What can be mortgaged are
(a) the land use right of collectively owned barren hills, gullies, hills, beaches and other wasteland contracted by farmers with the consent of the employer;
(two) to the township (town) village enterprise factory buildings and other buildings as collateral, the enterprise factory buildings and other buildings within the scope of collective land use rights shall be mortgaged at the same time.
No mortgage allowed:
(1) collective land ownership;
(two) the land use right of township enterprises shall not be mortgaged separately;
(3) Cultivated land, homestead, private plots and private hills;
(four) the ownership and use right of collective land is unknown or controversial;
(5) Collective land sealed up according to law.
Two. According to the Provisional Regulations of the People's Republic of China on Assignment and Transfer of the Right to Use Urban State-owned Land.
Article 32 stipulates that land use rights can be mortgaged.
Article 35
The land use right and the mortgage of buildings and other crops on the ground shall be registered in accordance with the provisions.
