The relevant departments of the people's governments at or above the county level and the organizations authorized by the people's governments at or above the county level are the competent business units of social organizations within the relevant industries, disciplines or business scope, provide business guidance and management to social organizations according to law, and assist the civil affairs departments at the same level in implementing the registration management of social organizations. The people's governments at or above the county level shall authorize the authorized organizations for five years.
Finance, taxation, market supervision and management and other relevant departments shall, according to the prescribed responsibilities, assist the civil affairs departments at the same level to implement the registration management of social organizations. Article 4 The registration management of social organizations shall be under the management system of dual responsibility of the competent business unit and the civil affairs department. Article 5 The people's governments at or above the county level shall strengthen their leadership over the registration and management of social organizations, encourage and support their development, standardize and guide their behaviors, support their activities according to law, and coordinate and solve major problems in the development of social organizations in a timely manner. Article 6 Social organizations may invest in the establishment of business institutions of enterprises as legal persons or unincorporated organizations suitable for their purposes. However, if it is established by using state-owned assets, it shall be reported to the financial department for examination and approval according to law.
The establishment of an enterprise legal person or an unincorporated business organization by a social organization shall be reported to the civil affairs department for the record. Chapter II Jurisdiction Article 7 The registration administration of provincial social organizations shall be the responsibility of the Provincial Civil Affairs Department; The civil affairs departments of cities and counties (cities, districts) with districts are responsible for the registration and management of social organizations; The registration management of township and street social organizations is the responsibility of the county (city, district) civil affairs department. Article 8 The civil affairs department at the next higher level in the same administrative region shall be responsible for the registration and management of social organizations across administrative regions. Article 9 If the civil affairs department and the competent business unit are not in the same place as the domicile of the social organization under their jurisdiction, they may entrust the civil affairs department and the competent business unit of the domicile of the social organization to be responsible for supervision and management within the scope of entrustment.
The entrusting department or unit shall issue a power of attorney on the entrusted matters and bear legal responsibility for the administrative acts carried out by the entrusted department or unit within the scope of entrustment. Chapter III Registration of Establishment Article 10 An application for the establishment of a social organization shall be approved by its competent business unit, and the promoters shall apply to the civil affairs department for registration. The sponsors of social organizations shall not be less than five; The number of promoters shall not be less than three units; Individuals and units * * * as sponsors, shall not be less than five. Article 11 The names of social organizations shall meet the following requirements:
(a) consistent with the business scope, membership distribution and activity area of social organizations;
(2) It is obviously different from the name of the registered social organization;
(3) The names of social organizations or banned organizations whose cancellation or revocation time is less than 3 years shall not be used;
(4) Academic social groups are generally named after societies or research institutes, industrial social groups are generally named after trade associations, trade associations, trade associations or chambers of commerce, professional social groups are generally named after associations or promotion associations, and joint social groups are generally named after federations or fraternity associations;
(5) Other relevant provisions of the Regulations. Twelfth to apply for registration of social organizations, the sponsors shall submit the following materials to the civil affairs department:
(1) An application for registration signed by the promoters;
(2) A document from the competent business unit agreeing to establish a social organization;
(3) A capital verification report issued by an accounting firm;
(four) proof of the ownership or right to use the place;
(5) Basic information and identity certificates of the promoters and the person-in-charge to be appointed;
(six) the draft articles of association drafted with reference to the model text of the articles of association of social organizations formulated by the civil affairs department of the State Council. Thirteenth promoters shall apply to the civil affairs department for registration of social organizations within three months from the date of receiving the documents from the competent business unit agreeing to establish social organizations; If an application is submitted to the civil affairs department within the time limit, a document re-signed by the competent business unit agreeing to establish a social organization shall be obtained. Fourteenth civil affairs departments shall, after accepting the application for registration of social organizations, make a decision of approval or disapproval within 60 days from the date of receiving all valid materials. If the registration is granted, a Certificate of Registration of Social Organizations as Legal Persons shall be issued; If the registration is not granted, the reasons shall be explained in writing.
The registered items of social organizations include: name, domicile, purpose, business scope, activity area, legal representative, activity funds and competent business unit.
The legal representative of a social organization may not be the legal representative of other social organizations at the same time. Fifteenth social organizations that have obtained legal person status according to law from the date of approval shall submit approval documents to the civil affairs department within 60 days from the date of approval, and apply for the legal person registration certificate for Social Organizations. The civil affairs department shall, within 30 days from the date of receiving the documents, issue the registration certificate of social organizations as legal persons.
