Legal basis: Measures for the Administration of Second-hand Car Circulation
Article 3 The second-hand car trading market refers to a legally established place that provides centralized trading of second-hand cars and related services for buyers and sellers.
Article 4 The second-hand car business entity refers to an enterprise registered by the administrative department for industry and commerce according to law and engaged in the distribution, auction, brokerage, appraisal and evaluation of second-hand cars.
Article 5 Business activities of second-hand cars refer to activities such as distribution, auction, brokerage, appraisal and evaluation of second-hand cars.
(1) Second-hand car distribution refers to the business activities of second-hand car distribution enterprises in buying and selling second-hand cars; (2) Second-hand car auction refers to the business activities of second-hand car auction enterprises to transfer second-hand cars to the highest bidder by open bidding; (3) Second-hand car brokerage refers to the business activities of a second-hand car brokerage institution as an intermediary, broker or agent for the purpose of collecting commissions and promoting others to trade second-hand cars; (4) Appraisal and evaluation of second-hand cars refers to the business activities of appraisal and evaluation institutions of second-hand cars to appraise the technical status and value of second-hand cars.
Article 6 The direct transaction of second-hand cars refers to the transaction in which the owners of second-hand cars directly sell their cars to the buyers without going through distribution enterprises, auction enterprises or brokerage institutions. Direct trading of second-hand cars should be conducted in the second-hand car trading market.
