According to the Measures for the Administration of Commercial Housing Sales, the real estate development enterprise shall submit the information required for housing ownership registration to the real estate administrative department where the house is located within 90 days from the date of delivery of the commercial housing. Real estate development enterprises shall assist the buyers of commercial housing to handle the procedures of land use right change and house ownership registration.
3. Due to the developer's reasons, the property buyers failed to obtain the real estate license within the time limit agreed in the contract; Or the buyer of the auction house fails to obtain the real estate license within 90 days from the date of delivery of the house, or the buyer of the completed commercial house fails to obtain the real estate license within 90 days from the date of conclusion of the contract, the developer shall bear the liability for breach of contract.

According to Article 18 of the Interpretation of the Supreme People's Court on Several Issues Concerning the Applicable Law in the Trial of Disputes over Commercial Housing Sales Contracts, which was implemented on June 1 2003, the explanation is beneficial to the buyers: if the buyers who purchase existing houses fail to obtain the property ownership certificate within 90 days after the conclusion of the contract due to the seller's reasons, the seller shall bear the liability for breach of contract; If there is no liquidated damages stipulated in the contract or the amount of loss is difficult to determine, it can be calculated according to the total amount of house purchase money paid and with reference to the standard for financial institutions to charge interest on overdue loans stipulated by the People's Bank of China. According to Article 19, if the buyer who purchased an existing house has been over 1 year for 90 days since the date of conclusion of the contract, the court shall support it if he requests to cancel the contract and compensate for the losses due to the seller's reasons. If the real estate license cannot be obtained because of the developer, the owner can take up legal weapons to protect his rights.
