Article 6 Where an operator engages in business activities without obtaining a business license according to law, it shall be investigated and punished by the administrative department for industry and commerce (hereinafter referred to as the administrative department for industry and commerce).

The Food Safety Law of the People's Republic of China stipulates that:

Article 35 The State practices a licensing system for food production and marketing. Engaged in food production, food sales, catering services, shall obtain a license according to law. However, the sale of edible agricultural products does not require permission.

Article 38 Drugs may not be added to foods produced and marketed, but substances that are traditionally both foods and Chinese herbal medicines may be added.
