Provisions of Harbin Municipality on the Administration of Labor Model Selection

Article 1 In order to standardize the recommendation, selection and management of model workers, these Provisions are formulated in accordance with the Trade Union Law of People's Republic of China (PRC), the Provisions on Recommendation, Selection and Management of Model Workers in Heilongjiang Province and the actual situation of our city.

Article 2 These Provisions shall apply to the selection and management of the naming of the Municipal People's Government within the administrative area of this Municipality.

Article 3 The Preparatory Committee of the Municipal Model Workers Conference (hereinafter referred to as the Preparatory Committee) is responsible for the selection and commendation of model workers. The Preparatory Committee is composed of trade unions, personnel, agriculture, labor and social security, finance and other relevant organizations and departments at the same level, and performs the following duties under the organization of the municipal government:

(a) to formulate the overall work plan of the labor model recommendation, selection and commendation meeting;

(2) Examining candidates recommended by model workers;

(three) to determine the reward standard of model workers;

(four) to consider the major issues that need to be clarified in the daily management of model workers.

The Preparatory Committee has a model worker management office, which is located in the Municipal Federation of Trade Unions and performs the following duties:

(a) responsible for the specific organization of the recommendation, selection and naming of model workers;

(two) to guide, coordinate and handle the daily management of model workers;

(three) to check the implementation of the relevant labor model policies and put forward suggestions for adjusting the labor model policies;

(4) Other tasks assigned by the Preparatory Committee.

Article 4 Those who have made remarkable achievements in promoting socialist economic construction, political construction, cultural construction and social construction and meet one of the following conditions may be recommended for selection as model workers:

(1) Having made outstanding contributions in production and operation management;

(2) Having made outstanding contributions to increasing farmers' income and promoting rural economic and social development;

(3) Having made outstanding contributions in enhancing the capability of independent innovation and promoting the transformation of scientific and technological achievements into real productive forces;

(4) Having made outstanding contributions in jobs such as hardship, dirty, tiredness and danger;

(5) Having made outstanding contributions to protecting state property and people's lives, maintaining social stability and building a harmonious socialist society;

(6) Having made outstanding contributions in saving energy and resources and protecting and improving the environment;

(seven) made outstanding contributions in deepening reform and opening up.

(eight) have made outstanding contributions in promoting science and technology, education, culture, sports, health and other aspects;

(9) Having made remarkable achievements in other aspects.

Article 5 The selection of model workers should face the grassroots, promote democracy, and adhere to the principles of paying attention to performance, making outstanding contributions, being advanced, open, fair and just.

Article 6 The recommendation and selection of model workers shall be conducted in accordance with the following procedures:

(a) model workers, recommended by the unit democracy, discussed and adopted by the joint meeting of the workers' congress or the workers' delegation (group), reported to the superior competent department or the district/county (city) people's government for review, reviewed and agreed by the Preparatory Committee of the Municipal Model Workers' Congress, and reported to the Municipal People's government for approval and naming;

(two) peasant model workers, recommended by the villagers' committee, submitted to the township (town), district, county (city) people's government for examination, with the consent of the Preparatory Committee of the Municipal Model Workers' Congress, and reported to the Municipal People's government for approval and naming;

(three) model workers of individual workers, recommended by the district and county (city) people's government, approved by the Preparatory Committee of the Municipal Model Workers Congress, and reported to the Municipal People's government for approval.

The employment of migrant workers in enterprises shall be handled in accordance with the provisions of item (1) of this article; Engaged in individual labor, according to the provisions of item (three) of this article.

If the recommended candidate is the person in charge of an enterprise or institution, it shall also be approved by the relevant departments of industry and commerce, auditing, taxation, production safety supervision, environmental protection and supervision.

Seventh in any of the following circumstances, the person in charge of an enterprise or institution shall not be selected as a model worker:

(a) the person directly responsible and the person in charge of the enterprise or the legal representative within one year of the general production safety accident, two years of the major production safety accident or three years of the major production safety accident;

(two) in violation of environmental protection laws, regulations and rules by administrative punishment;

(3) Failing to handle employment filing according to regulations or failing to sign labor contracts or collective contracts according to law;

(four) wage arrears or social insurance premiums are not corrected;

(5) Violating the family planning policy;

(6) Violating the legitimate rights and interests of migrant workers;

(seven) subject to disciplinary action;

(eight) subject to criminal punishment;

(9) Failing to establish a trade union organization according to law, infringing upon the democratic rights and legitimate rights and interests of employees;

(ten) there are other illegal acts that cause adverse effects.

Eighth city labor model commendation congress held every two years, named in recognition of model workers. When the Municipal Model Workers' Congress is not in session, the Municipal People's Government shall award the title of model worker and commend those who have made outstanding contributions to socialist economic construction, political construction, cultural construction and social construction.

Ninth won the honorary title of model worker, the naming authority issued honorary certificates and medals of model worker, and give material rewards.

Article 10 The naming authority may revoke the honorary title of model worker in any of the following circumstances:

(1) Being investigated for criminal responsibility according to law;

(two) subject to disciplinary action;

(three) there are other serious mistakes.

Eleventh the revocation of the honorary title of model worker shall be approved by the naming authority in accordance with the selection procedure of model worker. At the same time, the medals and certificates will be withdrawn and their corresponding treatment will be cancelled.

