Legal analysis: After the bank mortgage is repaid in advance, you need to go to the real estate bureau to go through the following procedures:
1. After the house loan is repaid, you need to go to the bank where the loan is located to go through the formalities and get the certificate of other items of the house. The bank will stamp the official seal on the certificate of other items of the house and write down the cancellation opinions, such as: the loan has been repaid, and you agree to cancel the mortgage.
2. Then, the property owner comes to the mortgage department of the local property housing security and real estate management bureau to handle the mortgage cancellation registration formalities with his real estate license, other warrants and the original ID card.
3. If there are more than one name on the property right certificate, at least one property owner must be present, and the original ID cards of the other property owners can also be handled. If there are minors' names, the guardian must bring the proof to prove the identity of the guardian.
Legal basis: Article 7 of the Detailed Rules for the Implementation of the Provisional Regulations on the Registration of Real Estate is under any of the following circumstances, and the parties may apply for the cancellation of mortgage registration with the necessary materials such as the registration certificate of real estate and the materials for the extinction of mortgage:
(1) the principal creditor's rights have been extinguished; (2) the mortgage has been realized; (3) the mortgagee gives up the mortgage; and (4) other circumstances in which the mortgage has been extinguished as stipulated by laws and administrative regulations.
