The term "big data" as mentioned in these Regulations refers to a collection of data with large capacity, various types, fast access speed and high application value, as well as a new generation of information technology and service formats that collect, store and analyze data, discover new knowledge, create new value and enhance new capabilities. Article 3 The province establishes the strategic position of big data leading development. Promoting the development of big data should follow the principles of government guidance, market dominance, openness and tolerance, innovative application and security. Article 4 The people's governments at or above the county level shall strengthen their leadership over the development of big data within their respective administrative areas, establish an overall coordination mechanism for the development of big data, incorporate the development of big data into the national economic and social development plan, strengthen the efforts to promote the development of big data, and give priority to the protection of big data development funds as key areas of fiscal expenditure.
The competent department of big data work of the people's governments at or above the county level is responsible for promoting the development of big data and related activities, and other relevant departments do relevant work within their respective responsibilities. Article 5 When engaging in activities related to the development of big data, natural persons, legal persons and other organizations shall abide by laws and regulations, and shall not disclose state secrets, business secrets and personal privacy, and shall not harm national interests, public interests and the legitimate rights and interests of others. Sixth people's governments at or above the county level and the relevant departments of the provincial people's government shall, in accordance with the relevant provisions of the state and the province, commend and reward the units and individuals that have made outstanding contributions in promoting the development of big data. Chapter II Infrastructure Article 7 People's governments at or above the county level shall organize relevant departments to formulate and implement plans for digital infrastructure construction, strengthen the overall coordination of digital infrastructure construction, and establish an efficient, collaborative and intelligent digital infrastructure system.
The special planning of infrastructure such as transportation, energy, water conservancy and municipal administration should be linked with the planning of digital infrastructure construction. Article 8 The municipal people's governments of provinces and districts shall organize relevant departments to promote the construction of computing power infrastructure such as new data centers, intelligent computing centers and edge data centers, improve the diversified level of computing power supply, and enhance the supporting capacity of intelligent applications. Article 9 People's governments at or above the county level and relevant departments shall support communication operators to strengthen the construction of high-speed broadband networks and improve network coverage and access capacity. Article 10 People's governments at or above the county level and relevant departments shall promote the construction of the Internet of Things, support the construction and application of sensing systems in the fields of infrastructure, urban governance, logistics and warehousing, manufacturing and life services, and promote the interconnection of sensing systems and the sharing of data. Article 11 The industrial and information departments of the people's governments at or above the county level shall, jointly with relevant departments, promote the construction of industrial Internet, improve the identification and analysis system of industrial Internet, and promote the deployment of new industrial networks. Twelfth provincial people's government departments in charge of big data work should build the province's integrated big data platform, co-ordinate the construction of the province's e-government cloud platform, and strengthen the integration and management of the province's e-government cloud platform.
The department in charge of big data work of the people's governments at or above the county level shall, jointly with relevant departments, build the e-government network at the corresponding level in accordance with the provisions, and optimize and integrate the existing e-government network. Thirteenth people's governments at or above the county level and their relevant departments shall promote the digital transformation of infrastructure in the fields of transportation, energy, water conservancy and municipal administration, and establish an intelligent infrastructure system. Fourteenth people's governments at or above the county level and their relevant departments shall, in accordance with the requirements of implementing the rural revitalization strategy, strengthen the construction of digital infrastructure in rural areas and improve the construction level and coverage quality of rural digital infrastructure. Chapter III Data Resources Article 15 The competent department of big data work of the people's government at or above the county level shall, in accordance with the relevant national and provincial regulations on data management, use and income, make overall plans for the management of data resources within their respective administrative areas according to law.
All kinds of data (hereinafter referred to as public data) collected and generated by state organs, organizations authorized by laws and regulations to manage public affairs, people's organizations and other enterprises and institutions with public service functions (hereinafter referred to as public data providers) in the process of performing public management and service duties according to law shall be organized by the department in charge of big data work of the people's government at or above the county level in accordance with relevant national and provincial regulations.
If financial funds are used to purchase data other than public data (hereinafter referred to as non-public data), it shall be reported to the competent department of big data work of the people's government at the same level for review unless otherwise provided by laws and administrative regulations. Sixteenth data resources shall be subject to directory management.
The department in charge of big data work of the provincial people's government shall formulate specifications for the compilation of public * * * data catalogues, and organize the compilation and publication of the general catalogue of public * * * data in this province.
The public * * * data provider shall, in accordance with the public * * * data catalogue compilation specification, compile and update the public * * * data catalogue of the unit, and report it to the department in charge of big data work for review, and incorporate it into the general catalogue of public * * * data of this province.
Encourage non-public * * * data providers to compile and update the non-public * * * data catalogue with reference to the public * * * data catalogue compilation specification.
