In order to implement the Opinions of the State Council on Promoting the Healthy Development of Coal Industry (Guo Fa [2005] 18), strictly control the entry of the industry, change the development mode, promote the optimization and upgrading of industrial structure, improve productivity, ensure safe production, improve the utilization rate of resources, strengthen environmental protection and promote the healthy development of coal industry, the National Development and Reform Commission has formulated coal industry policies in combination with relevant laws and regulations.

Coal industry policy

Coal is the main energy and important industrial raw material in China. Coal industry is an important basic industry in China, and its sustainable development is related to the healthy development of national economy and national energy security. In order to fully implement Scientific Outlook on Development, rationally and orderly develop coal resources, improve resource utilization rate and productivity level, and promote the healthy development of coal industry, according to People's Republic of China (PRC) Coal Law, People's Republic of China (PRC) Mineral Resources Law and the State Council's Opinions on Promoting the Healthy Development of Coal Industry (Guo Fa [2005] 18) and other laws and normative documents.

Chapter I Development Goals

Article 1 Insist on relying on scientific and technological progress and take the road of sustainable development of coal industry with high resource utilization rate, good safety guarantee, good economic benefit and less environmental pollution, so as to provide energy guarantee for building a well-off society in an all-round way.

Article 2 Deepen the reform of the paid use system of coal resources, speed up the integration of coal resources, and form a coal resources development and utilization system with rational development, enhanced conservation and recycling, safe production, environmental friendliness and coordinated development.

Article 3 Strict industrial access, standardize the development order, improve the exit mechanism, and form an industrial layout with large coal bases as the main body, adapting to external conditions such as environment and transportation, and coordinating with regional economic development.

Article 4 Deepen the reform of coal enterprises, promote the joint-stock reform and merger and reorganization of coal enterprises, improve industrial concentration, and form an industrial organization pattern with large coal enterprise groups as the main body and coordinated development of small and medium-sized coal mines.

Fifth to promote the construction of coal technology innovation system, establish and improve the market-oriented, enterprise-oriented, Industry-University-Research-based coal technology innovation mechanism, and form a number of major key technologies with independent intellectual property rights. Cultivate the science and technology market, develop service institutions, and form a perfect service system for technological innovation.

Article 6 Strengthen government supervision, implement the main responsibility of enterprises, rely on scientific and technological progress, focus on the prevention and control of disasters such as gas, water, fire, coal dust, roof and mine pressure, and improve the long-term mechanism of coal mine safety production investment and management.

Article 7 Strengthen the comprehensive utilization of coal resources, promote clean production, develop circular economy, establish compensation mechanism for ecological environment restoration in mining areas, build resource-saving and environment-friendly mining areas, and promote the harmonious development of people and land.

Article 8 Promote market-oriented reform, improve the price formation mechanism of coal market, strengthen the connection between coal production, transportation and demand, promote the total balance, and form a modern coal market system with sound mechanism, unified opening and orderly competition.

Chapter II Bureau of Industrial Layout

Article 9 According to the overall deployment of the national economic and social development plan, the development plan of coal industry, mineral resources, coal production, coal mine safety production and overall planning of mining areas, coal resources shall be developed and utilized in a reasonable and orderly manner.

Tenth stabilize the scale of coal production in the eastern region, strengthen the construction of large coal bases in the central coal-rich areas, and accelerate the exploration and moderate development of coal resources in the western region. We will build thirteen coal bases in Shendong, Jinbei, Jinzhong, Jin Dong, Shanbei, Huanglong (Huating), Luxi, Huaibei, Henan, Yunnan-Guizhou, Mengdong (Northeast) and Ningdong, so as to improve the continuous and stable supply capacity of coal.

Eleventh vigorously promote the coordinated development of coal, coalbed methane and other resources and the efficient use of infrastructure. Large coal bases, in principle, a mining area is developed by one subject, and one subject can develop multiple mining areas. According to the conditions of resource endowment, transportation, water resources and environmental carrying capacity, determine the scale and intensity of regional coal development, and give priority to the construction of large-scale and super-large modern coal mines in large-scale comprehensive coalfields and resource-rich areas.

Twelfth to encourage the construction of Kengkou power station, give priority to the development of coal-electricity integration projects, give priority to the development of circular economy and comprehensive utilization of resources. Newly built large and medium-sized coal mines should support the construction of coal preparation plants of corresponding scale, and encourage the construction of coal preparation plants of the Group in centralized mining areas of small and medium-sized coal mines.

Thirteenth in areas rich in water resources and coal resources, moderately develop coal chemical industry, restrict the development of coal chemical industry in coal transit areas and water-poor areas, and prohibit the development of coal chemical industry in areas with insufficient environmental capacity. The state implements protective development of special and scarce coal types and restricts the development of high sulfur and high ash coal resources.

