The man owed a loan and failed to pay it back. Will the divorce affect the woman?
If both men and women jointly sign a loan contract, the money belongs to the joint debt of husband and wife. When divorcing, it is necessary to reach an agreement on how to bear the debt.

The two sides agreed that the husband should repay the debt. If the husband fails to repay the debt on time after the divorce, the creditor may sue the husband and wife and demand repayment of the loan. The agreement between husband and wife on how to bear the debt shall not be against the creditor. After paying off the loan, the woman can claim compensation from the man according to the divorce agreement.

Therefore, in real life, it is basically not feasible to escape debt through fake divorce. Creditors may request to cancel the property division clause in the divorce agreement.

Judicial Interpretation of Marriage Law (II) Article 25

If the divorce agreement of the parties or the judgment, ruling or conciliation statement of the people's court has dealt with the division of husband and wife's property, the creditor still has the right to claim rights from both men and women for the joint debt of husband and wife.

If one party claims compensation from the other party based on the divorce agreement or the legal documents of the people's court after assuming joint and several liabilities, the people's court shall support it.
