Opinions on implementing unemployment insurance to support enterprises to stabilize their posts
I. Policy scope
Since 20 14, in the process of adjusting and optimizing the industrial structure, the unemployment insurance fund has given stable post subsidies (hereinafter referred to as "stable post subsidies") to enterprises that take measures such as skill training, job transfer and salary negotiation to stabilize the workforce and ensure that they do not lay off employees or reduce staff. The subsidy policy is mainly applicable to the following enterprises:
(1) Implementing enterprise merger and reorganization. It refers to the transaction that changes the legal structure or economic structure significantly outside the daily business activities and transfers the business control right of the enterprise according to the Opinions of the State Council on Promoting Enterprise Merger and Reorganization (Guo Fa [2010] No.27), including the implementation of economic behaviors such as merger, acquisition, merger, division and debt restructuring.
(2) Resolving enterprises with serious overcapacity. Refers to the overcapacity enterprises that have been resolved according to the Guiding Opinions of the State Council on Resolving the Serious Overcapacity Contradiction (Guo Fa [2013] No.41) and the Implementation Opinions of the Provincial Government on Resolving the Serious Overcapacity Contradiction (Shaanxi [2014] No.9).
(3) Eliminate enterprises with backward production capacity. Refers to the enterprises that eliminate backward production capacity according to the State Council's Notice on Further Strengthening the Work of Eliminating Backward Production Capacity (Guo Fa [2065438+00] No.7) and Shaanxi Provincial Leading Group Office's Notice on Printing and Distributing the Work Plan for Eliminating Backward Production Capacity in our province (Shaanxi Tao Ban Fa [2065438+03] No.3).
(4) Small and medium-sized enterprises. Refers to the enterprises classified by Ministry of Industry and Information Technology, National Bureau of Statistics, National Development and Reform Commission and Ministry of Finance (Ministry of Industry and Information Technology Lianqi [201] No.300).
(five) other industries and enterprises approved by the State Council and the provincial government.
Second, the basic conditions
(a) the implementation of post stability subsidies in the unemployment insurance co-ordination areas shall meet the following conditions: the accumulated balance of unemployment insurance funds in the previous year has the ability to pay for more than one year; Regulations on the administration of the use of unemployment insurance funds.
(2) An enterprise applying for occupational security subsidies shall meet the following conditions: its production and business activities conform to the industrial structure adjustment policies and environmental protection policies of the state and the region; Participate in unemployment insurance according to law and pay unemployment insurance premiums in full; No layoffs or layoffs in the previous year were lower than the registered unemployment rate in urban areas as a whole; The enterprise has a sound financial system and standardized management and operation.
Third, the use of funds.
For enterprises that meet the scope and basic conditions of the policy of stabilizing posts in the overall planning area, the subsidy for stabilizing posts can be given every year at a rate not exceeding 50% of the total amount of unemployment insurance premiums actually paid by enterprises and their employees in the previous year, and the required funds will be charged from the unemployment insurance fund. Job-stabilizing subsidies are mainly used for employees' living allowances, payment of social insurance premiums, job-transfer training, skills upgrading training and other related project expenditures. Enterprises can only apply for enjoyment once in the same year. In line with the unemployment control policy, it is still implemented according to the Notice on the Implementation Plan of Unemployment Control in Shaanxi Province (Shaanxi Zhengban made [2005] No.31) and the Notice on Further Improving Unemployment Control (Shaanxi People's Social Development [2011] No.94), which is also in line with employment security and

IV. Audit Procedures
The method of annual one-time declaration, review by relevant departments and annual appropriation is adopted to stabilize the post subsidy. 20 14 eligible applicants can apply together before the end of July 20 15. Thereafter, the application shall be submitted before the end of June each year.
1, the enterprise fills in the Examination Form of Shaanxi Province Unemployment Insurance Subsidies for Stabilizing Posts, and submits an application to the Development and Reform Commission, industry and information technology and other competent departments with the annual payment of unemployment insurance premiums, the list of employees, measures and plans for stabilizing posts and other related documents. If the application meets the policy scope and basic conditions after examination by the competent department, it shall report to the unemployment insurance agency where the enterprise is located.
2, the unemployment insurance agency according to the basic conditions of the enterprise, the enterprise's insurance payment, layoffs and measures to stabilize jobs, etc ... Audit, put forward preliminary opinions on subsidies and report them to the people's social department, which will examine and approve subsidy funds together with the financial department, determine the list of subsidized enterprises and the amount of subsidies, and publicize relevant information in the people's social department and enterprise portal websites to accept social supervision. The publicity time is not less than 5 working days.
3, publicity without objection, the financial sector according to determine the list of enterprises and the amount of subsidies in a timely manner to the unemployment insurance agencies to allocate subsidy funds, unemployment insurance agencies will be included in the enterprise account, as "other expenses-stable job subsidies" expenditure. Social security subsidies are paid first and then supplemented. After the normal payment, the enterprise will directly transfer the post security subsidy to the enterprise account.

Municipalities should attach great importance to it, strengthen organizational leadership, and clarify the division of responsibilities. Development and Reform Commission, industry and information technology departments are responsible for reviewing enterprise qualifications such as enterprise types, industrial structure adjustment, business management norms, and environmental protection policy implementation; The human and social departments are responsible for taking the lead, coordinating, supervising and inspecting the implementation of policies, reviewing the layoffs and insurance contributions of enterprises, and putting forward subsidy audit opinions; The financial department is responsible for reviewing the allocation of subsidy funds and supervising the use of subsidy funds. All departments should cooperate closely, carry out their duties, do a good job in unemployment insurance, and support enterprises to stabilize their posts.
(2) Strengthen fund management. Municipalities should, in accordance with the principle of "focusing on key points, controlling the total amount, strictly grasping and dynamically supervising", incorporate the post-stabilization subsidy into the budget management of the unemployment insurance fund, rationally formulate the use plan, strengthen supervision, track the effectiveness, simplify procedures, standardize procedures and ensure the safety of the fund. For enterprises that resort to fraud, interception and misappropriation. , cancel its subsidy qualification, recover the allocated subsidy funds, and punish the enterprise and relevant responsible persons according to relevant regulations; If the case constitutes a crime, legal responsibility shall be investigated according to law.
(3) Strengthen tracking and monitoring. Municipalities should include enterprises enjoying occupational security subsidies into the scope of dynamic monitoring of unemployment, keep abreast of job changes and the stability of the workforce, regularly analyze the effects of occupational security subsidies, and report the implementation of subsidy funds in a timely manner. Finance at all levels should provide necessary funds for the dynamic monitoring of unemployment within their respective jurisdictions. For cities (districts) with weak financial guarantee ability and difficult to implement the policy of stabilizing posts, if it is really necessary to adjust at the provincial level, they shall apply for adjustment in accordance with the current measures for the management and use of provincial adjustment funds.
(4) Do a good job of statistical reporting. Municipal human resources and social security departments should conscientiously do a good job in data statistics of subsidized enterprises, timely analyze and summarize the implementation of policies, and submit a summary of the use of unemployment insurance subsidy funds to the Provincial Department of Human Resources and Social Security before the end of September each year.
Municipalities should formulate specific measures for the implementation of unemployment insurance subsidies in the region, and report them to the Provincial Department of Human Resources and Social Security and the Department of Finance for the record.
