If the lender runs away and has a guarantor, according to the relevant provisions of China laws, it can be handled in the following ways:
1. Joint guarantee refers to the guarantee that the parties agree in the guarantee contract that the guarantor and the debtor shall bear joint and several liabilities for the debt, or that there is no agreement or unclear agreement on the way to apply for proof.
2. If the borrower fails to perform the repayment obligation as agreed in the loan contract, the creditor may require the guarantor to undertake the guarantee responsibility within the term of the guarantee contract. If the guarantee period is not agreed, the creditor has the right to require the guarantor to assume the guarantee responsibility within six months from the date of expiration of the independent debt performance period.
3. If the guarantor fails to perform the suretyship responsibilities as agreed in the contract, the creditor may bring a lawsuit to the people's court according to law and demand a judgment for repayment.
4. If the sole domicile of the guarantor meets the conditions stipulated in Article 20 of the Provisions of the Supreme People's Court on Several Issues Concerning the Handling of Objection Reconsideration Cases by People's Courts, it can be executed.
If the debtor fails to repay the debt within the time limit, there are several ways to protect the rights as a guarantor:
First, if it is a general guarantee, the creditor needs to sue the debtor to claim rights from the guarantor, otherwise it has no right to directly ask the guarantor to bear the guarantee responsibility;
Second, if it is a joint guarantor, the creditor can directly find the guarantor to bear the guarantee responsibility;
Third, after the debtor absconded, the guarantor can directly inform the creditor of the fact that he evaded the debt and ask the creditor to take legal measures to protect his rights;
Fourth, if the creditor neglects to exercise the right that the guarantor can undertake the obligation of guarantee, he shall recover from the debtor. It can be seen that if the lender escapes and fails to pay back the waste, the guarantor should usually perform the guarantee responsibility, but he can recover from the debtor.