Chapter III Industry Access

Article 14 To start a coal mine or engage in the exploration of coal and coalbed methane resources, and engage in the design, construction, supervision and safety evaluation of coal mine construction projects, one should have corresponding qualifications and meet other conditions stipulated by laws and regulations. The recovery rate of coal resources must meet the national standards, and the safety, production equipment and environmental protection measures must comply with the provisions of laws and regulations.

Fifteenth Shanxi, Inner Mongolia, Shaanxi and other provinces (regions) to build, rebuild and expand the mine scale of not less than 6.5438+0.2 million tons/year. Chongqing, Sichuan, Guizhou, Yunnan and other provinces (cities) to build, rebuild and expand the mine scale of not less than 6.5438+0.5 million tons/year. Fujian, Jiangxi, Hubei, Hunan, Guangxi and other provinces (regions) to build, rebuild and expand the mine scale of not less than 90 thousand tons/year. The scale of newly built, renovated and expanded mines in other areas is not less than 300,000 tons/year. In view of the large number of small coal mines, unreasonable layout, the situation of destroying resources and environment has not been fundamentally improved, and the situation of safe production in coal mines is still grim. During the "Eleventh Five-Year Plan" period, all new coal mine projects with a capacity of less than 300,000 tons/year will be stopped.

Article 16 Coal mining enterprises shall be equipped with geological and mineral professionals in accordance with state regulations, and special operators must obtain corresponding qualifications in accordance with relevant state regulations. Encourage coal mining enterprises to recruit workers from technical schools.

Chapter IV Trade Organizations

Article 17 Illegal coal mines shall be banned, and coal mines with unreasonable layout, non-compliance with industrial policies, no conditions for safe production, indiscriminate mining and excavation, destruction of resources, environmental pollution and serious soil erosion shall be closed.

Eighteenth to encourage the existing large coal enterprises as the core, to break the boundaries of regions, industries and ownership, to link resources and assets, and to develop large coal enterprise groups through strong alliance, merger and reorganization of small and medium-sized coal mines. Encourage the development of large enterprise groups with international competitiveness integrating coal, electricity, railways and ports. Encourage large coal enterprises to participate in joint ventures in metallurgy, chemical industry, building materials and transportation enterprises. Encourage small and medium-sized coal mines to integrate resources, jointly transform and implement intensive management.

Article 19 Coal enterprises are encouraged to further improve the corporate governance structure, actively promote the shareholding system reform, change the operating mechanism and improve the management level in accordance with the requirements of the modern enterprise system.

Twentieth actively guide the economic transformation of resource-exhausted mining areas and support the development of state-owned coal mines with resource depletion and serious losses. Establish the exit mechanism of small and medium-sized coal production enterprises. Encourage and support resource-exhausted coal mines to give full play to their talent, technology and management advantages and develop coal resources in different places.

Chapter V Industrial Technology

Twenty-first to encourage the development of geophysical exploration and high-precision three-dimensional seismic exploration technology. Encourage the development of deep well and thick alluvium drilling method, freezing method and rapid well completion technology.

Twenty-second encourage the use of high-tech and advanced applicable technologies to build high-yield and efficient mines. Encourage the development of open-pit mining technology. Encourage the development of comprehensive mechanized coal mining technology and promote wall coal mining. Develop complete sets of technologies for small coal mines, as well as coal mining technologies to improve resource recovery rate, such as mechanization of thin coal seam mining, underground filling, "three under" mining and corner coal recovery. Study on top coal caving technology for encouraging horizontal sublevel fully mechanized mining in steep and extra-thick coal seam. Encourage the construction of demonstration projects such as underground gasification of low-grade refractory mining.

Twenty-third to speed up the reform of coal mining technology and support methods in small coal mines, promote bolt support and metal support in coal mining faces, and eliminate wood support. Accelerate the development of safe and efficient underground auxiliary transportation technology and fully mechanized mining equipment relocation technology and equipment.

Twenty-fourth development of automatic control, centralized control of coal preparation technology and equipment. Develop efficient dry coal preparation technology, water-saving coal preparation technology, large-scale screening equipment and desulfurization technology to recover sulfur resources. Encourage the development and application of coal water slurry technology.

Twenty-fifth encourage coal enterprises to implement technological transformation for the purpose of industrial upgrading. Encourage research and development, integration and independent production of key technologies and major equipment such as coal exploration, mining, washing, processing and transformation through various means.

Twenty-sixth to promote the information construction of coal enterprises, the use of modern control technology, mine communication technology, to achieve automation and digitization of the production process. Promote the construction of coal mine safety production monitoring system, coal production monitoring system and underground personnel positioning management system.

