Article 2 Within the administrative area of ????this city, if the expropriation and compensation of houses on state-owned land need to be carried out due to public interests, these measures shall apply. Article 3 The municipal and county (city) district people's governments are responsible for the expropriation and compensation of houses on state-owned land within their respective administrative regions.

The Municipal People's Government may entrust the Daxie Development Zone, Ningbo National High-tech Zone, and Dongqian Lake Tourism Resort Management Committee to be responsible for the expropriation and compensation of houses on state-owned land involved in construction activities within the district.

The expropriation and compensation of houses on state-owned land involved in major or cross-regional construction activities shall be the responsibility of the Municipal People's Government or the people's government of the county (city) district involved in the construction activities designated by the Municipal People's Government. Article 4 The municipal housing and construction administrative department is the competent department for the expropriation and compensation of houses on state-owned land in this city, and is responsible for supervising and managing the expropriation and compensation of houses on state-owned land in this city in conjunction with relevant departments at the same level.

The municipal house expropriation department is responsible for supervising the organization and implementation of house expropriation and compensation work on state-owned land by the house expropriation departments of counties (city) districts, Daxie Development Zone, Ningbo National High-tech Zone, and Dongqian Lake Tourist Resort. ,guide. Article 5 The house expropriation department may entrust the house expropriation implementation unit to undertake the specific work of house expropriation and compensation.

House expropriation implementation units shall not be for profit-making purposes, and the funds required for carrying out house expropriation and compensation within the scope of entrustment shall be guaranteed by the finance department at the same level. Article 6 The administrative departments such as development and reform, urban and rural planning, land and resources, real estate, urban management, finance, taxation, public security, market supervision and management, and civil affairs shall cooperate in the work related to the expropriation and compensation of houses on state-owned land according to their respective responsibilities. .

Supervisory agencies should strengthen supervision of governments, relevant departments or units and their staff that implement house expropriation and compensation. Audit agencies should strengthen supervision over the management and use of expropriated compensation funds and publish audit results in accordance with the law. Chapter 2 Expropriation Article 7 complies with the provisions of Articles 8 and 9 of the State Council's "Regulations on House Expropriation and Compensation on State-Owned Land". If it is really necessary to expropriate houses, the construction activity implementation unit shall submit a house expropriation application to the house expropriation department and submit The following materials:

After receiving the application, the county (city) district housing expropriation department shall report the relevant information on the acceptance of the application to the municipal housing expropriation department in a timely manner. Article 8 The municipal or county (city) district development and reform, urban and rural planning, and land and resources administrative departments shall, based on the written opinions of the housing expropriation department, determine whether the construction activities comply with Article 9 of the State Council's "Regulations on Expropriation and Compensation of Houses on State-owned Land" Verify the specified circumstances.

If construction activities comply with the national economic and social development plan, urban and rural planning and special planning, and the overall land use plan, the development and reform, urban and rural planning, and land and resources administrative departments shall, in accordance with the division of responsibilities, separately levy house expropriations. The department shall issue relevant certification materials or approval documents and red line maps. If the construction activities belong to the construction of affordable housing projects and the reconstruction of old urban areas, the development and reform administrative department shall also issue certification materials or approval documents that comply with the annual plan for national economic and social development. ; If it does not meet the requirements, the administrative department responsible for verification shall explain the reasons in writing. Article 9 If the house expropriation department deems upon review that the house expropriation complies with the provisions of laws, regulations and these Measures, it shall organize on-site inspections based on the red line map, combined with the actual conditions of the houses within the planned land area, and draft the scope of house expropriation and submit it to the city or county (city) ) District People's Government. If the city or county (city) district people's government believes that it is in the interests of the public and it is really necessary to expropriate houses, it shall determine the scope of house expropriation and make an announcement within the scope of house expropriation. Article 10: After the scope of house expropriation is announced, no new construction, expansion, reconstruction of houses, change of house use, etc. shall be carried out within the scope of house expropriation to improperly increase the compensation fee; if it is carried out in violation of the regulations, no compensation will be given.

The housing expropriation department shall notify the relevant departments in writing of the matters listed in the preceding paragraph to suspend the relevant procedures and specify the suspension period. The suspension period shall not exceed twelve months from the date of announcement of the collection scope.

During the suspension period stipulated in the preceding paragraph, if the expropriated person or lessee carries out property division of the house, industrial and commercial registration, household registration transfer and household division, house decoration, etc. that increase the compensation expenses improperly, no compensation will be given.

Article 11 The house expropriation department shall investigate and register the ownership, location, purpose, construction area, etc. of the houses within the scope of house expropriation, and determine the delivery address of relevant documents, the person to be served, and their contact information. The lessee shall cooperate. The investigation results shall be announced to the expropriated persons and lessees within the scope of house expropriation.

For unregistered buildings, the housing expropriation department shall submit the request to the municipal or county (city) district people's government to organize urban and rural planning, land resources, housing and construction, urban management and other relevant administrative departments to investigate and identify in accordance with the law. and processing. Specific methods for the investigation, identification and handling of unregistered buildings shall be separately stipulated by the Municipal People's Government.

For investigation and registration of public housing directly managed by the public housing management department and public housing self-managed by the unit, the public housing management department and the owner of the public housing self-managed by the unit shall provide the lessee, house use area, construction area and other information to the housing expropriation department. Whether the tenant of a residential house complies with the housing reform policy and other relevant conditions.

Administrative departments such as taxation, public security, market supervision and management, and real estate registration agencies shall provide the housing expropriation department with tax payment, household registration, industrial and commercial registration, real estate registration and other information of expropriated persons and lessees in accordance with their respective responsibilities.
