Guarantor's Exemption of Defense Reply

Respondent: Ma, female, Han nationality, born on x, month, xxxx, xxxxxx, currently lives in xxxxxx, contact number xxxxxx.

On November 4, 2011, the respondent Ma submitted a "Civil Complaint" to your court, requiring the respondent and defendant xxx to return the loan of 667,000 yuan. The respondent received the letter from your court. After the lawsuit was reached, it was believed that the respondent's claim could not be established at all for the following reasons:

1. The contract is relative, and the creditor can only ask the debtor for the return of the loan. The respondent's claim for the respondent to return the loan has no basis.

2. The respondent’s signing and sealing of the IOU is not a guarantee, but a witness to the fact of the loan.

3. Even if the respondent’s signing and sealing is regarded as a guarantee by the respondent, the guarantee has expired and the respondent will not bear any legal liability. To sum up, the respondent believes that in the dispute arising from the loan between the respondent Ma and the defendant xxx, the respondent neither engaged in any loan activity with the respondent nor expressed any guarantee, and is not a party to this case.
