2. Including basic farmland and other land exceeding 35 hectares.

3. The expropriation of land other than that specified in the preceding paragraph shall be approved by the people's governments of provinces, autonomous regions and municipalities directly under the Central Government and reported to the State Council for the record.

4. if agricultural land is expropriated, the approval for conversion of agricultural land shall be handled in advance in accordance with the provisions of article 44 of this law.
