whereabouts of the diverted personnel. Vacancy, to the overall situation, in accordance with the unified arrangements of the organization, and actively accept the diversion of personnel. Before the resettlement of the triage personnel is not completed, all township organs and institutions shall not add supplementary personnel except receiving mandatory resettlement personnel. The organization, personnel and preparation departments are responsible for the guidance and coordination of personnel diversion work, straighten out all aspects of relations, and ensure the smooth progress of resettlement work; Finance, labor and social security, industry and commerce, taxation, science and technology, commerce and other departments should conscientiously perform their duties, clarify their responsibilities, and ensure that funds and policies are put in place; All relevant departments and units should cooperate closely to jointly complete the resettlement task of the local triage personnel.
(two) the implementation of policies to relieve the worries of triage personnel. Party committees and governments at all levels should implement the relevant policies of the central and autonomous regions to the letter and ensure that the policies are implemented. All localities shall not introduce regulations that violate the policies of the autonomous region; To change the relevant policies and regulations of the autonomous region without authorization, in addition to ordering rectification, the relevant leaders and management personnel should be held accountable. It is necessary to timely cash the living allowance of the triage personnel and timely cash the financial expenses. It is necessary to implement relevant policies such as social security and entrepreneurial support. Adhere to the people-oriented, in order to divert people's thoughts and urgent needs, party committees and governments at all levels should try their best to solve the reasonable requirements of diverting people and effectively relieve their worries.
(3) Do a good job and maintain stability. Party committees and governments at all levels should strengthen ideological and political work, organize party member cadres to seriously study the spirit of the documents on institutional reform of the central and autonomous regions, so that everyone can fully understand the importance and urgency of the resettlement of triage personnel, consciously stress politics, the overall situation and party spirit, and actively support the resettlement of triage personnel. Party committees and governments of counties (cities, districts) should formulate scientific, reasonable and practical plans, organize competition for posts in accordance with the principles of fairness, justice and openness, and ensure that this work is carried out in a planned and step-by-step manner as required. All towns and villages should do a good job in ideological and political work of personnel diversion, resolve various contradictions at the grassroots level, and maintain social stability. We must abide by the discipline of institutional reform, so as to concentrate our thoughts, maintain order and work regularly.
Four. any other business
(a) from 2000 to 2002, the organs (including the party, government, mass organizations and league organizations) that failed to be resettled in the institutional reform of autonomous regions, cities and counties were diverted, and the surplus personnel of the organs in the process of township merger and the township institutions (excluding primary and secondary schools and health centers) supported by financial allocations were referred to.
(2) This opinion shall be implemented as of the date of issuance and valid until June 65438+February 3, 20071.
