Article 2 The term "farmer's market" as mentioned in these Measures refers to a place where market operators provide fixed sites and facilities for business operations, and a number of operators are concentrated in the market to independently engage in agricultural and sideline products trading activities.

The term "farmers' market promoter" as mentioned in these Measures refers to an enterprise legal person or other economic organization established according to law, engaged in market operation, and attracting operators of agricultural and sideline products to enter the market by providing venues, facilities and services.

The term "floor operators" as mentioned in these Measures refers to enterprise legal persons, individual industrial and commercial households and other economic organizations that independently engage in agricultural and sideline products trading activities in the farmers' market.

Article 3 Trading activities in farmers' markets shall follow the principles of voluntariness, equality, fairness, honesty and credibility, and abide by business ethics. Market management activities should follow the principles of legality, openness, fairness and impartiality.

Article 4 These Measures shall apply to the establishment, operation and management of farmers' markets in the urban areas of this Municipality and related administrative supervision and management activities.

Chapter II Management Responsibilities

Article 5 The farmers' market shall be subject to territorial management. The District People's governments and Changsha High-tech Zone Administrative Committee shall, under the unified leadership of the Municipal People's government, earnestly strengthen the leadership over the management of farmers' markets, and organize and coordinate the relevant administrative departments at the corresponding level to perform their duties according to law.

Street offices should earnestly perform their duties, urge market promoters to implement management responsibilities, be responsible for daily market supervision, and coordinate relevant administrative departments to supervise according to law.

Article 6 The administrative department for industry and commerce shall take the lead in supervising and managing the farmers' market. Its main duties include confirming the qualifications of market promoters and floor operators according to law, supervising and managing business entities, commodity quality and trading behaviors, accepting and handling complaints and appeals, maintaining market order, investigating and punishing illegal acts according to law, organizing farmers' market managers to participate in training in time, and other duties stipulated by laws and regulations.

Article 7 The competent commerce department shall be responsible for organizing the implementation of the construction and upgrading projects of farmers' markets, drawing up the standards for the construction and upgrading projects of urban and rural farmers' markets, taking the lead in formulating the acceptance measures and organizing the acceptance.

Article 8 Urban management law enforcement departments shall be responsible for the supervision and management of environmental sanitation around and within the farmers' market, and investigate and deal with illegal market construction and illegal off-site occupation of roads and stalls according to law.

Tenth quality and technical supervision departments are responsible for the supervision and management of measuring instruments and measuring behaviors used for trade settlement in farmers' markets, and strengthen the regular compulsory verification of measuring instruments used for trade settlement by market operators; To be responsible for the measurement supervision and management of quantitatively packaged commodities, retail commodities and other commodities in the farmer's market.

Eleventh agricultural departments are responsible for the supervision and management of the quality and safety of agricultural products in the market, including supervision and spot checks, detection of pesticide residues in vegetables, fruits and other foods, and urging the promoters of wholesale markets to implement the quality and safety inspection system for agricultural products.

Twelfth animal husbandry and fishery departments are responsible for the supervision and management of the quality and safety of livestock and poultry products in the market, including supervision and spot checks, quarantine of livestock and poultry products, etc.

Thirteenth construction, public security, fire control, safety supervision and other departments shall supervise and manage the construction safety, fire safety and other safety production work in the farmer's market according to law.

Fourteenth environmental protection, health, real estate, food and drug supervision and other relevant departments shall, within the scope of their respective duties, supervise and manage the farmer's market according to law.

Chapter III Market Sponsors

Fifteenth to run a farmer's market should be registered according to law and obtain a business license. A farmer's market that has not been approved and registered by its name may not attract investment or lease.

Article 19 Market operators shall examine the licenses of food operators entering the market, clarify the responsibilities of food safety management of food operators entering the market, regularly check the operating environment and conditions of food operators, and find that food operators have violated the provisions of the Food Safety Law of People's Republic of China (PRC), and shall promptly stop and immediately report to the local county-level industrial and commercial administrative department or food and drug supervision and administration department.

If the market promoters fail to fulfill the obligations stipulated in the preceding paragraph, resulting in food safety accidents in this market, they shall bear joint liability.

Article 20 Market operators shall sign letters of responsibility for food quality and safety with local administrative departments for industry and commerce and market operators respectively, so as to clarify the food safety responsibilities of market operators and operators.

Twenty-first market operators shall sign a written admission contract with the on-site operators. The contract shall specify the product safety responsibility, ways to solve consumer disputes, illegal business responsibility, public security and fire safety, family planning, market environmental sanitation, liability for breach of contract and handling methods, and conditions for terminating the contract.

Article 22 The farmer's market shall establish and improve the systems of inspection and acceptance of incoming goods, inspection and testing vouchers, record and save purchase and sale ledgers, and be responsible for the quality and safety of agricultural products sold in the market.

