Chapter I General Provisions
Article 1 According to the spirit of the Notice of the Ministry of Finance, the Ministry of Education and the China Development Bank on Piloting Student-origin Credit Loan in Some Areas (Caijiao [2007] 135) and the Notice of the General Office of the Provincial Government on Forwarding the Opinions of the Provincial Department of Education and other departments on the Work of Student-origin Credit Loan in Jiangsu Province (Su Zhengban Fa [2008] No.79), in order to do a good job of student-origin credit in our province.
Chapter II Nature and Conditions of Loans
Article 2 Student-origin credit student loans in Jiangsu Province (hereinafter referred to as "student-origin loans") refer to student loans issued by Jiangsu Branch of China Development Bank (hereinafter referred to as "CDB Jiangsu Branch") to freshmen in ordinary colleges and universities and students with financial difficulties from families, which are handled by the students at their domicile before entering school, with the borrower's credit as the guarantee. Students and parents (legal guardians) are the same borrower, and both parties are responsible for repayment.
Article 3 A student applying for a student-origin student loan must meet the following conditions: (1) China nationality; (2) Honest and trustworthy, law-abiding; (3) freshmen who take the unified entrance examination for ordinary colleges and universities and are officially admitted by ordinary colleges and universities (including private colleges and independent colleges), or full-time ordinary college students and graduate students; (4) Students' pre-school household registration and their parents' household registration are in the jurisdiction where the loan application acceptance institution is located; (5) The family income is not enough to pay the basic expenses needed to finish school.
Chapter III Loan Policy
Article 4 Student-origin credit student loans shall be used for the tuition and accommodation fees of students during their stay at school, and shall be applied, approved and issued annually, with no more than 6,000 yuan per student per year. The amount of loans issued by various localities and universities every year should be controlled. The specific amount is issued by the Provincial Department of Education and the Provincial Department of Finance according to the number of ordinary colleges and universities in the province and the number of non-fresh graduates in March each year, in accordance with relevant policies and with the consent of Jiangsu Branch.
Article 5 In principle, the term of student-origin student loans shall be determined according to the academic system of full-time colleges and universities plus 14 years, but the longest term shall not exceed 14 years. The grace period of "no repayment of principal, only interest" is two years after graduation. If the educational system exceeds 4 years or fresh graduates pursue postgraduate or second bachelor's degrees, the grace period will be extended accordingly, but the loan period will not be adjusted.
Article 6 The loan interest of students' origin shall be collected on an annual basis, and the value date shall be the date when the loan funds of CDB Jiangsu Branch are released. The loan interest rate is the benchmark interest rate of RMB loans of the same grade in the same period, and it is re-determined on February 2 1 every year according to the interest rate level implemented on that day.
Article 7 In order to help students from poor families successfully complete their studies, the financial department shall fully subsidize the interest of students' home loans during their school days (transfer to banks). The borrower shall bear the interest generated after September 1 of the year of graduation, and repay the principal according to the "average capital method" from the third year after graduation. The loan interest shall be settled once a year.1Feb. 20. If there is prepayment, only the actual interest of the repaid principal will be charged, and no other fees will be charged.
Chapter IV Loan Application and Approval
Article 8 All localities and colleges and universities shall, in accordance with the relevant policies of the state and the province, and under the organization of the Provincial Student Financial Assistance Management Center, respectively examine the qualifications of students who participated in the college entrance examination that year and non-fresh college students who applied for student-origin loan. Students studying in colleges and universities outside the province shall apply for loan qualification examination to the student financial assistance management center of the county (city, district) where the original household registration is located with the school certificate, and students who are in urgent need of financial assistance due to emergencies after the qualification examination. Only students who have passed the qualification examination can apply for student-origin student loans, and all localities and colleges and universities must strictly examine and implement them conscientiously and responsibly.
Article 9 In principle, the time for accepting student-origin student loans is from July to September each year, and the specific time is announced in the form of announcement in July each year. The materials required for the borrower to apply for a student loan are: (1) student loan certificate (see table1for samples); (2) Fill in a clear loan application form; (3) Original and photocopy of the following materials: student and 1 parent (legal guardian) ID card, student ID card (student) or admission notice (freshman); (4) The financial card or passbook account number opened by the student in the correspondent bank.