Chapter VI Safety and Safe Production

Twenty-seventh adhere to the safety policy of safety first, prevention first and comprehensive management, and implement the main responsibility of enterprise safety production and the responsibility of legal representative as the first person responsible for safety production. Coal enterprises should strictly abide by laws and regulations and relevant national standards or industry standards, strengthen on-site management, and strictly prohibit super-capacity, super-strength and over-quota organization of production to curb accidents. Coal production enterprises that have not obtained safety production licenses shall not engage in coal production activities.

Article 28 Establish and improve mine ventilation, gas prevention, outburst prevention, fire prevention, dust prevention, waterproof and flood control systems. Adhere to the coal mine gas control policy of pumping first and then mining, monitoring and controlling, and determining production by wind, and implement regional outburst prevention measures such as giving priority to mining protective layer and pre-pumping coal seam gas to improve gas drainage rate. Adhere to the principle of coal mine water disaster prevention and control, such as forecasting, doubtful exploration, exploration before excavation, treatment before mining, and implement comprehensive control measures such as prevention, blocking, drainage, drainage and interception. Strengthen the monitoring and control of coal mine rockburst and the prevention of roof accidents.

Twenty-ninth establish and improve the investigation, management and reporting system of major accidents in coal mines. Establish and improve the disaster prevention and emergency rescue system. Adhere to the system that the person in charge of the coal mine and the production, operation and management personnel take the class to go down the well.

Thirtieth strict implementation of coal mine construction project safety facilities and the main project "three simultaneous" system. All aspects of coal production must be equipped with necessary safety and health protection facilities, and obvious safety warning signs must be set up in production and business premises and related facilities and equipment with large risk factors. It is forbidden to use processes and equipment that do not meet safety standards. Implement a safety sign management system for underground coal mines and related equipment and equipment.

Chapter VII Trade and Transportation

Thirty-first strict qualification examination of coal trading enterprises, promote the optimization of the structure of coal trading enterprises, and form a coordinated development pattern with coal production enterprises and large coal trading enterprises as the main body and small and medium-sized coal trading enterprises as the supplement.

Thirty-second actively promote the market-oriented reform of coal trade, establish and improve the coal trading market system, improve the formation mechanism of coal price market, and formulate fair trading rules. Establish national and regional coal trading centers and information publishing platforms, encourage coal supply and demand sides to establish long-term cooperative relations, and guide rational production, orderly transportation and balanced consumption. We will steadily develop international coal trade, optimize the structure of coal import and export, and encourage enterprises to invest overseas to run mines.

Thirty-third actively develop railway and waterway coal transportation, speed up the construction and transformation of coal export channels in western Shanxi, Shaanxi and Inner Mongolia, and improve the coal transportation capacity. Limit the long-distance transportation of low calorific value coal and high ash coal. Dust prevention and leakage prevention measures should be taken in coal transportation.

Chapter VIII About Utilization and Environmental Protection

Article 34 Implement the development strategy of giving priority to economy, speed up the comprehensive utilization of resources, reduce the energy consumption in the process of coal processing and utilization, and improve the recovery rate and utilization efficiency of coal resources.

Thirty-fifth to strengthen energy conservation and energy efficiency management, establish and improve the coal industry energy management, evaluation, energy conservation and emission reduction and cleaner production reward and punishment system. Encourage coal enterprises to develop advanced and applicable energy-saving technologies. New construction, reconstruction and expansion projects of coal enterprises must be carried out in accordance with energy-saving design specifications and energy-using standards. Eliminate backward energy-consuming processes, equipment and products, and promote and use certified energy-saving products that meet national energy efficiency standards.

Article 36 The associated resources of coal and coal mine wastes shall be comprehensively developed and utilized in accordance with the principles of reduction, reuse and resource utilization. Encourage enterprises to use coal gangue and low calorific value coal to generate electricity and heat, use coal gangue to produce building materials products, fill underground, reclaim land to build roads, comprehensively utilize mine water and develop circular economy. Support the construction of long-distance coalbed methane (coal mine gas) pipelines and encourage the production of coalbed methane (coal mine gas) for civil use, power generation and chemical products.

Article 37 The development and utilization of coal resources must carry out environmental impact assessment according to law, and strictly implement the "three simultaneities" system of environmental protection facilities and main project construction. In accordance with the principle of "who develops, protects, destroys, restores, pollutes, governs and benefits", comprehensive environmental management in mining areas will be promoted, and a compensation mechanism for soil and water conservation, land reclamation and ecological environment restoration in mining areas will be formed in synchronization with production.

Article 38 Pollutants produced in the process of coal mining, storage, loading and unloading must be discharged up to standard to prevent secondary pollution. Strengthen coal mine gas drainage and utilization to reduce emissions. Coal washing water should realize closed circulation. Optimize roadway layout and reduce underground gangue output.

