According to the provisions of Article 6 of the Interpretation of the Supreme People's Court on Applicable Legal Issues in the Trial of Construction Contract Disputes, advance payment is allowed in engineering construction. Where the parties have agreed on the advance payment and its interest, and the contractor requests to return the advance payment and its interest according to the agreement, it shall be supported, except that the agreed interest calculation standard is higher than the interest rate of similar loans of the People's Bank of China in the same period. If the parties have no agreement on the advance payment, it shall be treated as the project arrears. If the parties have no agreement on the interest of the advance payment, and the contractor requests to pay the interest, it will not be supported.
