1. Applicable object
After civil servants resign or retire, their activities after leaving office should be restricted to some extent. This law does not stipulate that civil servants leave their posts due to other circumstances, such as dismissal or dismissal. This is mainly due to the fact that the dismissed and dismissed personnel have lost their good personal reputation, and even if they work in profit-making organizations directly related to their original jobs or engage in profit-making activities after leaving their jobs, it is difficult to "play a role" in the original organs, so this law has not made any provisions.
2. Applicable time
When a civil servant resigns or retires, the business activities of the former leading members of the civil servant are restricted within three years, and other civil servants are restricted within two years. If the time limit prescribed by law is exceeded, the recruitment of civil servants will no longer be restricted.
3. Applicable behavior
Civil servants who resign or retire shall not be employed by enterprises or other profit-making organizations directly related to their original jobs or engage in profit-making activities directly related to their original jobs within the prescribed time limit.
4. Sanctions for violation of the provisions of this article
For the situation of civil servants after resignation or retirement, the original organ should do a good job of understanding and related follow-up investigation. If it is found that it violates the above provisions of this law, it shall promptly report the situation to the competent department of civil servants at the same level. The competent department of civil servants has the right to order the resigned civil servants to correct their illegal acts. If a civil servant does business in violation of regulations after resigning or retiring, the administrative department for industry and commerce will impose an administrative penalty of fine on those who have committed the above-mentioned illegal acts, that is, confiscate all their income during their service. For the receiving unit, the administrative department for industry and commerce has the right to order the retired civil servant to retire, and impose a fine of not less than one time but not more than five times the illegal income of the punished person according to the seriousness of the case.