Article 39 Establish an evaluation system and an evaluation index system for the development environmental carrying capacity of mining areas. Strict implementation of coal mine environmental impact assessment, soil and water conservation, land reclamation and sewage charging system. Coal mining is restricted in areas prone to geological disasters, important groundwater recharge areas and fragile ecological environment, and coal mining is prohibited in prohibited areas such as nature reserves, important water source protection areas and geological disaster danger areas. Strengthen the comprehensive management of abandoned mines.

Fortieth strengthen the investigation, monitoring, prediction and early warning of disasters that may be induced in the process of mine development, and take effective prevention measures in time. Establish an information network system and formulate disaster prevention and mitigation plans.

Chapter IX Labor Protection

Forty-first coal production enterprises should participate in the social overall planning of industrial injury insurance, and establish and improve the industrial injury insurance system that combines industrial injury prevention, industrial injury compensation and industrial injury rehabilitation. Implement the subsidy system for hard jobs in coal mines and gradually improve the income level of coal mine workers.

Forty-second to strengthen the management of labor and personnel, the implementation of underground four classes of six-hour work system. Promote the standardization of mine quality and improve the underground working environment. Equip underground workers with labor protection articles that meet national standards or industry standards.

Forty-third encourage coal production enterprises to increase investment in safety and prevention and treatment of occupational diseases such as pneumoconiosis. Develop and popularize the research and application of occupational disease prevention, occupational safety and labor protection technology. Establish and improve the occupational health management and occupational disease hazard control system.

Chapter 10 Obstacle Protection Measures

Article 44 Improve the tax and fee policies that are conducive to improving the safety production level of coal mines and the utilization rate of coal resources and promoting the healthy development of the coal industry, and improve the preferential tax policies for resource exploration, development and comprehensive utilization. A strict supervision system for the utilization of coal resources is implemented, and the recovery rate of coal resources is subject to annual verification and dynamic supervision. Those who fail to meet the standards prescribed by the state shall be punished in accordance with relevant laws and regulations.

Forty-fifth coal resources development adhere to the principle of planning first and then developing. The state manages the first-class exploration right market of coal resources in a unified way, and the state invests to complete the coal prospecting, general survey and necessary detailed investigation of coal resources, formulate the overall development plan and mining right setting scheme of mining areas, and transfer the second-class exploration right and mining right to enterprises in a planned way, thus forming a virtuous circle mechanism of investment in coal resources exploration. The Central Geological Exploration Fund (working capital) mainly supports the exploration of coal resources in key metallogenic areas (belts) determined by the state.

Forty-sixth support coal enterprises to establish technology development centers and enhance the ability of independent innovation. Coal mining enterprises can extract a certain proportion of funds from the sales revenue of coal products for technological innovation and technological transformation. We will promote the full cost reform of coal production, and strictly implement the system of coal mine maintenance fee, coal production safety fee extraction and use, and safety risk of mortgage. In accordance with the principle of enterprise ownership, earmarking, special account storage and government supervision, coal mining enterprises should withdraw the deposit for environmental governance and restoration as required. Encourage social funds to invest in environmental management in mining areas.

Article 47 Implement the knowledge updating project for professional and technical personnel in the coal industry, strengthen the national coal mine professionals' continuing education, training base construction and professional personnel training, implement the training project for skilled talents in the coal industry, and improve the counterpart single-recruit and order-based training. Standardize the management of professional qualifications of coal mine employees, and encourage enterprises to carry out all-round and multi-level safety technology education and training for employees.

Forty-eighth support coal enterprises to separate social functions and accelerate the separation of main and auxiliary. Support coal mining enterprises to extract funds for the development of coal mine conversion, which are earmarked for the development of continuous industries and alternative industries.

Article 49 For construction projects that do not conform to the planning and industrial development direction, the land and resources department will not handle the registration of mining rights and land use procedures, the environmental protection department will not approve environmental impact assessment documents and issue pollution discharge permits, the water conservancy department will not approve soil and water conservation plan documents, the administrative department for industry and commerce will not handle industrial and commercial registration, financial institutions will not provide credit support in the form of loans, and the investment department will not handle the examination and approval procedures.

Fiftieth play the role of intermediary organizations. The coal industry association shall establish and improve the regular information release system and industry early warning system of coal market supply and demand, technical and economic indicators, timely reflect the industry trends and put forward policy suggestions, strengthen industry self-discipline and guide the development of enterprises.

The National Development and Reform Commission is responsible for the interpretation of this policy. The relevant administrative departments of the coal industry may formulate relevant technical standards and norms according to this policy.

This policy shall be implemented as of the date of promulgation.
