Bidding process
Legal analysis: project bidding refers to the legal behavior of the construction unit to attract the contractors of construction projects to compete and choose the party with superior conditions to complete the construction task through legal procedures and methods. The process is generally as follows: the process is generally as follows: first, we must confirm the bidding qualification, bidding method and filing. Then, please ask the manufacturer to send the tender documents with drawings and samples. Then, submit the bidding documents and pre-qualification application as required. The bid opening, bid evaluation and bid selection shall be conducted in public under the auspices of notarization. If they are completely qualified, they will be designated as the winning bidder. Finally, both parties sign a contract or transaction and put it on record.

Legal basis: Bidding Law of People's Republic of China (PRC).

Article 3 The following construction projects within the territory of People's Republic of China (PRC), including engineering survey, design, construction, supervision and procurement of important equipment and materials related to engineering construction, must be subject to tender:

(a) large-scale infrastructure, public utilities and other projects related to social interests and public safety;

(2) Projects that are wholly or partially invested with state-owned funds or financed by the state;

(3) Projects that use loans or aid funds from international organizations or foreign governments.

The specific scope and scale standards of the projects listed in the preceding paragraph shall be formulated by the development planning department of the State Council in conjunction with the relevant departments of the State Council and submitted to the State Council for approval.

Where the law or the State Council has provisions on the scope of other projects that must be subject to tender, such provisions shall prevail.

Article 4 No unit or individual may break up the projects that must be subject to bidding according to law or evade bidding in any other way.

Article 5 Bidding activities shall follow the principles of openness, fairness, impartiality, honesty and credibility.
