The ownership of the house is based on whether the parties enjoy the rights. If it is purchased jointly by husband and wife, it belongs to both husband and wife. Whether the bank still collects liquidated damages after repaying the mortgage in advance depends on the loan contract. If there is liquidated damages in the contract, it shall be paid.

The basic conditions for commercial housing mortgage loans are as follows:

1, the borrower has a stable occupation and income, good credit and the ability to repay the principal and interest of the loan;

2. The purchased house is located in a town (including urban area, county town and big market town) and in principle is the borrower's current residence or place of work and business operation;

3. Has signed a commercial housing sales contract with the developer, and paid the down payment ratio stipulated by the bank according to the personal credit situation, with a minimum of more than 30%;

4. The loan amount is determined according to the borrower's credit status, occupation, education level, repayment ability and the liquidity of the purchased house.

5. Agree to go through the mortgage registration of pre-purchased commercial housing first, and promise to use the purchased house as the loan mortgage, and go through the mortgage registration formalities again after the purchased house is completed and the immovable property certificate is obtained.

The information required for mortgage is as follows:

To sum up, no matter who has paid off the mortgage, he has no right to get the mortgage. If the property is purchased after marriage, it belongs to the joint property of both husband and wife, regardless of who repays the mortgage, because the money used to repay the mortgage during marriage also belongs to the joint property of husband and wife. In other words, determining whether the property belongs to the joint property and personal property of husband and wife cannot be determined by repayment.

The following property acquired by husband and wife during the marriage relationship is the joint property of husband and wife, which is jointly owned by husband and wife:

The following property is the personal property of one of the spouses:
