Interim Measures for the Administration of Public Credit Information in Fujian Province
Chapter I General Provisions Article 1 In order to standardize the collection, disclosure and use of public credit information, strengthen the management of public credit information, comprehensively promote the construction of social credit system, and create a good social credit environment for the construction of "Credit Fujian", these Measures are formulated in accordance with relevant laws and regulations and combined with the actual situation of this province. Article 2 The collection, disclosure, use, supervision and management of public credit information within the administrative area of this province shall abide by these measures. Article 3 The term "public credit information" as mentioned in these Measures refers to the data and materials that reflect the credit status of natural persons, legal persons and other organizations generated and mastered by administrative organs and organizations authorized by laws and regulations to manage public affairs (hereinafter referred to as relevant organs and organizations) in the course of performing their duties.

The term "natural person" as mentioned in these Measures refers to the legal representative of the enterprise, the main managers of the enterprise, individual industrial and commercial households and employees with professional qualifications. Article 4 The collection, disclosure, use, supervision and management of public credit information shall follow the principles of legality, objectivity, impartiality and timeliness, keep state secrets and protect business secrets and personal privacy. Article 5 The people's governments at or above the county level shall strengthen their leadership over public credit information work, establish and improve the coordination mechanism of public credit information management, and coordinate and solve major problems in public credit information work.

The provincial people's government is responsible for organizing the preparation of the province's social credit system construction plan and publishing it to the public; The people's governments of districts and cities shall, according to the construction plan of social credit system in the whole province, formulate the construction plan of social credit system in their respective administrative areas and make it public.

The municipal people's governments of provinces and districts shall establish and improve the public credit information system and guarantee the required funds. Article 6 The Development and Reform Department of the Provincial People's Government and Fuzhou Central Sub-branch of the People's Bank of China are the competent departments of public credit information in the province, responsible for guiding, supervising and managing the collection, disclosure and use of public credit information in the province, and undertaking the daily work of the leading group for the construction of social credit system in the province.

Cities and counties (cities, districts) divided into districts may determine the competent department of public credit information with reference to the provisions of the preceding paragraph and exercise the functions of public credit information management within their respective administrative areas. Seventh relevant organs and organizations are responsible for the collection, disclosure and use of public credit information.

Relevant organs and organizations shall formulate a public credit information management system with industry characteristics, define the functional institutions and responsible personnel of the credit information work of their own units, and be responsible for collecting, sorting, preserving and processing public credit information generated or obtained in the course of performing their duties. Article 8 The public credit information platforms of provinces, autonomous regions and municipalities are interconnected or share data with the industry credit information systems of relevant organs and organizations at the same level, so as to realize the cross-regional and cross-industry use of public credit information in the whole province and provide relevant information inquiry services to the society. Article 9 In the collection, disclosure, use, supervision and management of public credit information, administrative organs shall establish cooperation mechanisms with judicial organs to realize information sharing. Chapter II Collection of Public Credit Information Article 10 The competent department of provincial public credit information shall, in accordance with laws, administrative regulations and national standards, formulate technical specifications for public credit information in this province. Relevant organs and organizations shall provide information to the public credit information platform according to the catalogue of public credit information. Article 12 The credit information of natural persons, legal persons and other organizations includes basic information, good information, prompt information and warning information.

Basic information refers to the identity and related information of natural persons, legal persons and other organizations qualified to engage in specific activities.

Good information refers to information that natural persons, legal persons and other organizations have abilities beyond the average level of ordinary individuals or have made contributions in specific fields, including honors awarded by governments or departments at or above the provincial level, information that has made contributions to charity, and information that has been evaluated in excellent grades in classified management.

Prompt information refers to credit information that does not violate laws and regulations and may cause risks to counterparties and trading behaviors.

Warning information refers to the bad information produced by natural persons, legal persons and other organizations in violation of legal provisions. Thirteenth public credit information departments can collect credit information of natural persons from relevant organs and organizations according to law, mainly including:

(1) Basic information, including identity information and occupation information;

(2) Good information;

(3) prompt information;

(four) warning information, tax arrears, criminal offences, administrative penalties, civil judgment execution and other bad information that can be recorded according to law.

The information specified in the preceding paragraph shall also include the contents of registration, alteration, cancellation or revocation. Fourteenth relevant organs and organizations shall not collect personal religious beliefs, genes, fingerprints, blood types, diseases and medical history, as well as other personal information prohibited by laws and administrative regulations.

The relevant organs and organizations shall not collect personal income, deposits, marketable securities, commercial insurance, real estate, tax payment and other information, unless the information subject is clearly informed of the possible adverse consequences of providing this information and obtains its written consent.
