Parents pay for their first house to repay the loan. If the house belongs to a person designated by the parents, it is registered in the name of one person. The mortgage is borne by this person and can be regarded as the personal property of one party and cannot be divided; If the parents pay the down payment and the house loan is repaid by the joint property of the married couple, it belongs to the joint property of the husband and wife, and the property can be divided through consultation.

Article 29 of the Supreme People's Court's Interpretation on the Application of Marriage and Family in the Civil Code of People's Republic of China (PRC) (1): Before the parties get married, if the parents contribute to the purchase of houses for both parties, the contribution shall be regarded as a personal gift to their children, unless the parents explicitly indicate that it is a gift to both parties. After the parties get married, if the parents contribute money to buy houses for both parties, it shall be handled in accordance with the agreement; If there is no agreement or the agreement is unclear, it shall be handled in accordance with the principle stipulated in Item 4, Paragraph 1, Article 1062 of the Civil Code.
