As long as the motor vehicle meets the scrapping standards stipulated by China laws, if the car loan is not paid off, the vehicle can be scrapped. Owners who meet the mandatory scrapping standards shall sell their motor vehicles to scrapped motor vehicle recycling and dismantling enterprises. Scrap motor vehicle recycling and dismantling enterprises shall register, dismantle and destroy according to law, and submit the registration certificate, license plate and driving license of scrapped motor vehicles to the traffic management department of the public security organ for cancellation. Scrap the car, but pay back the money. The debtor shall repay the debt in time. If the debtor fails to repay the debt on time, the creditor may sue the people's court in the place where it is executed for recovery; If a person refuses to pay back, the people's court has the right to enforce it according to law, and seal up, freeze, transfer or change the price of the property of the person subjected to execution according to different circumstances. If the people's court finds out that the debtor is really incapable of execution, it shall make an order to suspend execution and resume execution after the suspension disappears. If the other party refuses to execute the judgment or ruling if the circumstances are serious, it may be suspected of refusing to execute the judgment or ruling and bear criminal responsibility. "Regulations on Motor Vehicle Registration" Article 37 If a motor vehicle is under any of the following circumstances, the owner of the motor vehicle shall apply to the vehicle management office for cancellation of registration:

(1) The motor vehicle meets the national compulsory scrapping standards;

(two) the motor vehicle does not meet the national compulsory retirement standards, and the owner of the motor vehicle voluntarily retires;

(3) Motor vehicle losses caused by natural disasters, fires, traffic accidents, etc. ;

(four) the motor vehicle is not used in China for some reason;

(5) Due to quality problems.

Under the circumstances specified in items (4) and (5) of the first paragraph, the owner of a motor vehicle shall deal with the road traffic safety violations and traffic accidents involving the vehicle before applying for cancellation of registration.

If the export of second-hand cars conforms to the provisions of Item 4 of Paragraph 1, the second-hand car export enterprise shall apply for cancellation of registration within two months after the motor vehicle goes through the customs formalities. Article 4 of the Standard Provisions on Compulsory Scrapping of Motor Vehicles shall be forcibly scrapped under any of the following circumstances, and the owner of the motor vehicle shall sell the motor vehicle to the scrapped motor vehicle recycling and dismantling enterprise. By the scrapped motor vehicle recycling and dismantling enterprises in accordance with the provisions of the registration, dismantling, destruction and other processing, and the scrapped motor vehicle registration certificate, license plate, driving license to the traffic management department of the public security organ for cancellation:

(1) Having reached the service life specified in Article 5 of these Provisions;

(two) after repair and adjustment, it still does not meet the relevant requirements of the national standards for motor vehicle safety technology in use;

(three) after the repair and adjustment or the use of control technology, the discharge of pollutants or noise into the atmosphere still does not meet the relevant requirements of the national standards for in-use vehicles;

(four) after the expiration of the inspection period, the motor vehicle inspection mark has not been obtained within three consecutive motor vehicle inspection cycles.
