Article 1: In order to do a good job in the relocation and resettlement of military officers, according to Article 59 of the Military Service Law of the People's Republic of China, "Officers Resign "After active service, they will be properly resettled by the state" and based on the actual conditions of our province, these measures are formulated.
Article 2: In principle, the regional administrative office and the municipal people's government (hereinafter referred to as the "prefecture and city") where the demobilized military officers were originally from or where they were when they joined the army are responsible for their placement within their respective jurisdictions. For those who really need to be resettled in other places or cities under special circumstances, appropriate care can be given.
Article 3: Relocating retired military officers is an important long-term political task. All agencies, groups, schools, enterprises, and institutions in the province (including units stationed in Shaanxi under the ministries and commissions of the State Council and enterprises and institutions managed by the military) have the obligation to resettle retired military officers and their transferred family members. Governments, departments and receiving units at all levels must obey the overall situation of the country, overcome difficulties, actively accept and effectively resettle demobilized officers.
Article 4 The job relocation and resettlement of military officers shall be carried out under the leadership of people's governments at all levels.
Provincial and prefectural (municipal) levels may, based on the needs of resettlement work, set up a working group for the resettlement of military officers, with an office for the resettlement of military officers to undertake the daily work of the resettlement of officers.
Chapter Name: Chapter 2 Transfer and Acceptance
Article 5: In accordance with the deployment and resettlement plan of the State Council and the Central Military Commission for the year, the files of demobilized officers and the transfer, review and acceptance work shall be carried out by the provincial government The Officers' Relocation and Resettlement Office organizes and implements the work in a unified manner.
Article 6: Retired officers who meet one of the following conditions will be accepted and placed by our province:
(1) Originally from Shaanxi or enlisted from Shaanxi (excluding those who are on loan to study in Shaanxi) Students from colleges and universities are assigned to join the army after graduation, the same below);
(2) The spouse is originally from Shaanxi, has a current household registration in Shaanxi, and has been married for more than three years;
(3) The couple is both from the Foreign provincial nationality, one of whom is an employee of a state-owned enterprise or a large collective unit in Shaanxi, and has worked continuously for more than ten years;
(4) "Double military" couples change jobs at the same time, and one of them is originally from Shaanxi or enlisted in the army from Shaanxi;
(5) The demobilized officers are from other provinces, their parents or parents-in-law have settled in Shaanxi, have formal household registration there, have no children in Shaanxi, and need care;
(6) Shaanxi urgently needs Professional and technical personnel with intermediate and senior professional titles.
Article 7 Transfer and acceptance shall be handled in accordance with the following provisions:
(1) The files and materials of demobilized officers and their transferred spouses shall be handled by the military region or the equivalent of the military region level. The transfer team sent by the unit or the provincial military region or the provincial armed police corps is entrusted to transfer to our province;
(2) Before the transfer, the military should fill in the relevant forms as required and propose a transfer plan;
(3) At the time of handover, the files and materials of the transferred officers and their transferred spouses must be true and complete, and any incomplete files must be completed within a limited time;
(4) Provincial officers transferred to another job The resettlement office or authorized unit is responsible for reviewing and receiving the files and related materials of transferred officers;
(5) The provincial personnel and labor department or authorized unit is responsible for reviewing and receiving the files of cadres and workers in the transferred personnel respectively. and related materials;
(6) If the transfer is not carried out according to the resettlement plan or the prescribed time limit, our province will not accept it.
Chapter Name Chapter 3 Distribution and Placement
Article 8 The distribution of retired officers shall be based on the method of "mainly block, combined with section". Demobilized officers who return to their place of origin or place of enlistment will be assigned by the locality or city. Demobilized military officers who need to be resettled in units under the provincial and ministerial ministries and commissions of the State Council (hereinafter referred to as the ministries) stationed in Xi'an will be directly assigned by the Provincial Officers' Demobilization and Resettlement Office; those who need to be placed in units outside the provincial or ministry-affiliated units stationed in Xi'an will be allocated by the location and city.
Article 9: For the placement of retired military officers, the people's governments at or above the county level (including regional administrative offices) shall issue mandatory plans, and they shall be mainly allocated to grassroots units in various industries. Systems and newly built and expanded units that need to increase cadres should first recruit from retired officers.
Under the premise of mandatory plan allocation, recommendations, selections, etc. can be adopted to try to achieve reasonable allocation and appropriate use, so that everyone can make the best use of their talents and everyone has their place.
Article 10: Implement a close relative avoidance system for the placement of retired military officers. The focus of avoidance is the party and government organs and the political, legal and financial systems. The objects of avoidance are mainly parents, spouses, brothers, sisters and other relatives who are in cadre positions, especially leadership positions. The methods of avoidance are: if relatives are in party and government agencies, they should not be placed in the same department or unit; if relatives are in systems with similar business nature, cross-distribution will be implemented; if relatives are in the same large system, allocation will be adjusted within the system.
Article 11 After the resettlement plan is issued, the resettlement department must pay attention to the implementation of the plan. If it is found that the allocation is not reasonable or the situation changes and it is really necessary to reconsider, it should be studied and solved in a timely manner. However, the number of adjustments should be strictly controlled.
Article 12 Under the principle of strictly controlling the population of large cities, demobilized officers accepted by our province who meet one of the following conditions can be resettled in the Xi'an area (including provincial and ministry-affiliated officers stationed in Xi'an) units and Xi'an municipal units);
(1) Originally from Xi'an or enlisted in the army from Xi'an (excluding students from other areas of origin who are studying in colleges and universities in Xi'an and are assigned to join the army after graduation, the same below);
(2) The spouse is originally from Xi’an, has a current household registration in Xi’an, and has been married for more than three years;
(3) The spouse is with the army in Xi’an and is a full-time employee of the general public or a large collective, and has worked continuously for more than six years;< /p>