Article 12 The unit where the model worker works shall ensure that the model worker's salary is paid in full every month and pay all social insurance premiums in full and on time.

Article 13 Where an enterprise on the verge of bankruptcy or an enterprise that has stopped production and rectification stops paying wages to its employees, the competent department of industry shall coordinate the relevant units and departments to pay a living allowance to the model worker according to the standard of not less than 60% of the average wage of the unit where the model worker works in the previous year.

Article 14 The unit to which the model worker belongs shall provide honorary allowance for the model worker.

If the monthly payment is less than 10 years, the unit to which it belongs shall make up the supplementary endowment insurance payable for the insufficient years at one time.

The city model worker named after the implementation of the "Regulations" will be awarded an honorary allowance of 8,000 yuan at a time during his term of office.

Those who have won the honorary title at the same level in this session will not enjoy the on-the-job honorary allowance again; Those who have won various levels of honorary titles shall enjoy the on-the-job honorary allowance according to the highest level of honorary title allowance standard.

Fifteenth labor model honor allowance expenses, enterprises charged in the total wages, administrative institutions by the finance at the same level.

Sixteenth people who have won the title of model unit and model collective can be given a one-time reward to the unit or collective. The reward standard and form shall be determined by the unit, and the funds shall be charged in the unit's own funds.

Article 17 If the unit to which the model worker belongs does not participate in the social pooling of medical insurance, and the medical expenses of the model worker meet the relevant provisions of medical insurance, the unit to which the model worker belongs shall be reimbursed according to the relevant provisions of medical insurance in Harbin, and the city model worker will increase by 20%, and the city model worker will increase by 30%. The improved reimbursement standard for medical expenses shall not exceed 100% of the medical expenses that meet the relevant provisions of medical insurance at one time.

Eighteenth labor model units to participate in social pooling of medical insurance, labor model hospitalization, medical expenses paid by individuals according to the medical insurance policy, the individual pays part according to the following standards:

(a) to obtain the title of 1 session of model worker, the subsidy is 25%;

(two) won the title of the 2 session of the city model worker, 50% subsidy;

(three) won the title of 3, 3 model workers, subsidies 75%;

(four) won the title of model worker, subsidy 100%.

The subsidy fee is charged in the supplementary medical insurance premium extracted by the unit where the model worker works for the model worker above the city.

When the unit where the model worker works goes bankrupt, is revoked or dissolved, it shall pay supplementary medical insurance premiums for the model worker until he reaches the age of 70.

Article 19 Trade union organizations at all levels shall regularly organize model workers for treatment and rest, and the required funds shall be paid by the unit where the model workers work, and the wages, bonuses and welfare benefits during treatment and rest shall remain unchanged.

Twentieth trade unions at all levels should regularly organize physical examination of model workers. If the model worker is over 40 years old, he shall have a physical examination once a year; Those over 30 years old and under 39 years old shall have a physical examination every 2 years; Under the age of 29, have a physical examination every three years.

The medical expenses of model workers shall be paid by the unit where the model workers work. If there are difficulties, the finance at the same level should support them.

Twenty-first people's governments at all levels, trade union organizations, enterprises and institutions shall give timely help and assistance to model workers who have difficulties in life.

Twenty-second specialized courses and refresher courses held by municipal colleges and universities, under the same conditions, give priority to the admission of model workers for further study.

The unit where the model worker works shall bear the tuition fees for the model worker to enter the school for further study, and ensure the study time.

The wages (including all kinds of subsidies) of model workers during their study in school shall be paid by their units.

Twenty-third model workers above the municipal level, whose per capita living area is lower than the local average housing area and per capita income is lower than the local minimum wage standard, can give priority to the purchase of affordable housing and low-rent housing provided by the government. Conditional enterprises and institutions can also provide housing for model workers with special contributions in the form of incentives.

Twenty-fourth district, county (city) Federation of trade unions, the municipal department in charge of industry, and the trade union organizations of provincial units in Kazakhstan shall designate special persons or part-time personnel to be responsible for the management of model workers.

Twenty-fifth labor model retirement, death, the unit should be reported to the Municipal Federation of trade unions for the record. After the death of the city model worker, Harbin Daily published an obituary with a certificate issued by the Municipal Federation of Trade Unions.

Twenty-sixth news, culture and other units should always publicize the advanced ideas and deeds of model workers. When the Municipal People's Government holds festivals or other major activities, it invites a certain number of model workers to participate.

Twenty-seventh trade union organizations at all levels and the unit where the model workers are located shall collect, sort out and file the relevant materials selected and recommended by the model workers in a timely manner, and keep the files intact.

Article 28 People's governments at all levels, their departments and the units where model workers work should strengthen the training and education of model workers, care about their work, study and life, and hold model workers' symposiums regularly to listen to their opinions, suggestions and demands, so as to help solve practical difficulties.

Twenty-ninth labor model management office should do a good job in the reception and handling of letters and visits from labor models, check and supervise the implementation of various treatments of labor models, and safeguard the legitimate rights and interests of labor models according to law.

Article 30 If a municipal model worker in the same city is transferred to work in our city, the model worker management department in the transferred place shall issue the Model Worker Certificate, and after filing in the model worker management office in our city, he can enjoy the treatment of the municipal model worker in our city.
