1. How many days of paid annual leave do civil servants have?

According to the Regulations on Paid Annual Leave for Employees, the number of days of paid annual leave for civil servants depends on their working years. Those who have worked for more than one year but less than ten years will be given five days off every year.

Regulations on paid annual leave for employees

Article 2 Employees of government organs, organizations, enterprises, institutions, private non-enterprise units and individual industrial and commercial households with employees who have worked continuously for more than 1 year shall enjoy paid annual leave (hereinafter referred to as annual leave). The unit shall ensure that employees enjoy annual leave. During the annual leave, employees enjoy the same salary as during normal work.

Article 3 If an employee has worked for more than 1 year but less than1year, he/she shall have an annual leave of 5 days; Annual leave 10 days if it is over/kloc-0 years but less than 20 years; Annual leave 15 days for those who have completed 20 years.

National statutory holidays and rest days are not included in the annual leave.

2. What if the company doesn't arrange annual leave?

If the employing unit fails to arrange annual leave for the employees or fails to finish the annual leave after consultation with the employees themselves, it shall, in addition to the normal salary income, pay the employees annual leave salary equivalent to twice their daily salary according to the number of days they should take annual leave.

If an employee does not enjoy the annual leave treatment when his/her labor contract expires or his/her labor relationship is terminated, the employing unit may extend the employee's labor contract until the employee takes annual leave, and then go through the formalities for termination or rescission of the labor contract after the employee takes annual leave. Employees are not allowed to enjoy annual leave repeatedly between different units. When an employer terminates or rescinds a laborer's labor contract, it shall specify the annual leave enjoyed by the laborer in the certificate of termination or rescission of the labor contract, and store the certificate of termination or rescission of the labor contract in the employee's file.

Employees who are legally approved to implement the flexible working system do not need to pay three times the salary for annual leave, but the employer shall scientifically and reasonably determine the labor remuneration of employees according to their workload and work performance. Personnel who implement the annual salary system may apply to the employer for flexible working hours according to law. In addition, part-time employees do not enjoy paid annual leave.
