Annex II to the Basic Law of the People's Republic of China (PRC) Special Administrative Region Method for Forming the Legislative Council of the Hong Kong Special Administrative Region and its voting procedures (202 1 Amendment) 1. The Legislative Council of the Hong Kong Special Administrative Region is composed of 90 members for each term, as follows:

Members elected by the Election Committee? 40 people

Members elected by functional constituencies? 30 people

Members directly elected by districts? 20 people

The above-mentioned election committee is the election committee specified in Annex I of this Law. 2. Candidates for election by the Election Committee shall be nominated by no less than 10 and no more than 20 members of the Election Committee, and no less than 2 and no more than 4 members from each sector shall participate in the nomination. Any eligible voter can be nominated as a candidate. Each member of the Election Committee may propose only one candidate.

The Election Committee shall vote by secret ballot according to the nominated list. The number of people selected for each ballot is equal to the number of members to be elected, and 40 candidates with more votes are elected. 3. The following 28 functional constituencies are elected by functional constituencies: agriculture and fisheries, Heung Yee Kuk, industry (first), industry (second), textiles and clothing, business (first), business (second), business (third), finance, financial services, insurance, real estate and construction, shipping and transportation, import and export, tourism and transportation. Education, sports, performing arts, culture and publishing, medical and health care, social welfare, labor, Chinese People's Political Consultative Conference, member of the National People's Congress of the Hong Kong Special Administrative Region, and representatives of relevant national organizations. Among them, three members were elected by the labour sector, and one member was elected by other sectors.

Members from Heung Yee Kuk, engineering, architectural surveying, urban planning and garden boundary, accounting, law, education, medical and health care, social welfare, members of the National People's Congress of the Hong Kong Special Administrative Region Chinese People's Political Consultative Conference and representatives of relevant national organizations are elected by individual voters. Members from other sectors are elected by eligible corporate voters, and eligible corporate voters from all walks of life are composed of representative institutions, organizations, groups or enterprises as stipulated by law. Unless specified in the electoral law of the Hong Kong Special Administrative Region, relevant organizations and enterprises must obtain the corresponding qualifications of their respective sectors and continue to operate for more than three years before they can become voters in that sector.

Candidates must be nominated by not less than 10 and not more than 20 voters in their respective sectors and not less than 2 and not more than 4 members of the Election Committee in each sector. Each member of the Election Committee can only propose one candidate in the functional constituency election.

Voters from all walks of life elect members of the Legislative Council in this sector by secret ballot according to the list of nominations.

The division of statutory bodies in different sectors, the definition of eligible corporate voters and the election methods shall be stipulated by the Hong Kong Special Administrative Region in the electoral law. Four, the establishment of ten constituencies by direct election, each constituency elected two members.

Candidates must be nominated by not less than 100 and not more than 200 voters in their constituency and not less than 2 and not more than 4 members of each sector of the Election Committee. Each member of the Election Committee can only propose one candidate in the geographical direct election.

Voters choose a candidate by secret ballot according to the nominated list, and the two candidates with more votes are elected.

The electoral division and voting methods shall be prescribed by the Hong Kong Special Administrative Region in the electoral law. 5. The Candidate Qualification Examination Committee of the Hong Kong Special Administrative Region is responsible for examining and confirming the qualifications of candidates for the Legislative Council. The Committee for Safeguarding National Security of the Hong Kong Special Administrative Region shall, according to the examination conducted by the police department for safeguarding national security of the Hong Kong Special Administrative Region Government, make a judgment on whether the candidates for Legislative Council Members meet the statutory requirements and conditions for supporting the Basic Law of the People's Republic of China and the Hong Kong Special Administrative Region of China, and issue examination opinions to the Candidate Qualification Committee of the Hong Kong Special Administrative Region for those who do not meet the above statutory requirements and conditions.

No lawsuit may be brought against the decision made by the Candidate Qualification Examination Committee of the Hong Kong Special Administrative Region on the confirmation of the candidate qualification of the Legislative Council Members based on the examination opinions of the Committee for Safeguarding National Security of the Hong Kong Special Administrative Region. 6. The Hong Kong Special Administrative Region shall take measures to control the manipulation and sabotage of elections in accordance with laws and regulations. 7. Unless otherwise provided for in this Law, the Legislative Council of the Hong Kong Special Administrative Region shall adopt the following procedures for voting on bills and motions:

A bill introduced by the government shall be passed if it receives more than half of the votes of all the members present at the meeting.

Proposals, bills and amendments to government bills proposed by individual members of the Legislative Council must be passed by more than half of the members present at the meeting, namely, those elected by the Election Committee, those elected by functional constituencies and those directly elected by geographical constituencies. Eight, the NPC Standing Committee shall exercise the right to amend these measures and the voting procedures of bills and motions according to law. Before the NPC Standing Committee made the amendment, it listened to the opinions of all sectors of the Hong Kong community in an appropriate form. IX. These Measures and voting procedures for bills and motions shall come into force on March 3, 20021year. The original Annex II and the relevant amendments will no longer be implemented.
