Article 4 Commercial banks shall operate independently based on the operating principles of safety, liquidity and efficiency. Take your own risks, be responsible for your own profits and losses, and exercise self-discipline. Commercial banks conduct business in accordance with the law and are not subject to interference by any unit or individual. A commercial bank shall bear civil liability independently with all its legal person property.
Article 5: Commercial banks’ business dealings with customers shall abide by the principles of equality, voluntariness, fairness and good faith.
Article 11 The establishment of a commercial bank shall be subject to review and approval by the banking regulatory authority of the State Council. Without the approval of the banking regulatory authority of the State Council, no unit or individual may engage in commercial banking business such as accepting deposits from the public, and no unit may use the word "bank" in its name.
Article 12 To establish a commercial bank, the following conditions must be met: (1) Have a charter that complies with the provisions of this Law and the "Company Law of the People's Republic of China"; (2) Have a charter that complies with this Law; The prescribed minimum registered capital; (3) having directors and senior managers with professional knowledge and business experience; (4) having a sound organizational structure and management system; (5) having business premises and safety precautions that meet the requirements measures and other facilities related to the business. The establishment of a commercial bank must also meet other prudential conditions.
