If the payment is overdue for more than three months or the bank makes more than two reminders, the bank will freeze your card and list you as a prohibited customer (blacklist).
At the same time, it may be sued for credit card fraud and malicious overdraft, which will be enforced by the court. If you refuse to repay the loan after prosecution, and the amount owed exceeds 1 000, the court will impose a sentence on the crime of credit card fraud according to Article 196 of the Criminal Law!
Article 196 of the Criminal Law stipulates that in any of the following circumstances, if a large amount of credit card fraud is committed, it shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention, and a fine of not less than 20,000 yuan but not more than 200,000 yuan shall be imposed;
If the amount is huge or there are other serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than five years but not more than ten years, and shall also be fined not less than 50,000 yuan but not more than 500,000 yuan; If the amount is especially huge or there are other especially serious circumstances, he shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment, and shall also be fined not less than 50,000 yuan but not more than 500,000 yuan or confiscated property:
(a) using a forged credit card, or using a credit card fraudulently obtained with a false identity certificate;
(2) Using an invalid credit card;
(3) Fraudulent use of another person's credit card;
(4) malicious overdraft.
Malicious overdraft refers to the behavior that the cardholder overdraws beyond the prescribed limit or time limit for the purpose of illegal possession, and refuses to return it after being urged by the issuing bank. You belong to the fourth situation.
Repay actively and avoid taking legal responsibility. Reasonable use of credit cards:
1, try not to withdraw cash, because not only do you have to charge a handling fee of 1%, but you also have to pay five ten thousandths of interest every day from the date of withdrawal. In short, the interest is very high.
2. Choose the date when you can get the longest interest-free period: on the second day of the billing date, because the consumption record on the second day of the billing date appears on the bill of next month, and the corresponding interest-free repayment date is also the last repayment date corresponding to the billing date of next month, so that you can enjoy the interest-free period to the maximum extent!
3. Buy bulk items, such as laptops, digital cameras and air tickets. You can call customer service in advance (the number is on the back of the card), apply for installment payment, and then find out which merchants your credit card bank cooperates with.
Installment means, for example, if you buy something with a price of 5,000 yuan, apply for installment payment and choose 10 (that is, 10 months) to pay it back. When buying, the merchant will take away all 5,000 yuan and charge a handling fee of several percent. You should discuss with the merchant how much to charge.
Then you owe money to the bank, not to the merchant. You have to divide it into 10 months, and only pay back 500 each month. There is no interest during this period! This not only reduces your repayment pressure, but also solves the problem of insufficient funds.
