Counter-guarantee refers to the guarantee that the third party who provides guarantee for the debtor requires the debtor to provide in order to ensure the realization of its right of recourse.
When the debtor fails to perform the debt at the expiration of the debt settlement period, the third party becomes the debtor's creditor after assuming the guarantee responsibility, and the third party has the right to recover the debt paid by the debtor on its behalf.
When the third party exercises the right of recourse, the right of recourse may be invalid because the debtor is unable to repay. In order to ensure the realization of the right of recourse, a third party may ask the debtor to provide a guarantee for the debtor, which in turn is called counter-guarantee.
