Measures for the Administration of Foreign Aid (for Trial Implementation)
Chapter I General Provisions Article 1 In order to standardize the administration of foreign aid and improve the effect of foreign aid, these Measures are formulated in accordance with the provisions of relevant laws and administrative regulations. Article 2 The term "foreign aid" as mentioned in these Measures refers to the activities of providing economic, technical, material, talent and management support to the recipient by using government foreign aid funds (hereinafter referred to as foreign aid funds). Article 3 The recipients of foreign aid mainly include developing countries that have established diplomatic relations with People's Republic of China (PRC) and need assistance, as well as international or regional organizations that are mainly developing countries.

In case of emergency or special circumstances such as humanitarian assistance, developed or developing countries that have no diplomatic relations with People's Republic of China (PRC) can also serve as recipients. Article 4 Foreign aid should respect the sovereignty of the recipient country, not interfere in the internal affairs of the recipient country, strive to alleviate and eliminate poverty in the recipient country, improve the national life and ecological environment of the recipient country, promote the economic development and social progress of the recipient country, enhance the independent development ability of the recipient country, and consolidate and develop friendly and cooperative relations with the recipient country. Article 5 The Ministry of Commerce shall be responsible for foreign aid work, formulate and implement foreign aid policies and programs, formulate foreign aid plans, determine foreign aid projects (hereinafter referred to as foreign aid projects) and organize their implementation, manage the use of foreign aid funds, and carry out international exchanges and cooperation in foreign aid.

The economic and commercial institutions of embassies and consulates abroad assist the Ministry of Commerce in handling foreign aid-related intergovernmental affairs and are responsible for overseas supervision and management of the implementation of foreign aid projects.

Provincial commerce authorities shall assist the Ministry of Commerce in handling foreign aid management. Article 6 The Ministry of Commerce shall establish a full-caliber foreign aid statistical system to collect, summarize and compile foreign aid statistical data. Article 7 The Ministry of Commerce shall formulate unified foreign aid signs and be responsible for the supervision and administration of the use of the signs. Chapter II Foreign Aid Policy Planning Article 8 The Ministry of Commerce shall, jointly with relevant departments, formulate medium and long-term foreign aid policy planning and country aid guidelines, which shall be implemented after approval. Article 9 The Ministry of Commerce shall establish a reserve system for foreign aid projects. Tenth foreign aid reserve projects are the main basis for the preparation of foreign aid fund plans and budgets and the establishment of foreign aid projects. Article 11 The Ministry of Commerce is responsible for collecting, examining and determining the foreign aid reserve projects of specific countries, and implementing dynamic management of the determined reserve projects. Chapter III Ways of Foreign Aid Article 12 Foreign aid funds mainly include free aid, interest-free loans and preferential loans.

Free aid is mainly used for the aid needs of recipients in poverty alleviation, people's livelihood, social welfare, public services and humanitarianism;

Interest-free loans are mainly used for the assistance needs of recipients in public infrastructure and industrial and agricultural production;

Preferential loans are mainly used to support economically productive projects, large-scale infrastructure construction and the provision of bulk mechanical and electrical products and complete sets of equipment in recipient countries. Article 13 Except in special circumstances, foreign aid shall be organized and implemented by the Ministry of Commerce in the form of intergovernmental aid. Fourteenth foreign aid is mainly project aid.

In emergency or special circumstances such as humanitarian assistance, cash assistance can be provided to the recipients. Fifteenth foreign aid projects mainly include the following types:

(1) Complete sets of projects, that is, with foreign aid funds, the Chinese side provides complete sets of equipment and engineering facilities for production, living, public services and other services to the recipient through organizing or guiding the whole or part of the construction, installation and trial production, and provides long-term quality assurance and supporting technical services;

(2) Material projects, that is, projects in which China provides general production and living materials, technical products or single equipment to the recipient under foreign aid funds, and undertakes necessary supporting technical services;

(3) Technical assistance projects, that is, under foreign aid funds, the Chinese side comprehensively adopts means such as selecting experts, skilled workers or providing equipment to help the recipient achieve specific technical goals;

(4) Human resources development cooperation projects, that is, projects in which China provides various forms of academic degree education, short-term and medium-term training, personnel exchange and senior expert services for officials and technicians of recipient countries under foreign aid funds;

(5) Volunteer service projects, that is, projects in which China sends volunteers to the recipients to engage in public welfare services under foreign aid funds. Chapter IV Establishment of Foreign Aid Projects Article 16 Except for emergency or special circumstances such as humanitarian aid, foreign aid projects to be established shall be determined from foreign aid reserve projects. Seventeenth foreign aid projects should go through feasibility study before they are approved.

China can ask the recipient countries to provide relevant information about the proposed project as a prerequisite for the feasibility study. Article 18 Except for projects that need to be submitted to the State Council for approval according to relevant regulations, the Ministry of Commerce shall decide whether to establish a project according to the feasibility study results. Article 19 After the establishment of a foreign aid project, the Ministry of Commerce shall generally negotiate and sign an agreement with the recipient.

The project agreement shall specify the technical contents, funding arrangements, rights and obligations of all parties to the agreement, especially:

(a) the local supporting conditions required for the project implementation and subsequent operation, guarantee or management responsibilities;

(2) To bear or exempt from customs duties and other taxes and fees the equipment and materials, general materials and a reasonable number of living materials for foreign aid workers imported from China to the recipient under foreign aid projects;

(three) to facilitate the entry, residence and work of Chinese equipment and materials, general materials and foreign aid personnel;

(4) Courtesy of foreign aid workers who carry out foreign aid projects in the recipient country, and measures to ensure the safety of personnel.
