Legal analysis: Mortgaged houses can be enforced. Although the law stipulates that if the mortgagor does not have a second residence, it can only be sealed up and cannot be enforced, in reality, the second residence certificate will be provided when mortgaging. Article 1 The people's court may seal up the houses mortgaged according to law owned by the person subjected to execution, and may auction, sell off or pay off debts according to law upon the application of the mortgagee.

Article 2 After the people's court makes an order to auction, sell off or pay off the house legally mortgaged by the person subjected to execution and his dependents, it shall give the person subjected to execution a grace period of six months. During this period, the person subjected to execution shall vacate the house voluntarily, and the people's court shall not force the person subjected to execution and his dependents to move out of the house.