The agricultural product market shall require the sellers of agricultural products entering the market to submit valid certificates or certification marks (hereinafter referred to as valid certificates) of pollution-free agricultural products, green foods and organic foods, and carefully check and record them.

The agricultural product market shall be equipped with testing equipment and technicians or entrusted with legal testing institutions for testing. If the seller cannot submit a valid certificate of agricultural products, it shall be sold only after passing the test; If the test fails, it shall report to the administrative department for industry and commerce or the administrative department of agriculture in a timely manner.

Twenty-third market operators should maintain the environmental sanitation of the market, strengthen the publicity of environmental sanitation, establish and improve the market cleaning system, promptly remove sewage, garbage and waste, and keep the market clean and tidy and the environment excellent.

Twenty-fourth market operators should ensure the fire safety of the market, sign a letter of responsibility for public security and fire safety with business operators, and clarify the responsibilities for public security and fire safety. Clarify the mediators of public security disputes, promptly stop emergencies that disrupt and endanger the market, and maintain social order. Clear fire control responsible person, equipped with full-time and part-time firefighters, and regularly check the safety fire control facilities. Equipped with fire-fighting equipment and equipment that meet fire-fighting standards. It is not allowed to pull, take or connect wires or change power supply devices to ensure the safety of electricity use.

Market operators should always check the safe use of market buildings (structures). Twenty-fifth market operators should set up emergency agencies, formulate emergency plans, clarify personnel responsibilities and emergency procedures, refine the division of labor, implement responsibilities, and ensure the smooth implementation of emergency plans.

Article 26 Market operators shall register the measuring instruments used in the market and report them to the local quality and technical supervision department for the record, require the market operators to apply for periodic verification to the designated metrological verification institutions, urge the operators to correctly use and maintain the measuring instruments according to law, prohibit the use of measuring instruments explicitly eliminated by the state, and prohibit the use of measuring instruments that have not been verified or failed to pass the verification.

Twenty-seventh market operators shall not provide business premises, warehousing, storage, transportation and other conditions for illegal activities such as operating without a license and selling fake and shoddy goods. When the market promoters find that the market operators have illegal business practices, they shall promptly stop and urge them to correct them; Supervise and urge not to change, report to the relevant administrative departments, and demand to investigate and deal with them according to law.

Where market promoters directly participate in on-site operations, they shall also approve relevant business projects at the time of market registration, and shall not use their management service authority to conduct unfair competition with other operators.

Market promoters can set up special areas for farmers to sell their own agricultural and sideline products in the market for consumers to choose independently. Farmers selling self-produced and self-sold agricultural products in the market shall operate in special areas designated by market promoters.

Twenty-eighth the use of financial funds to build or transform the farmer's market shall not change the business scope or close down, nor shall it change the market function layout determined in the process of building or transforming the farmer's market. If it is really necessary to relocate, merge, transfer or close the farmer's market due to planning adjustment, it shall be handled in accordance with the following procedures:

(1) The market promoter submits a written application;

(two) after the preliminary examination by the district administrative department for industry and commerce and the review by the leading group of the district farmers' market management, it shall be reported to the Municipal People's government for approval;

(3) After approval, the market promoter shall notify the venue operators within 1 month before changing the venue or closing the venue. The farmer's market, which is mainly retail, should also be posted at the market gate 1 month in advance;

(four) market operators should fully refund the financial investment at all levels of construction or renovation funds.

If the farmer's market invested by non-financial funds needs to be changed or cancelled, it shall go through the formalities of change and cancellation at the administrative department for industry and commerce within 30 days from the date of making the change decision.

Twenty-ninth transfer of financial investment in the farmer's market for new construction or transformation, by the local competent department of commerce in conjunction with the administrative department for Industry and commerce, preliminary examination, reported to the District People's government for approval. The transferee shall, within 30 days from the date of approval, go to the administrative department for industry and commerce for registration of change.

After the transfer occurs, the transferee shall abide by the provisions of these measures, enjoy the rights of market operators and fulfill the obligations of market operators according to law.

Chapter IV Site Operators and Business Activities

Thirtieth floor operators should be honest and trustworthy, operate legally, compete fairly, abide by the market management system, and consciously maintain market order.

The floor operator shall not engage in commodities prohibited by laws, regulations and rules in the market, and shall not engage in activities prohibited by laws, regulations and rules in the market.

Thirty-first floor operators independently determine the prices of agricultural and sideline products according to law, have the right to refuse illegal charges and apportionment, and enjoy the rights conferred by laws and regulations.

Thirty-second floor operators should be licensed to operate, and hang business licenses, tax registration certificates and other permits in a prominent position in their business premises. Farmers who sell their own agricultural and sideline products in the bazaars do not apply for the license prescribed in the preceding paragraph. Where laws and regulations provide otherwise, such provisions shall prevail.

