Regulations on the Administration of Border Economy and Trade in Dehong Prefecture (for Trial Implementation)
Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Constitution of People's Republic of China (PRC), the Law on Regional National Autonomy of People's Republic of China (PRC), the Regulations on Autonomy of Dehong Autonomous Prefecture and the relevant laws and regulations of the state, and in combination with the actual situation of border economy and trade in this state. Article 2 Autonomous Prefecture shall focus on economic construction, adhere to the Four Cardinal Principles and the policy of reform and opening up, actively develop foreign trade and economic and technological cooperation, actively carry out various forms of border trade, prosper national economy, strengthen national unity, stabilize frontier areas and develop good-neighborly and friendly relations with neighboring countries from the perspective of being conducive to developing socialist social productive forces, enhancing comprehensive national strength and improving people's living standards. Article 3 The border economy and trade of Autonomous Prefecture shall follow the policy of "taking trade as the guide, agriculture as the foundation, industry as the support, relying on education and scientific and technological progress, opening wider to the outside world, and all-round development of trade, workers and peasants". Ruili City, Wan Ding, luxi county, lianghe county, Yingjiang County and Longchuan County under the jurisdiction of the fourth autonomous prefecture are border economic and trade zones. Encourage foreign businessmen, overseas Chinese and compatriots from Hong Kong, Macao and Taiwan to carry out trade and economic cooperation throughout the state. Encourage industrial and commercial enterprises inside and outside the state and inside and outside the province to participate in intra-state border trade and economic and technological cooperation in accordance with relevant state regulations. Article 5 The border trade of Autonomous Prefecture shall be governed by the principles of "self-sufficiency, self-sale, self-discussion, self-leveling and self-financing".

Autonomous Prefecture border trade enjoys preferential policies such as tax reduction and exemption for small-scale trade imported goods and exemption from import and export licenses stipulated by the state and the Yunnan provincial government. Article 6 Autonomous Prefecture shall, in accordance with the Law of People's Republic of China (PRC) on Regional National Autonomy and relevant state regulations and policies, set up import and export companies, carry out foreign economic and trade activities, enjoy the preferential policies of the state on foreign economic and trade, carry out entrepot trade at border ports, and carry out import and export business at coastal ports to promote the economic development of frontier ethnic groups. Article 7 Autonomous Prefecture shall combine border trade with foreign economic, technical and labor cooperation, and combine border areas with mainland cooperation, utilize domestic and foreign raw materials, face domestic and foreign markets, develop processing industry, increase export products, and actively develop export-oriented economy. Eighth Autonomous Prefecture encourages industrial and commercial enterprises and other economic organizations inside and outside the state to carry out economic, technological and labor cooperation with neighboring countries in accordance with the relevant provisions of these regulations. Article 9 The Autonomous Prefecture encourages foreign companies, enterprises and other economic organizations or individuals to set up foreign-funded enterprises in the State in accordance with the relevant provisions of the State, or to set up joint ventures and cooperative enterprises with enterprises in the State and other economic organizations or individuals. Autonomous Prefecture protects the legitimate rights and interests of foreign investors in accordance with the laws and regulations of China. Tenth Autonomous Prefecture should adhere to the principle of openness, strengthen management, and ensure the healthy development of border economy and trade.

Supervision and management departments at all levels should strengthen the management of border economy and trade according to their respective responsibilities in the spirit of promotion, support and service. Chapter II Border Trade Article 11 Border trade includes local foreign trade, small-scale trade and border trade.

Local foreign trade is the trade between local governments and local governments in neighboring countries.

Small-scale trade refers to the trade between border trading companies and companies approved by the national government and companies, economic organizations or businessmen in neighboring countries.

Border people's mutual market is a mutual market trade between border people. Article 12 Industrial and commercial enterprises in this state are encouraged to set up border trading companies and businesses in accordance with the relevant provisions of the State, and may participate in other forms of border economic and trade activities in accordance with the relevant provisions of these Regulations. Thirteenth border trading companies and businesses must meet the following basic conditions:

(1) Having a name, organization and articles of association that meet the requirements;

(2) Fixed business premises and facilities suitable for the business scale;

(3) Self-owned liquidity meeting the prescribed requirements;

(4) The business scope conforms to the provisions of national laws, regulations and policies;

(5) Employees suitable for the business scale;

(six) a sound financial system and statistical reporting system;

(seven) to obtain the qualification of a legal person and be able to bear legal responsibilities independently. Article 14 The procedures for establishing border small-scale trading companies are as follows:

A written application shall be submitted by the enterprise or the competent department, reviewed by the local county (city) border trade administration jointly with the Administration for Industry and Commerce, and approved by the county (city) people's government, and reported to the State Border Trade Administration jointly with the State Administration for Industry and Commerce for examination and approval.

Border trade companies and businesses established with approval shall apply for registration with the local county (city) Administration for Industry and Commerce, obtain a business license, obtain legal person status, and go through the registration formalities with the local county (city) Border Trade Administration, Customs, Taxation Bureau, Animal and Plant Quarantine Bureau and Commodity Inspection Bureau, and only after opening an account with the local county (city) bank can they conduct business activities. Fifteenth Autonomous Prefecture encourages foreign industrial and commercial enterprises and other economic organizations to participate in the border trade activities of the state in the following forms:

(a) to carry out the purchase and sale business with the border trading companies and firms in this state;

(2) Entrusting the state border trade company to handle import and export business;

(three) joint ventures with border trade companies and commercial banks in this state;

(4) Upon approval, enterprises producing export products, enterprises processing imported raw materials and border trading companies may be established on their own.
