Chapter I General Principles
Article 1 These Measures are formulated in accordance with the Government Procurement Law of People's Republic of China (PRC) (hereinafter referred to as the "Government Procurement Law") for the purpose of standardizing the announcement of government procurement information, improving the transparency of government procurement activities and promoting fair competition.
Article 2 Government procurement information refers to laws, regulations, rules and other normative documents that regulate government procurement activities, as well as data and materials that reflect the state of government procurement activities.

Article 3 Purchasers and procurement agencies shall release government procurement information in accordance with laws, administrative regulations and these Measures.
The procurement agency mentioned in the preceding paragraph refers to centralized procurement agencies and other procurement agencies recognized as qualified according to law.
Article 4 The announcement of government procurement information shall follow the principles of timely information release, unified content specification, relatively centralized channels and easy retrieval.
Fifth financial departments at or above the county level shall be responsible for the supervision, inspection and management of government procurement information announcement activities. However, the following duties shall be performed by the financial department at or above the provincial level:
(a) to determine the scope and content of government procurement information that should be published;
(two) to designate, supervise and inspect the media that publish government procurement information.
Article 6 The Ministry of Finance shall be responsible for determining the basic scope and contents of the government procurement information announcement and designating the national government procurement information publishing media.
Provincial (including cities under separate state planning, the same below) financial departments are responsible for determining the scope and content of local government procurement information announcement, and may designate local government procurement information release media.
Except the Ministry of Finance and the provincial finance department, no other unit or individual may designate the media to release government procurement information.
Article 7 Government procurement information shall first be published in the media designated by the Ministry of Finance.
Local government procurement information can also be published in the government procurement information release media designated by the provincial finance department.
Chapter II Scope and Content of Government Procurement Information Announcement
Article 8 Except for government procurement information that involves state secrets, commercial secrets of suppliers and should be kept confidential according to laws and administrative regulations, the following government procurement information must be announced:
(1) Construction laws, regulations, rules and other normative documents related to government procurement;
(two) the centralized procurement catalogue, the standard of government procurement quota and the standard of public bidding amount published by the people's governments at or above the provincial level;
(3) Directory of government procurement bidding agencies;
(4) Tender information, including tender announcement, tender prequalification announcement, bid winning announcement, transaction result and its correction, etc. ;
(five) the contact information and complaint handling decision of the financial department to accept the government procurement complaints;
(six) the assessment results of the financial department on the centralized procurement institutions;
(seven) the list of bad behavior records of procurement agencies and suppliers;
(eight) other government procurement information that should be published in accordance with laws, regulations and rules.
Article 9 In addition to the contents stipulated in Article 8 of these Measures, the financial departments at or above the provincial level may increase the contents of government procurement information to be published according to management needs.
Article 10 A tender announcement shall include the following contents:
(a) the name, address and contact information of the purchaser and the procurement agency;
(two) the name, purpose, quantity, brief technical requirements or nature of the project subject to tender;
(3) Qualification requirements of suppliers;
(four) the time, place and method of obtaining the tender documents and the selling price of the tender documents;
(five) the deadline for bidding, the time and place of bid opening;
(six) the name and telephone number of the contact person of the procurement project.
Eleventh tender prequalification announcement shall include the following contents:
(a) the name, address and contact information of the purchaser and the procurement agency;
(two) the name, purpose, quantity, brief technical requirements or nature of the project subject to tender;
(3) Qualification requirements of suppliers;
(four) the deadline for submitting the qualification application and certification materials and the date of qualification examination;
(five) the name and telephone number of the contact person of the procurement project.
Article 12 The bid-winning announcement shall include the following contents:
(a) the name, address and contact information of the purchaser and the procurement agency;
(two) the name, purpose, quantity, brief technical requirements and contract performance date of the procurement project;
(three) the date of selection (indicating the number of the tender documents);
(four) the date of the project tender announcement;
(five) the name, address and bid amount of the successful supplier of the construction enterprise;
(6) List of members of the bid evaluation committee;
(seven) the name and telephone number of the contact person of the procurement project.
Thirteenth procurement information correction announcement shall include the following contents:
(a) the name, address and contact information of the purchaser and the procurement agency;
(two) the original announcement of the name of the procurement project and the date of the first announcement;
(three) the way, content and date of correction;
(4) Contact person and telephone number of procurement project.
Article 14 The announcement of the list of bad behavior records of procurement agencies and suppliers shall include the names of the parties, reasons, handling organs and handling results.
Fifteenth complaints handling decision announcement shall include the following contents:
(a) the names of the purchaser and the procurement agency;
(two) the name of the procurement project and the date of purchase;
(three) the name of the complainant and the complaint;
(four) the name of the complaint handling organ;
(5) The main contents of the decision.
Chapter III Administration of Government Procurement Information Announcement
Sixteenth announcement of government procurement information must be true, accurate and reliable, and there shall be no false or misleading statements, and no items that must be announced according to law shall be omitted.
Seventeenth in the designated media to publish government procurement information, the same government procurement information content must be consistent. Where the contents are inconsistent, the information released by the media designated by the Ministry of Finance for government procurement information release shall prevail, except as otherwise provided by laws and administrative regulations.