The student loan certificate is divided into three categories: (1) For non-fresh graduates of colleges and universities in the province who have passed the qualification examination, the school or the Ministry of Education (Ministry) and the school funding center print the loan certificate and affix the official seal, and the graduate students can also be issued by the graduate school (Ministry) of the school; (2) Freshmen who have passed the qualification examination of the college entrance examination shall print the loan voucher and affix the official seal of the school; (3) Students from colleges and universities outside the province who have passed the qualification examination and those who are in urgent need of financial aid due to emergencies shall be printed with loan vouchers and stamped with official seals by the county-level student financial aid management center. Anything that does not meet the above requirements is invalid.
Article 10 The student financial assistance management centers in counties (cities, districts) are responsible for accepting students' loan applications, specifically for guiding borrowers to fill in the loan application form (Annex 2), reviewing the information of loan applicants and the qualifications of student loans, and filling out the loan application form after confirming that the school to which the students belong is an ordinary institution of higher learning announced by the Ministry of Education, and inputting relevant information into the CDB business management system. After the loan application is finally approved, the county-level student financial assistance management center fills in the loan contract in strict accordance with the information content of CDB business management system.
Article 11 Borrowing students shall go through the enrollment registration formalities at their colleges and universities with the student source loan contract and the loan receipt issued by the county-level student financial assistance management center, and send the original receipt of the contract sealed and confirmed to the county-level student financial assistance management center before June 20th. 10, otherwise, the application for student source loan will be deemed to be cancelled.
Article 12 Before June 5438+065438+1October 15, the county-level student financial assistance management center will input the collection information into the CDB business management system, and prepare a loan application summary table (see Annex 3 for the style) and submit it to the provincial student financial assistance management center.
Thirteenth provincial student financial assistance management center to deal with the loan applications submitted by all localities for preliminary examination, and submitted to CDB Jiangsu Branch. CDB Jiangsu Branch conducts the final audit according to relevant procedures, and replies the examination results to the Provincial Student Financial Assistance Management Center in writing. The provincial student financial assistance management center should forward the final results to all localities in a timely manner.
Chapter V Loan Issuance and Payment
Fourteenth before the loan is issued, the provincial student financial assistance management center opens a special account for loan deposits in CDB Jiangsu Branch, and the financial assistance centers at all levels open a settlement account for student-origin credit student loan funds in the agent bank. Borrowing students open personal accounts in correspondent banks before applying for loans.
Article 15 After receiving the loan confirmation letter from CDB Jiangsu Branch, the provincial student financial assistance management center shall organize the county student financial assistance management centers to prepare the Loan Instruction Summary Table (Annex 4) according to the amount approved by CDB Jiangsu Branch five days before the loan is issued, and at the same time, timely submit the Loan Notice (Annex 5) stamped with the official seal to the provincial student financial assistance management center and the handling bank. After summarizing, the Provincial Student Financial Assistance Management Center will submit the loan application, IOU and loan amount details of each county to CDB Jiangsu Branch, which will distribute the loan funds to the special account of the Provincial Student Financial Assistance Management Center after passing the internal approval process, and the Provincial Student Financial Assistance Management Center will submit the payment voucher to CDB Jiangsu Branch. The agent bank will remit the loan funds to the account of the financial aid center in the agent bank according to the payment instruction of the provincial student financial aid management center.
Article 16 The correspondent bank is responsible for transferring the loan funds from the settlement account to the borrower's personal account within 3 days at the latest after the loan funds arrive. At the same time, according to the summary of loan instructions, the loan funds will be transferred from the personal account to the account of the borrower's school at the latest within 3 days from the date when the loan funds are transferred from the settlement account to the borrower's personal account. The remittance fee from the student's personal account to the borrower's college payment account shall be borne by the student himself.
Article 17 After the loan disbursement is completed, the handling bank shall affix its official seal on the Summary Table of Loan Remittance (Annex 6) within 3 working days (postponed on holidays) and submit it to the county-level student financial assistance management center, as well as electronic documents and paper documents. Each county-level student financial assistance management center should check the accounts in time and maintain the loan information in the CDB management information system. Provincial Student Financial Assistance Management Center shall summarize and report to CDB Jiangsu Branch.
