The mortgagor shall carry his identity certificate (if the mortgagor or mortgagee is an individual), xx real estate mortgage contract (one copy), application form for cancellation of real estate mortgage, application form for cancellation of registration of xx public (private) housing mortgage, house ownership certificate, state-owned land use certificate and other property rights certificates, and go through the mortgage cancellation procedures at the local mortgage registration acceptance window.
Third, the staff of the mortgage registration acceptance window will review the application materials for mortgage cancellation. After the materials are correct, go through the cancellation procedures at the counter. After the cancellation procedures are completed, the real estate license and state-owned land use certificate are returned to the mortgagor, and other cancellation materials are kept by the window staff.
Legal basis: Article 35 of the Measures for the Administration of Urban Real Estate Mortgage, when the mortgage contract is changed or the mortgage relationship is terminated, the mortgage parties shall go to the original registration authority to change or cancel the mortgage registration within 15 days from the date of change or termination. If the mortgaged real estate is punished according to law and the land use right and the ownership of buildings and other attachments on the ground are obtained, the mortgagor shall, within 30 days from the effective date of the punishment, apply to the real estate management department of the local people's government at or above the county level for registration of change of property right, and apply to the land management department of the people's government at the same level for registration of change of land use right on the basis of the changed house ownership certificate.
