Measures for the administration of coal mine resumption of work and production?

Article 1 In order to strengthen and standardize the acceptance of coal mine's resumption of work, and resolutely prevent and contain serious accidents in coal mines, these measures are formulated according to the Law of People's Republic of China (PRC) on Safety in Production, the Opinions of General Office of the State Council on Further Strengthening the Work of Safety in Coal Mine, and other laws, regulations and documents.

Article 2 These Measures shall apply to the resumption of production acceptance of all legally produced and constructed coal mines in China.

Article 3 The acceptance of resumption of production in coal mines shall be classified according to the state and nature of production suspension. Shutdown refers to the coal mine construction to stop construction work; Stop production refers to the production of coal mines to stop production operations.

(a) for less than 30 days, the ventilation, drainage, safety monitoring system and personnel position monitoring system are operating normally, and the maintenance and safety inspection of underground tunnels and equipment and facilities are carried out normally during the shutdown period, which shall be accepted by the coal mining enterprise (coal mine).

(two) the coal mine safety supervision department is responsible for the acceptance of the following coal mines:

1. Due to natural disasters or mine accidents, the safety production system or roadway is seriously damaged or the wellhead (mining area) coal mine is closed;

2 coal mines that have been shut down for 30 days or more;

3. Coal mines ordered to stop production by relevant departments due to production safety accidents, hidden dangers of major production safety accidents or illegal acts;

4 coal mine safety supervision departments and coal mine safety supervision institutions that need to resume production acceptance of other coal mines.

Article 4 In accordance with the principle of territorial grading supervision, the resumed coal mines shall be subject to grading acceptance. The provincial coal mine safety supervision department is responsible for the supervision of coal mines, and the provincial coal mine safety supervision department shall organize the acceptance, and the main person in charge shall sign it; City (prefecture) level coal mine safety supervision department is responsible for the supervision of coal mines, by the city (prefecture) level coal mine safety supervision department to organize the acceptance, the city (prefecture) level people's government is mainly responsible for the signature; Other coal mines shall be accepted by the county-level coal mine safety supervision department and signed by the main person in charge of the county-level people's government. If a coal mining enterprise (coal mine) organizes the acceptance, it shall be signed by the main person in charge of the coal mining enterprise (coal mine).

Article 5 Before a coal mine unseals its wellhead and personnel enter a mine with severe rockburst or stops production for more than 30 days to investigate the hidden dangers of accidents, they should first conduct a safety risk assessment, formulate a work plan and safety technical measures for unsealing the wellhead and investigating the hidden dangers of accidents, and apply to the coal mine safety supervision department. After examination and approval, the preliminary work of resuming production such as unsealing the wellhead can be carried out. The investigation and management of hidden dangers of coal mine accidents must delimit the scope of work, define the duration of work, limit the location of work and the number of workers in various types of work, and implement the "responsibilities, measures, funds, time limits and plans".

Coal mines ordered to be closed by public security, land, environmental protection, coal industry management and other departments. Those who stop production may not apply for resumption of production until the relevant departments agree to resume production and construction.

Article 6 A coal mine applying for resumption of work and production shall meet at least the following conditions:

(a) the coal mine safety production license is legal and effective, the conditions for safe production conform to the provisions of the Measures for the Implementation of Safety Production License for Coal Mine Enterprises, the procedures for coal mine construction are complete, and the qualifications of construction and supervision units conform to the relevant provisions;

(two) meet the requirements of the three-level safety production standardization level;

(three) the general survey of hidden dangers and disaster-causing factors is clear, and the situation of water accumulation in mines and surrounding old goaf is clear;

(4) The safety monitoring and personnel position monitoring system is operating normally;

(five) coal mine management personnel, professional and technical personnel and special operations personnel meet the requirements;

(six) the safety training of employees meets the requirements of the "Regulations on Coal Mine Safety Training";

(seven) disaster management institutions, personnel, equipment and other requirements in accordance with the relevant provisions;

(eight) the coal mine has a mine rescue team that meets its service requirements. Article 7 The acceptance of coal mine resumption shall be conducted according to the following procedures: (1) The main person in charge of the coal mine shall organize the formulation of the resumption plan and safety technical measures; (two) the main person in charge of the coal mine organizes the investigation and management of hidden dangers of accidents;

(3) Acceptance of coal mining enterprises (coal mines).

The coal mine accepted by the department shall perform the following procedures at the same time as handling the acceptance procedures of coal mining enterprises (coal mines):

(four) by the coal mining enterprises (coal mines) to apply for acceptance;

(five) the coal mine safety supervision department organizes the acceptance;

(six) to perform the signing procedures;

(seven) issued a notice agreeing to resume work and production.

Article 8 Coal mines under any of the following circumstances may not resume production:

(a) the application materials are incomplete or untrue;

(two) the main person in charge of the coal mine did not organize a comprehensive investigation of hidden dangers, did not formulate safety technical measures to rectify hidden dangers or did not complete the management of hidden dangers;

(three) did not strictly fulfill the acceptance procedures for returning to work;

(four) without acceptance, unqualified acceptance or failure to perform the signing procedures or department acceptance did not send a notice of resumption of work;

(five) the existence of unauthorized organization of production and construction in the name of equipment maintenance and hidden dangers rectification;

(six) there are major accidents such as equipment and technology that are explicitly prohibited or eliminated;

(seven) the coal mine safety supervision department and the coal mine safety supervision organization believe that there are major safety hazards in the resumption of production and construction.

Article 9 After the coal mine stops production, it is necessary to strengthen safety management and do a good job in normal ventilation, drainage, underground roadway and equipment and facilities maintenance, safety inspection, monitoring and duty. Coal mining enterprises (coal mines) are responsible for the acceptance of coal mines that have resumed production, and inform the coal mine safety supervision departments and coal mine safety supervision institutions.

Tenth coal mine safety supervision departments and coal mine safety supervision institutions shall, after ordering the coal mine to stop production, promptly notify the public security, electric power and other departments (units) to stop or limit the supply, collect civil explosives and limit power supply.

Article 11 When the coal mine safety supervision department issues a notice of resumption of work and production, it shall also send a copy to the coal mine safety supervision, coal industry management, public security, electric power and other departments (units).

Twelfth of the unqualified coal mine, no longer accept its application for acceptance within 2 months; For coal mines that resort to deceit and deliberately conceal problems, their applications for acceptance of resumption of work and production will no longer be accepted within six months, and they will be regarded as key regulatory targets. Coal mine safety supervision departments and coal mine safety supervision institutions shall order coal mines that resume production without authorization to immediately suspend production for rectification and temporarily suspend safety production licenses.

Article 13 The work system of "who accepts, who signs and who is responsible" shall be implemented in the acceptance of coal mines, and all personnel involved in the acceptance shall sign the acceptance report and be responsible for the authenticity of the acceptance results. Anyone who violates the procedures, lowers the standards, is lax, or practices fraud in the resumption of production acceptance work, once found, shall be seriously investigated for the responsibility of the relevant units and personnel.

Fourteenth provincial coal mine safety supervision departments can formulate detailed rules for the implementation of coal mine safety work in this area according to these measures.