Thirty-third floor operators must carry out compulsory periodic verification of measuring instruments used for commodity trading, and shall not use measuring instruments that have not been verified or are unqualified. Establish the acceptance system of quantitatively packaged goods, ensure that the net content of goods meets the requirements of relevant laws and regulations, and correctly use the national legal units of measurement.

Thirty-fourth floor operators should keep the goods neatly stacked, the passage is smooth, and they are not allowed to occupy the road or leave them lying around.

Article 35 When purchasing commodities, floor operators shall establish and implement the system of inspection and acceptance of incoming goods, check the licenses and product certificates of incoming goods, and truthfully record the name, specifications, quantity, production batch number, shelf life, supplier name and contact information, date of incoming goods and other information.

The incoming inspection records shall be true, and the storage period of food incoming records and bills shall not be less than 2 years. Other commodities should keep bills and documents that can prove the source of purchase within six months after the goods are sold out.

Chapter V Supervision and Administration

Thirty-sixth people's governments at all levels shall set up a leading group for the management of farmers' markets. The office of the leading group is located in the administrative department for industry and commerce at the same level.

Article 37 All levels shall establish and improve the target assessment system for farmers' markets, and regularly organize target assessment for farmers' markets and market supervision units. The assessment results shall serve as an important basis for the annual performance assessment of district people's governments at all levels, sub-district offices and relevant administrative departments. Farmers' market management leading groups at all levels can reward farmers' markets and management units with excellent assessment results, and the sources of funds are included in the financial budgets of governments at all levels.

The assessment methods and scoring standards shall be formulated by the office of the leading group for the management of the municipal farmers' market and implemented after being approved by the leading group.

Thirty-eighth administrative departments for industry and commerce and other relevant administrative organs, according to the needs of the work, can set up management stations (points) or stationed personnel in the market. The administrative department for industry and commerce shall set up re-inspection measuring instruments that meet the requirements in a prominent position in the market.

Thirty-ninth administrative law enforcement officers of the relevant administrative departments must produce relevant law enforcement certificates when performing official duties. If the law enforcement certificate is not produced, the counterpart has the right to refuse to accept the inspection.

The administrative department shall, according to its duties, enter the farmer's market for supervision and inspection according to law, and shall inform the relevant administrative departments in a timely manner if it finds any illegal acts that should be investigated and dealt with by other departments.

Fortieth administrative departments shall submit punishment documents to the office of the leading group for the management of farmers' markets at the same level after imposing administrative penalties on illegal acts involving farmers' markets.

Chapter VI Legal Liability

Article 41 Where market promoters and floor operators engage in production and business operations without business licenses or although they have business licenses, they are beyond the approved business scope, the administrative department for industry and commerce shall investigate and deal with them in accordance with the Company Law of People's Republic of China (PRC), Measures for Investigating and Banning Unlicensed Business, and other relevant laws and regulations; If the floor operators have illegal trading behaviors, the administrative department for industry and commerce shall investigate and deal with them according to the People's Republic of China (PRC) Anti-Unfair Competition Law and other laws and regulations.

Market promoters and venue operators who violate fire safety management regulations, fail to perform fire safety management responsibilities or commit other illegal acts shall be investigated and dealt with by public security and fire departments according to the Fire Protection Law of People's Republic of China (PRC), the Law of People's Republic of China (PRC) on Public Security Management Punishment, and the Measures for the Administration of Fire Safety in Public Gathering Places in Hunan Province.

If the floor operators violate the provisions on commodity quality management, produce and sell foods and unqualified commodities prohibited by the state, or commit other illegal acts, the departments of industry and commerce, quality supervision, health, agriculture, animal husbandry and aquatic products shall investigate and deal with them according to their respective duties.

Market operators fail to fulfill the responsibility of city appearance and environmental sanitation management, and the market environmental sanitation is unqualified, and the urban management law enforcement department shall investigate and deal with it according to the Measures for the Administration of City Appearance and Environmental Sanitation in Changsha.

Market operators do not perform the duties of safety production management, and shall be investigated and dealt with by the safety supervision department according to the "Safety Production Law of People's Republic of China (PRC)" and other laws and regulations.

Market operators who, in violation of the provisions of Article 28 of these measures, without the approval of the Municipal People's Government, move, merge, transfer or close the farmers' market, or change the functional layout of the farmers' market, shall be investigated and dealt with by the commerce department jointly with the industry and commerce department according to law.

Market promoters and floor operators who commit other illegal acts shall be investigated and dealt with by the relevant administrative departments according to their duties.

Chapter VII Supplementary Provisions

Forty-second counties (cities) under the jurisdiction of this Municipality may refer to these measures.

Article 43 These Measures shall come into force on September 1 day, 2065.
