Legal analysis: If there is no special agreement, the property purchased by loan after marriage should be owned by both husband and wife, and should be divided equally at the time of divorce. Buying a house with a loan after marriage, whether the individual pays the house price or the husband and wife pay the house price together, whether one party repays the loan or both parties repay the loan together, will not affect the formation of the same property.

Legal basis: Article 5 (1) of the Supreme People's Court's Interpretation on the Application of Marriage and Family in the Civil Code of People's Republic of China (PRC), if a party requests to return the bride price paid according to custom, the people's court shall support it if it is found that it belongs to the following circumstances:

(1) Both parties have not gone through the marriage registration formalities;

(2) Both parties have gone through the marriage registration formalities, but they have not lived together;

(3) premarital payment, causing difficulties to the payer.

The application of items 2 and 3 of the preceding paragraph is conditional on the divorce of both parties.