Chapter VI Recovery of Principal and Interest
Eighteenth of the normal principal and interest recovery. Every year, 65438+February 2 1 is a fixed repayment date, including interest and the principal to be repaid in installments (August 3 1 day, the last principal and interest will be repaid on the expiration date of the contract). The provincial student financial assistance management center is responsible for organizing the county-level student financial assistance management center to do a good job in calculating the debt service funds, and complete the summary table of deduction instructions (Annex 7) five days before the debt service date, and submit the deduction notice (Annex 8) and the summary table of deduction instructions stamped with the official seal to the agent bank. On the fixed repayment date, the agent bank completes the operation of deducting the principal and interest funds, transfers the principal and interest funds into the account opened by the Provincial Student Financial Assistance Management Center in CDB Jiangsu Branch, and provides county-level details for accounting treatment. After the fixed repayment date is completed, within 3 working days, the county-level student financial assistance management center will issue the settlement documents and the loan deduction summary table (Annex 9), and the county-level student financial assistance management center will timely reconcile and input the relevant principal and interest recovery information into the CDB management information system. The Provincial Student Financial Assistance Management Center is responsible for summarizing the loan deduction and collection, and submitting it to CDB Jiangsu Branch.
Article 19 About prepayment. Every year, 65438+ 10 month 15 and July 15 are fixed prepayment dates. Students who have not fully repaid in one lump sum must be repaid in 500 yuan as an integral multiple of the loan principal. The interest on the prepayment part is calculated according to the interest rate agreed in the contract and the actual service life, and no other fees are charged except the interest payable. Students who pay in full at one time should repay all the loan interest they should bear. Borrowing students (or * * * the same borrower) should apply to the county-level student financial assistance management center 30 days before the fixed prepayment date, and fill in the Application Form for Prepayment of Student Credit Loan of China Development Bank (attachment 10). After the county-level student financial assistance management center accepts it, it will review the advance payment, and at the same time, with the assistance of the agent bank, calculate the principal and interest of one-time repayment, and report it to the provincial student financial assistance management center for review. After the approval of CDB Jiangsu Branch, the county-level student financial assistance management center is responsible for summarizing and submitting the deduction notice and the deduction instruction stamped with the official seal to the agent bank five days before the fixed prepayment date. On the fixed prepayment date, the agent bank will complete the operation of withholding the principal and interest funds, transfer the principal and interest funds into the account opened by the Provincial Student Financial Assistance Management Center in CDB Jiangsu Branch, and provide county-level details for accounting treatment. After the fixed prepayment date is completed, the county-level student financial assistance management center shall issue the settlement documents and loan deduction summary table within 3 working days, and the county-level student financial assistance management center shall timely reconcile the accounts and input the relevant principal and interest recovery information into the CDB management information system. Each county-level student financial assistance management center shall prepare the prepayment summary table according to the loan deduction summary table and submit it to the provincial student financial assistance management center. At the same time, the provincial student financial assistance management center should do a good job of feedback from borrowers. After summary, it will be submitted to CDB Jiangsu Branch for accounting treatment after audit.
Article 20 The provincial student financial assistance management center shall guide and urge the county student financial assistance management center to urge the borrower to repay the principal and interest on schedule by means of SMS, telephone and registered letter one month before the principal and interest recovery. For those who cannot repay the principal and interest on time, the county-level student financial assistance management center shall be responsible for collecting the borrower within one year after the loan expires, once a month for the first three months and once a quarter for the last nine months, and keep all loan collection vouchers. At the same time, each county-level student financial assistance management center should complete the summary of deduction instructions for all overdue principal and interest accounts before 5 working days every month, and submit the Notice of Deduction and Summary of Deduction Instructions with official seal to the agent bank. On the sixth working day of each month, the agent bank will check the balance of the overdue principal and interest of the student account, and deduct it in time if there is any balance. On the same day, the agent bank is responsible for transferring overdue principal and interest into the account of CDB Jiangsu Branch of the Provincial Student Financial Assistance Management Center, providing county-level details at the same time, doing a good job in accounting treatment, and issuing settlement documents and loan deduction summary tables to the county-level student financial assistance management center within 3 working days after the principal and interest deduction operation is completed. The county-level student financial assistance management center should check the accounts in time and input the relevant principal and interest recovery information into the CDB management information system in time. The Provincial Student Financial Assistance Management Center summarizes the summary table of overdue loan principal and interest deduction, and submits it to CDB Jiangsu Branch for accounting treatment.
