According to the criminal law:
Article 272 Crime of misappropriating funds; Crime of misappropriating public funds: any employee of a company, enterprise or other unit who, by taking advantage of his position, misappropriates the funds of his own unit for personal use or lends them to others, and the amount is relatively large, and has not been paid back for more than three months, or although it has not been more than three months, the amount is relatively large, and he is engaged in profit-making activities or illegal activities, he shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention; Whoever misappropriates the funds of his own unit in a huge amount, or fails to return the funds in a large amount, shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years.
Personnel engaged in public service in state-owned companies, enterprises or other state-owned units and personnel appointed by state-owned companies, enterprises or other state-owned units to engage in public service in non-state-owned companies, enterprises or other units shall be convicted and punished in accordance with the provisions of Article 384 of this Law.
Article 273 Crime of misappropriating specific funds and materials. If a crime misappropriates funds and materials for disaster relief, emergency rescue, flood control, special care, poverty alleviation, immigration and relief, and the circumstances are serious, resulting in great damage to the interests of the state and the people, the person directly responsible shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention; If the circumstances are especially serious, they shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years.
If it fails to meet the standards of crime, it also violates the Constitution:
Article 13 The lawful private property of citizens is inviolable.
In this case, the money of the brigade belongs to all the villagers collectively and is the private property of a specific group (in this case, all the villagers) in the legal sense. Before obtaining the consent of all villagers or villagers' representatives, no individual has the right to dispose of it alone. It is legal if it is approved by the deputies or villagers' assembly. If the village chief's behavior violates the criminal law, he should be punished by law.
In view of the special circumstances of this case, if no interest is charged to help the poor, and the amount is not up to the criminal standard, it is suggested that the villagers inform the discussion, and urge them to return the misappropriated funds if the amount is large but the time is less than three months; Villagers and villagers' representatives can discuss concrete and feasible supervision plans for the use of funds, or write the assistance and relief plan for villagers in difficulty into village rules and regulations, or jointly lend money to help villagers in difficulty. It can not only supervise the use of collective funds, but also help villagers tide over difficulties, realize village-level democratic autonomy and build a harmonious society.
