Goods can freely enter and exit between the bonded area and overseas. Except for goods whose import and export are prohibited by the state and have special provisions, customs duties and import link taxes are exempted, and inspection permits and routine customs supervision procedures are exempted. Article 3 The bonded area mainly develops import and export trade, entrepot trade, processing trade, goods storage, goods transportation, goods display, goods trading and finance. Article 4 The bonded area is led by the Shanghai Municipal People's Government (hereinafter referred to as the Municipal People's Government), and the customs supervises the customs business. Article 5 Enterprises, institutions and individuals in the bonded area and their related economic activities must abide by these Regulations. Article 6 The legitimate rights and interests of investors in the bonded area are protected by law. Chapter II Management and Service Institutions Article 7 Shanghai Waigaoqiao Free Trade Zone Management Committee (hereinafter referred to as the Administrative Committee) is an agency of the Municipal People's Government, which uniformly manages the administrative affairs of the Free Trade Zone and implements independent accounting for financial revenue and expenditure management.
The director of the CMC is appointed by the Municipal People's government. Article 8 The CMC shall exercise the following duties:
(1) To be responsible for the implementation of laws, regulations and these Regulations in the bonded area, and to formulate and issue specific management regulations for the bonded area;
(two) to formulate the development plan and industrial policy of the bonded area, and organize the implementation after the approval of the Municipal People's government;
(3) To be responsible for the planning, planning, state-owned assets, investment, foreign economic relations and trade, finance, local taxation, statistics, industrial and commercial administration, public security, labor and personnel, foreign affairs, transportation, infrastructure, land and real estate, environmental protection, environmental sanitation and public utilities of the bonded area;
(four) to coordinate the work of customs, national tax, finance, commodity inspection and other departments in the bonded area;
(five) other functions and powers granted by the Municipal People's government.
Where the management work in Item (3) of the preceding paragraph involves the issuance of licenses, the relevant municipal competent departments shall entrust the relevant administrative departments of the CMC to handle it. Article 9 Customs in the bonded area shall exercise special supervision over the bonded area: record and examine the goods and articles entering and leaving the bonded area and the goods circulating in the bonded area; Daily supervision and management of goods, means of transport and articles entering and leaving between bonded areas and domestic non-bonded areas (hereinafter referred to as non-bonded areas). Article 10 The Waigaoqiao Port Area and the Bonded Area shall be managed in an integrated way, and the port management agency shall be responsible for the port management. Article 11 The bonded zone development company entrusted by the CMC undertakes the municipal construction and management of the bonded zone and provides services for enterprises and institutions in the bonded zone. Article 12 The bonded area may set up customs declaration, inspection, labor service, notarization, lawyers and other institutions according to law to provide services for enterprises and institutions in the bonded area. Chapter III Establishment of Enterprises Article 13 Investors may apply for the establishment of enterprises in the bonded area in accordance with laws, regulations and these Regulations.
It is forbidden to set up projects that pollute the environment, endanger national security and harm public interests in the bonded area. Article 14 An investor who establishes a foreign-invested enterprise in the bonded area shall apply to the Administrative Committee. The CMC shall, within 20 days from the date of receiving the complete and legal application documents (hereinafter referred to as the application documents), make a decision on whether or not to approve jointly with the relevant departments, and within three days from the date of making the approval decision, the administrative department for industry and commerce of the CMC shall issue a business license.
Investors who set up other enterprises in the bonded area shall apply to the administrative department for industry and commerce of the CMC. The administrative department for industry and commerce of the CMC shall, jointly with the relevant departments, make a decision on whether to approve the registration within fifteen days from the date of receiving the application documents. If the registration is approved, a business license shall be issued.
Applications beyond the scope of examination and approval shall be submitted by the administrative department for industry and commerce of the CMC for examination and approval. The CMC shall, within ten days from the date of receiving the application documents, transfer the application beyond the examination and approval authority to the municipal competent department for examination and approval.
The enterprise shall go through the formalities of customs, taxation, foreign exchange management, commodity inspection and other registration within 30 days after obtaining the business license.
Investors shall make capital contributions on schedule and go through the capital verification procedures. Fifteenth enterprises in the bonded area shall operate according to the approved business scope.
Enterprises should improve the statistical, financial and accounting systems, establish special accounts for goods, and submit relevant statements to the administrative Committee, customs and other relevant departments regularly according to law.
Enterprises should abide by the provisions of environmental protection in construction, production and operation, and go through relevant procedures with the administrative committee according to law. Chapter IV Operating Rules Article 16 Unless otherwise stipulated by the State, enterprises in the bonded area are free to engage in trade between the bonded area and overseas, and are not restricted by quotas and licenses.
Enterprises in the bonded area are free to engage in trade in the bonded area.
Enterprises in bonded areas may engage in trade between bonded areas and non-bonded areas and between bonded areas and other bonded areas in China in accordance with relevant state regulations.
With the approval of the competent foreign trade department of the state, enterprises in bonded areas may act as agents for the import and export business of non-bonded enterprises.
