Principle of ownership of fruits
The principle of fruits attribution: mainly depends on the agreement between the parties. If there is an agreement, the legal fruits shall be obtained in accordance with the trading habits, and the natural fruits shall be obtained by the owner or usufructuary right holder. Fruits refer to things or interests derived from original things, in other words, material interests obtained by civil subjects through legal channels, including natural fruits and legal fruits.

Second, the difference between fruit and interest.

Legal basis: Article 32 1 of People's Republic of China (PRC) Civil Code, natural fruits are obtained by the owner; If there is both the owner and the usufructuary right holder, it shall be obtained by the usufructuary right holder. Unless otherwise agreed by the parties, such agreement shall prevail. Legal fruits, if agreed by the parties, shall be obtained in accordance with the agreement; If there is no agreement or the agreement is unclear, it shall be obtained in accordance with the trading habits.
