Article 17 Anyone who commits any of the following acts shall be fined a fine of more than 200 yuan by the public security organ. A fine of not more than 1,000 yuan, or a detention of not more than ten days, and any illegal gains shall be confiscated:
(1) Anyone who uses another person’s resident identity card or uses a fraudulently obtained resident identity card;
>(2) Buying, selling, or using forged or altered resident identity cards.
Forged or altered resident identity cards and fraudulently obtained resident identity cards shall be confiscated by the public security organs.
Article 18 Anyone who forges or alters a resident identity card shall be held criminally responsible in accordance with the law.
Anyone who commits any of the acts listed in Articles 16 and 17 of this Law and engages in criminal activities shall be held criminally responsible in accordance with the law.
Article 19 It constitutes a crime for staff of state agencies or financial, telecommunications, transportation, education, medical and other units to disclose citizens’ personal information recorded on resident identity cards obtained in the process of performing duties or providing services. If it does not constitute a crime, the public security organ shall detain him for not less than ten days but not more than fifteen days and impose a fine of RMB 5,000. If there is any illegal income, the illegal income shall be confiscated.
If a unit commits the acts mentioned in the preceding paragraph and it constitutes a crime, it shall be investigated for criminal responsibility in accordance with the law; if it does not constitute a crime, the public security organ shall be responsible for the person directly in charge and other persons directly responsible for it and shall be sentenced to not less than ten days and fifteen years. Detain for less than 10 days, and impose a fine of not less than 100,000 yuan but not more than 500,000 yuan. If there are any illegal gains, the illegal gains will be confiscated.
Anyone who commits the acts in the preceding two paragraphs and causes damage to others shall bear civil liability in accordance with the law.