Article 13: Retired officers who have any of the following circumstances may be given care and placement;
(1) Those who have received second-class military honors or above in the army;

Among them, those who have obtained second-class merit or above can be placed in the region (city) Resettlement in the county (district) where the applicant is located; ② When arranging work, if conditions permit, one's expertise and wishes can be taken into consideration.
Article 14 Prefectures and cities with conditions may formulate preferential policies to mobilize and encourage some demobilized military officers to work from plain counties to mountainous counties on the basis of good ideological work.
Article 15: The job arrangement of retired officers should be based on the work needs of the receiving unit and the requirements of the "four modernizations" of cadres, based on their moral integrity and specific conditions, with reference to their original positions. On the premise of changing the status of cadres, appropriate tasks will be assigned. Departments and units that implement the appointment system should give priority to hiring retired officers. Division and regiment officers who have not been assigned corresponding positions will enjoy the political and living treatment of prefecture- and county-level cadres respectively.
Article 16: The work arrangements for transferred persons shall be based on the division of labor of "cadres shall be placed by the personnel department and workers shall be placed by the labor department". The personnel and labor departments shall be responsible for issuing placement plans and solving the placement work respectively. In order to solve the practical problems in the army, we should receive and place them at the same time as the retired officers, and send out the registration notice at the same time.

Article 17: All localities, cities and receiving units should complete the appointment of demobilized officers within two months after accepting the placement task. Positioning workers; if tasks cannot be arranged temporarily, positions can only be positioned but not fixed. The job placement form should be filled in in triplicate and submitted to the provincial resettlement department for review, and the provincial resettlement department will issue a registration notice to the troops.
Article 18: According to the notice of the local resettlement department, demobilized officers shall report to the receiving unit with a letter of administrative introduction from the political organs of units above the army division, and go through the formalities with the provincial or prefecture (city) officer demobilization and resettlement department. . Relevant departments such as public security, food, banking, and education should quickly implement issues such as household registration, food, wages, and children's schooling and daycare for retired officers based on the introduction letter from the resettlement department.
Article 19 People’s governments at all levels and receiving units must actively solve the housing problem of retired military officers. When arranging staff housing, priority should be given to the urgent needs of retired officers.
Article 20 In accordance with the principles of "training first and then taking up the post", "learn what you do, and make up for what you lack", except for professional and technical personnel who have been placed in the corresponding positions, demobilized officers should undergo training for half a year after they leave the army and report for duty. professional training around.
The training of demobilized officers is planned uniformly by the province, and a combination of "strips" and "blocks" is adopted to provide centralized training according to majors or industries. If prefectures, cities, provinces, and subordinate units receive large quantities, they will organize training in "blocks" and "articles" respectively; if they receive small quantities, the province will make overall arrangements.

Article 21 For regions, departments and units that have completed the annual resettlement and training work well and have outstanding achievements, provincial officers will be transferred to other jobs. The resettlement working group will give commendations and rewards.
Article 22: Departments and units that refuse to undertake resettlement tasks or fail to complete resettlement tasks as planned without justifiable reasons may be dealt with as follows:
(1) Failure to conscientiously implement According to the allocation and resettlement plan issued by the government, departments and units that fail to complete the resettlement tasks on time will be ordered by the military officers' demobilization and resettlement department to complete the resettlement tasks within a time limit;
(2) For departments and units that refuse to accept resettlement tasks without justifiable reasons For units, the personnel and labor departments shall suspend their recruitment and transfer cadres and workers;

Article 23: Units and personnel who do not comply with policy provisions during the resettlement work will be dealt with as follows depending on the circumstances:

Article 24 The Provincial Officers’ Relocation and Resettlement Working Group is responsible for the interpretation of these measures.
Article 25 These Measures shall come into effect on the date of promulgation. If the relevant regulations of the provincial government in the past are inconsistent with these Measures, they shall be implemented in accordance with the provisions of these Measures.