Article 21 Calculation of financial discount and risk compensation. The provincial student financial assistance management center should organize the county student financial assistance management center, with the assistance of the agent bank, do a good job in calculating and checking the discount interest and risk compensation, and complete the calculation of the discount interest and risk compensation that should be borne by the finance and universities at all levels before 1 10 every year, and prepare the Application Form for Financial Discount and Risk Compensation of Student Credit Loans of China Development Bank (attachment 165438+). Before165438+1October 2 1 every year, CDB Jiangsu Branch submits statements and materials about the discount amount to the Provincial Student Financial Assistance Management Center, which applies to the Provincial Department of Finance for receiving financial discount funds, and transfers the discount funds to CDB Jiangsu before the interest settlement date of 65438+February 2 1.
Chapter VII Post-loan Management
Article 22 System maintenance. The provincial student financial assistance management center shall coordinate the use of CDB management information system by all county-level student financial assistance management centers, and maintain the system in real time to ensure the accuracy of the data in the system. The agent bank generates monthly loan data and submits it to the county-level student financial assistance management center, which is responsible for reconciliation with the agent bank. If problems are found, they should be reported to the Provincial Student Financial Assistance Management Center and Jiangsu Branch. In case of adjustment of CDB management information system, all county-level student financial assistance management centers should cooperate.
Article 23 ledger management. Each county-level student financial assistance management center shall establish a student source credit student loan management ledger (attachment 12) according to the format requirements of CDB Jiangsu Branch, and maintain it regularly. When problems are found, they should be checked in time, and the provincial student financial assistance management center will summarize them on a monthly basis and submit them to CDB Jiangsu Branch. After the CDB management information system is launched, all county-level student financial assistance management centers can manage ledgers through the system.
Article 24 Contract modification. Contract changes mainly include account changes and repayment plan changes. CDB Jiangsu Branch authorized the Provincial Student Financial Assistance Management Center to organize all county-level student financial assistance management centers to make contract changes. The specific operation is as follows:
Account change refers to the loss of personal account card or other reasons, and the borrower needs to change the personal account number. Student loans do not allow borrowers to change banks. When the borrower (or * * * relationship with the borrower) changes his account, he/she shall go through the change formalities at the county-level student financial assistance management center with his/her ID card. The borrower (or * * * with the borrower) fills in the application for account change and signs it, and then submits it to the county-level student financial assistance management center. The county-level student financial assistance management center conducts on-site audit of borrowers (or * * * and borrowers) and account information. After approval, it will be modified in CDB management information system. The county-level student financial assistance management center shall promptly notify the agent bank of the updated borrower account information, and keep the relevant change application materials for future reference.
The change of repayment plan refers to the matters that students cannot repay according to the repayment plan agreed in the original contract because they are studying for a master's degree or dropping out of school, and need to adjust the repayment plan. In principle, the repayment plan can only be adjusted within the loan period agreed in the contract and cannot be extended. The repayment plan change process is the same as the account change process.
Article 25 Archives management. Student-origin loan credit files are divided into two categories according to different management departments: the first category is the file materials submitted by the county-level student financial assistance management center to CDB Jiangsu Branch, including but not limited to the original loan contract, contract receipt, roster of borrowing students, copies of ID cards of borrowing students and borrowers, receipts from universities, relevant vouchers formed in the process of loan issuance and disbursement, and relevant vouchers formed in the process of principal and interest recovery. The second category is the loan student credit files kept by the county-level student financial assistance management center. The provincial student financial assistance management centers shall require the county-level student financial assistance management centers to timely sort out and submit the files retained by CDB Jiangsu Branch, and at the same time properly preserve the self-retained archival materials, and complete the establishment, collection, sorting and filing of credit files according to the requirements of CDB Jiangsu Branch to ensure the authenticity and integrity of all kinds of files. The person in charge of the provincial student financial assistance management center and the county student financial assistance management center shall bear the responsibility of supervision, supervision and audit.