Article 18 If the time of publishing the same government procurement information on the designated media of government procurement information is inconsistent, the earliest time of publishing information on the government procurement information media designated by the Ministry of Finance shall be the time of announcement and the time when the parties involved in government procurement should know about relevant matters.
Nineteenth government procurement laws, regulations, rules and other normative documents, centralized procurement catalogue, government procurement quota standards, public bidding quota standards and other information, by the financial department of the people's government at or above the provincial level is responsible for the government procurement information designated release media announcement.
Twentieth tender information by the purchaser or its entrusted procurement agency is responsible for the announcement in the government procurement information designated release media.
Twenty-first centralized procurement institutions assessment results and procurement institutions, suppliers bad behavior record list, by the financial department of the people's government at the same level in accordance with the relevant provisions in the government procurement information designated media published.
Twenty-second other information other than those specified in Articles 19, 20 and 21 of these Measures, which belongs to the supervision and administration of government procurement, shall be published by the financial department of the people's government at the same level; If it is a procurement business, the purchaser or its entrusted procurement agency shall make an announcement.
Article 23 If a purchaser or procurement agency needs to release government procurement information, it shall provide it to the designated media of government procurement information by fax or e-mail. , can also be provided by the financial department of the people's government at the same level to the designated media of government procurement information.
Chapter IV Administration of Designated Media of Government Procurement Information
Twenty-fourth government procurement information release media designated to undertake the specific matters of government procurement information release as stipulated in these measures.
Government procurement information should be released through designated media, which should reflect the principle of public welfare.
Twenty-fifth government procurement information designated publishing media shall publish information in accordance with the information content provided by information providers. However, if the information space is too large, the designated release media of government procurement information can be appropriately compressed and adjusted according to the unified technical requirements; Compression and adjustment shall not change the substantive content of the information provided.
Twenty-sixth government procurement information designated release media found that the information provided by information providers in violation of laws, regulations, rules and the provisions of these measures, it should promptly advise the information providers to modify; If the information provider refuses to modify it, it shall report to the financial department of the people's government at the same level as the information provider.
Article 27 The online media in the government procurement information release media designated by the financial department shall be released online within 1 working days from the date of receiving the announcement information; The designated newspaper shall publish it within 3 working days from the date of receiving the announcement information; Designated magazines should publish relevant announcement information in time.
Twenty-eighth government procurement information designated release media shall classify the government procurement information released by them, and submit the statistical results to the financial department of the people's government at the same level on schedule.
Twenty-ninth government procurement information designated media should be published to the public media name and contact information. If the name and contact information change, it shall be announced to the public in a timely manner and filed with the financial department responsible for designating it to release government procurement information.
Chapter V Legal Liability
Thirtieth the purchaser or procurement agency in any of the following circumstances, the financial department of the people's government at the county level shall order it to make corrections within a time limit and give a warning; The directly responsible person in charge and other directly responsible personnel shall be punished by the administrative department or the relevant authorities and notified:
(a) the government procurement information should be published but not published;
(2) Failing to publish information on the government procurement information publishing media designated by the Ministry of Finance, or failing to publish information on the government procurement information publishing media designated by the financial department;
(three) the content of government procurement information clearly violates the provisions of these measures;
(four) the same information published in two or more designated media that publish government procurement information is obviously inconsistent;
(5) Failing to publish information within the prescribed time limit.
Thirty-first buyers or procurement agencies in any of the following circumstances, the procurement is invalid, given a warning or informed criticism by the financial department of the people's government at the county level; If it is the responsibility of the government procurement agency and the circumstances are serious, its relevant business qualifications shall be cancelled according to law:
(1) Restricting or excluding potential bidders with unreasonable conditions in the bidding information;
(2) The information released is untrue and contains false or fraudulent contents.
Thirty-second government procurement information designated release media in any of the following circumstances, given a warning by the financial department of the people's government at or above the provincial level; If the circumstances are serious, the qualification of the designated media for publishing government procurement information shall be cancelled according to law; Causing economic losses, it shall bear the corresponding liability for compensation according to law:
(1) collecting information dissemination fees in violation of prior agreement or in disguised form;
(2) Refusing to publish the information provided by the information provider without justifiable reasons;
(3) delaying the release time of government procurement information without justifiable reasons;
(four) the release of government procurement information has changed the substantive content of information provided by information providers;
(five) other acts in violation of government procurement information management.
Thirty-third any unit or individual who illegally interferes with the announcement of government procurement information shall be ordered by the financial department of the people's government at or above the provincial level to make corrections within a time limit and give a warning; Refuses to correct, transferred to the relevant authorities according to law.
Thirty-fourth any unit or individual who finds that the government procurement information release activities do not conform to the provisions of these measures has the right to complain and report to the financial department of the people's government at the same level, and the relevant financial department shall handle it according to law.
Chapter VI Supplementary Provisions
Thirty-fifth provincial finance departments can formulate specific implementation measures according to these measures.
Article 36 These Measures shall come into force as of September 0, 2004. The Measures for the Administration of Government Procurement Information Announcement (Caiku [2000] No.7) promulgated and implemented by the Ministry of Finance on September 1 1 2000 shall be abolished at the same time.
