Buying a house may put some pressure on the economy. Many people are in urgent need of money and want to mortgage their houses. The real estate license has not been completed yet, and only the purchase contract is in hand. So in this case, can the house be mortgaged? It is understood that only the property of the purchase contract cannot be mortgaged. This is because, the most basic condition for the real estate used for mortgage loan is that two certificates must be complete, namely, People's Republic of China (PRC) Land Use Certificate and People's Republic of China (PRC) House Ownership Certificate. Because only the real estate with complete double certificates can go through the mortgage registration formalities, and the lending institution can obtain his right certificate before lending. But if it is a mortgage loan to buy a house, you can apply for a second mortgage from the bank without a real estate license. However, to handle this kind of loan, it is required that the bank that handles the housing mortgage loan has this business, and at the same time, it is required that the applicant's housing mortgage loan has been repaid on time for more than two years, and the house can only be handled with a certain mortgage value. To apply for housing, the house must meet the following conditions in two mortgage loans: 1. The houses used for secondary mortgage should be high-quality houses and commercial houses with great market development potential; 2. The house used for personal housing in the second mortgage must be an existing house; 3. The house is a first-hand house purchased with a mortgage loan from a loan bank; 4. The house has been registered as mortgage, and the loan bank is from housing mortgages; 5. The house has been insured, and the original policy is managed by the loan bank; 6. The house has excellent location, convenient transportation, complete facilities and great appreciation potential. It can be seen that it is difficult to apply for mortgage loans only for houses with purchase contracts.

Article 63 of the Law on Urban Real Estate Management Where the people's governments of provinces, autonomous regions and municipalities directly under the Central Government determine that the local people's governments at or above the county level are in charge of real estate management and land management, unified certificates of real estate ownership may be issued. In accordance with the provisions of Article 61 of this Law, the confirmation and change of house ownership and land use rights within the scope of house occupation shall be recorded in the certificates of real estate ownership respectively.