Article 26 asset quality classification and disposal of non-performing assets. Provincial Student Financial Assistance Management Center is responsible for coordinating student financial assistance management centers at all levels. According to the "Guiding Opinions on the Asset Quality of Student-origin Credit Student Loan of China Development Bank", the asset quality classification will be completed on the 20th day of each quarter, and the classification results will be reported to the provincial student aid center within 3 working days after the end of each quarter analysis. At the same time, all county-level student financial assistance management centers should do a good job in risk compensation, government sharing and write-off of non-performing assets. The county-level student financial assistance management center is responsible for submitting the information of loan students whose loan principal and interest are overdue for more than 3 months in the previous quarter to the provincial student financial assistance management center, which will summarize it and submit it to CDB Jiangsu Branch. CDB Jiangsu Branch is responsible for accounting the actual default amount of the current period as default loss on March 20th every year, and submitting it to the Provincial Student Financial Assistance Management Center for confirmation. After confirmation by the Provincial Student Financial Assistance Management Center, CDB Jiangsu Branch will allocate funds from the risk compensation fund to make up for the losses. The excess is shared by CDB Jiangsu Branch and county-level finance according to the ratio of 1: 1. After the default principal and interest are compensated in the above way, the principal and interest of the borrowing students will continue to be collected by the county-level student financial assistance management center. The recovered funds are first used to make up for the uncompensated loan losses, and the rest are used to return the government-shared funds, supplement risk compensation and reward the county-level student financial assistance management center. CDB Jiangsu Branch is responsible for establishing a risk compensation management ledger to record the collection and use of risk compensation. For student loans that cannot be recovered after taking all possible measures such as risk compensation and government sharing losses and performing necessary procedures, CDB Jiangsu Branch will write off bad debts in accordance with the current regulations of the Ministry of Finance and the Development Bank.
Article 27 Risk monitoring. CDB Jiangsu Branch is responsible for monitoring the default rate of credit student loans in various districts and counties, the default rate in the current year and other important indicators, and taking corresponding measures to manage according to the degree of risk. The losses exceeding the risk compensation shall be shared by the county-level financial department in proportion.

Article 28 Post-loan monitoring. The provincial student financial assistance management center is responsible for coordinating the county-level student financial assistance management center to do a good job in post-loan monitoring, including but not limited to the following:
Provincial Student Financial Assistance Management Center cooperates with CDB Jiangsu Branch to guide, coordinate and supervise the county-level student financial assistance management center, which is responsible for establishing contact system with the families of loan students. With the assistance of township governments (street offices) and village committees (neighborhood committees), middle schools and settlement agencies, county-level student financial assistance management centers mainly manage loans through student families. Regular (at least once a year) contact and communication with students and their families, understand the borrower's education, employment, economic income, etc., form an interview record and be signed by the interviewee for the record. The county-level student financial assistance management center should be responsible for keeping in touch with universities, students and employment units through the education department and the labor and personnel department, and urging students to repay on schedule. The borrower should study and deal with the situation that affects its solvency, and report to CDB Jiangsu Branch. The provincial student financial assistance management center is responsible for regularly summarizing the credit, schooling, work, family situation and other information provided by the county-level student financial assistance management center, and feeding it back to CDB Jiangsu Branch in time. For students who have obviously violated the loan contract, they should apply to CDB Jiangsu Branch in time to stop issuing loans, cancel their qualification to continue applying for loans, and recover the loans in advance.
CDB Jiangsu Branch has the right to take disciplinary measures against obvious breach of contract, such as dishonesty, failure to repay loans on time or malicious default of loans, including publishing the list of students in breach of contract in newspapers and related websites, informing the employment units of students in breach of contract, loading it into the personal credit information system of the People's Bank of China, and loading it into the national academic inquiry system of graduates from places of origin.
Chapter VII Financial Discount and Risk Compensation
Twenty-ninth students credit student loans during the school loan interest by the financial full subsidy. Jiangsu students studying in universities affiliated to the central ministries and commissions and ordinary universities outside the province shall be borne by the central finance, and those studying in ordinary universities in the province shall be borne by the provincial finance.
Thirtieth students credit student loan risk compensation special funds in accordance with the loan amount of 05% one-time establishment. Jiangsu students studying in universities affiliated to the central ministries and commissions and ordinary universities outside the province shall bear the loan risk compensation funds by the central finance; Those who study in colleges and universities in the province shall be borne by the central government and our province, the part borne by our province shall be borne by relevant colleges and universities 1 percentage point, and the rest shall be borne by the provincial finance.
Thirty-first financial discount funds and special funds for risk compensation shall be fully allocated by the provincial finance before February 20 each year.
Thirty-second student loan risk compensation by the National Development Bank to implement special account management, mainly used to prevent and make up for the loss of student loans. If the risk compensation exceeds the loan loss of the students' origin, the National Development Bank will reward the student financial assistance management centers in some counties (cities, districts); If the loan loss is lower than that of the students' origin, the insufficient part shall be borne by the Jiangsu Branch of China Development Bank and the county-level financial department, 50% respectively.
Chapter VII Other Matters
Article 33 These Measures shall be implemented as of the date of promulgation.
Article 34 These Measures shall be interpreted by the Provincial Department of Education, the Provincial Department of Finance and CDB Jiangsu Branch.
