Prior to this, the Notice of Tianjin Municipal Bureau of Land and Housing Management on Comprehensively Carrying out Online Signing of Stocking Houses of Brokerage Institutions (Tianjin Land and Housing Development [2016] No.24) is about to expire.
The new version of the Notice requires that when a brokerage agency signs a brokerage service contract online, it should check the client's household registration book, identity certificate, marriage certificate and the real estate ownership certificate of the house entrusted for sale, and input the identity information of the seller and the number of the real estate ownership certificate into the online signing system for matching verification. Only those who have passed the verification can sign a service contract online and release the information of house sale.
The information that the house has been mortgaged shall be made clear to the buyer by the brokerage institution; The house whose transfer is restricted according to law, such as changing the certificate of ownership of real estate, sealing up registration, etc., shall not be entrusted to the seller.
If a house transaction is conducted through a brokerage institution, the brokerage institution shall sign an existing home sale agreement online. Brokerage agencies should carefully check the household registration book, identity certificate, marriage certificate, real estate ownership certificate and other materials presented by the buyers and sellers. If the buyer and seller fail to produce the above materials or check the information incorrectly, they may not sign an existing home sale agreement online. Brokerage agencies may not charge any fees for signing existing home sales agreements online.
If the buyer and the seller fail to complete the stock house transaction by themselves through the intermediary of the brokerage agency, they can go to the district real estate registration hall where the house is located, and the real estate registration agency will sign the agreement online.
When signing an online existing home sale agreement for the buyer and the seller, the staff of the brokerage institution shall accurately enter the relevant information of the agreement according to the true meaning of the buyer and the seller. The seller and the buyer check the entered agreement information, and the staff of the brokerage institution can submit the online signing agreement for confirmation only after the printed agreement is signed and sealed by both parties. Without the consent of the buyer and the seller, the staff of the brokerage institution shall not sign the existing home sales agreement online without authorization, and shall not assist the buyer and the seller to conceal or falsely report the actual transaction price for the purpose of evading taxes, fund supervision and defrauding bank loans.
The Tianjin Housing Construction Committee said that the housing construction committees of all districts will investigate and deal with the illegal acts of brokerage institutions according to law, and close the online signing system port during the investigation. If the circumstances are serious, the qualification for online signing may be cancelled.
